A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,
FLORIDA,AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH SERRALTA
REBULL SERIG,INC.FOR THE SNAPPER CREEK DRAINAGE IMPROVEMENTS -PHASE 2
CONSTRUCTION IN THE AMOUNT OF $141,292.50 TO BE CHARGED TO SOUTH FLORIDA WATER
MANAGEMENT DISTRICT GRANT ACCOUNT NO.001-0000-132-2060;PROVIDING FOR AN
EFFECTIVE DATE
WHEREAS,the Mayor andCity Commission wishes to provide drainage construction
improvements within the Snapper Creek area (SW 87th Street from SW 58th Avenue to SW 59th Avenue and SW
58th Avenue fromSW 85'Street toSW87 'Street)under a project known as Snapper Creek Drainage
Improvement -Phase 2 and;
WHEREAS,the construction activities will consist of drainage system improvements,right-of-way
re-grading,re-surfacing andpavementmarkingwithinthe construction corridor,and;
WHEREAS,the Mayor andCity Commission authorize theCity Manager to execute a construction
contractwith Serralta RebullSerig,Inc.for Snapper Creek Drainage Improvements -Phase2 project inan
amount of $141,292.50.
NOW THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI.FLORIDA:
Section 1:The city wishes to piggy-back onthe existing Snapper Creek -Phase 1 contract
which was awarded to Serralta Rebull Serig.Inc.on June 3,2003and executed on June 19,2003.
Section 2:The engineering consultant reviewed the proposal submitted by Serralta Rebull
Serig,Inc.and confirmed thattheunit prices for Snapper Creek -Phase 2 were consistent with those submitted
onMay 13.2003forthe Snapper Creek -Phase1 contract.
Section 3:The project willbefunded through a grant from Legislative Appropriation funds
managedbySouth Florida Water Management District under grant account number 001-0000-132-2060.
Section 4:That the Mayor andCity Commission authorize theCity Manager to execute an
agreementwithSerraltaRebullSerig.Inc.forthe construction of Snapper CreekDrainageImprovements-
Phase 2inan amount of $141,292.50.

A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,
FLORIDA,AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH

BACKGROUND &ANALYSIS
The proposed roadway project is intended to provide much needed drainage improvements along
SW87*Street between SW 58th AvenueandSW 59th AvenueandSW 58th AvenuefromSW
85 Street to SW 87 Street.The construction activities will also include grading,resurfacing
and pavement marking within the disturbed corridor.Serralta,Rebull,Serig,Inc.was previously
awarded the Snapper Creek Drainage Improvements -Phase 1 contract on June 3,2003asthe
lowest responsible andeligible bidder andhascompletedtheworkina satisfactory manner.Inan
efforttosavetimeandmoneybynotgoingouttobid,theCity requested a proposal from
Serralta,Rebull,Serig,Inc.forthe Snapper Creek Drainage Improvements -Phase 2 which
couldbe piggy-backed ontothePhase1contract.This process reduces the possibility of
receiving increased unit prices,which canoccur if the project is advertised forbids.The
engineer of record has reviewed theunitpricesinthe proposal submitted by Serralta Rebull
Serig,Inc.andhas confirmed that theyare consistent with the prices previously submitted under
the Snapper Creek Drainage Improvements -Phase1 contract on May 13,2003.
This project will be funded through a Legislative Appropriation grant administered by South
Florida Water Management District.The project's account balance,without this project,is
$630,600.00.PublicWorks Department's account management sheet,per submitted requisitions
is attached.

The undersigned,as Bidder,hereby declares that the only person or persons interested in the Proposal,as
principal or principals,is or are named herein and that no other person than herein mentioned has any interest in
the Proposal of the Contract to which the work pertains;that this Proposal is made without connection or
arrangement with any other person,company,or parties making a bid or proposal and that the Proposal is in all
respects fair and made in good faith without collusion or fraud.
The Bidder further declares that he has examined the site of the work and that from personal knowledge
and experience,or that he has made sufficient observations ofthe conditions ofthe project site to satisfy himself
that such site isa correct and suitable one for this work and he assumes full responsibility therefore,that he has
examined the Drawings and Specifications for the work and from his own experience or from professional advice
that the Drawings and Specifications are sufficient for the work to be done and he has examined the other
Contractual Documents relating thereto,including the Notice of Bid Invitation,Instructions to Bidders,Proposal,
Contract,General and Special Conditions,Technical Specifications,Drawings and has red all addenda prior to the
receipt of bids,and that he has satisfied himself fully,relative to all matters and conditions with respect to the
worktowhichthis Proposal pertains.
The Bidder further proposes and agrees,if this Proposal is accepted,to contract with the City of South
Miami (Owner),in the form of contract specified,to furnish all necessary materials,all equipment,all necessary
machinery,tools,apparatus,means of transportation,and labor necessary to complete the work specified in the
Proposal and the Contract,and called for by the Drawings and Specifications and in the manner specified.
The Bidder further proposes and agrees to comply in all respects with the time limits for commencement
and completion ofthe work as stated inthe Contract Form.
The Bidder further agrees that the deductions for liquidated damages,as stated in the Contract Form,
constitute fixed,agreed,and liquidated damages to reimburse the Owner for additional costs to the Owner
resulting from the work not being completed within the time limit stated inthe Contract Form.
The Bidder further agrees to execute a Contract and furnish satisfactory Performance and Payment Bonds
each inthe amount of one-hundred percent of the Contract price,within ten (10)consecutive calendar days after

written notice being given bythe Owner ofthe award ofthe Contract,and the undersigned agrees thatin case of
failure on his part to execute the said Contract and Performance and Payment Bonds within theten (10)
consecutive calendar days after the award ofthe Contract,the cashier's checkorBidBond accompanying hisbid
and the money payable thereon shall be paid tothe Owner as liquidation of damages sustained bythe Owner;
otherwise,the check accompanying the Proposal shall be returned tothe undersigned after the Contract is signed
andthePerformanceandPaymentBondsare filed.
The undersigned agrees to accept in full compensation therefore thetotal of thelumpsum prices for the
items named inthe following schedule,based onthe quantities actually constructed as determined bythe
applicable measurement and payment portion ofthetechnical specifications.
