(2)The front yard setback variance requested will resultina T-6"front setback for the proposed addition.This is a unique situation due tothe curvature created bythe right-of- way along SW65Avenueandthe irregular shapeofthe lot (3)It is important tonotethatthe design and construction ofthe original home in 1956 also took into account the irregular shape of the lot and its orientation to the curved right-of- way.This construction was accomplished bythe granting ofa variance was by Resolution No.891 (attached),passed and adopted on June 12,1956.The approved variance was for a 15 foot setback from the side and rear property lines,and a 15 foot setback from front property line. (4)The applicants Letter of Intent states that the irregular shaped parcel is a hardship and the special circumstances of the existing street curvature along SW 65 Avenue justify the granting of the variance. The approval of the variance is consistent with the City's general intent and purpose of the code;preserves the character of the neighborhood,which is predominately single-story residences;and will notme injurious to the neighborhood or otherwise detrimental tothepublic welfare. At the October 14,2014 Planning Board meeting,the board reviewed Application PB-14-010 for the requested variance,and following a public hearing on the application,voted 4 ayes and 2 nays torecommendthedenialofthe variance asrequested.Please refertotheattached summary of the discussion. Recommendation Pursuant to the recommendations of the Planning Board and the City Attorney,staff recommends denial of the request as presented.The City Commission can approve the application as submitted,approve with conditions/modifications or deny the application. Should the Commission recommend approval of the requested variance,the development shall comply with all other City Code requirements. Mr.Carrerasasked staff if the applicant couldbuilda two-story additionatthefront of thehouseoncethevariancewasapproved.Mr.Brimostatedyes,butthesecondstory portion of thehomewouldhavetobesetbacksothatitcomplieswiththe LDC.He thenstatedthatasecondvariancewouldberequirediftheapplicantwantedtobuildthe second story addition with afront setback of 7'-6". Mr.Greiner asked thecity attorney ifthe hardship with the property wasself created because the applicant is choosing to build the addition.Mr.Pepe responded that if the applicant had purchased the property before 1956 and the City changed its regulations, then that would create a hardship.If the applicant purchased the property knowing what the setbacks were,4then heis taking the property subject to those setbacks.In essence, the hardship was created by the applicant when he purchased the property.He knew thathe couldn't buildany closer tothestreet. Mr.Greiner asked staffif enclosed garages were typical ofthe neighborhood,of which Mr.Brimo stated yes. Ms.Fischer stated that itisa big stretch to consider this request a hardship.She then stated that even though it has no bearing on the setbacks,the proposed site plan shows VA bathrooms,which equates to one bathroom for each ofthe bedrooms in the house, anda swimming pool.Shethen stated thatthis type of lifestyle does not match the definition ofa hardship.She then stated that hundreds of residents of the city live in structures thatwerebuiltinthe 1950's thathavesmall bathrooms andsmallclosets. Based on that,all of the residents should have a situation of hardship. Dr.Philips asked staffifthe impervious coverage forthelotcouldbe decreased if some ofthe pavers were replaced by pervious paver systems,of which Mr.Brimo stated yes. Ms.Fischerstatedthat if the applicant weretobuildaonecargarageinsteadofthetwo cargaragethatis proposed,thegaragecouldbesetbacktotheexistingfrontwall.Dr. Philips stated thatthe variance would still be needed regardless ofthe size ofthe garage were reduced. Mr.Greiner stated thatduetothe language thatisinthe Land Development Code,heis havingdifficultyrecommendingapprovalforthevariance.Hestatedthatwhilethe proposedadditionconformstothe neighborhood andmeetsdesign standards,itisnota hardshipcreatedbytheLand Development Code.Itisahardshipcreatedbythe owner. Dr.Whitmanstatedthathisimpression of ahardshipwaswhentheownercouldnot buildontheland.Hethenstatedthat if thegarage weren't added,thentheaddition could be built without thevariance.Because of this,hestatedthathe didn't seea hardship. Mr.Carrerasstatedthatthehouse,asis,doesnotcomplywiththecurrentsetback requirements of thedistrict.Hethenasked staff if any addition would adheretothe currentfrontsetbackrequirement,orwouldthisvarianceestablishprecedence.Mr. Brimo responded that if thesecondstorywasbuilt,itwouldhavetobesetbacksothat it complied withthe regulations.Hethenaddedthat there isa concern inthe neighborhood thatatwostoryhousewouldbebuilt. Justification for hardship Di Donato Residence 6001 SW 65 Ave,South Miami FL 33134 Request for Variance Thisapplicationforavarianceand determination forahardshipisdueto the irregularshape of the 14,656 sqft.lot located at6001SW65Ave.The house is situated onapiano shaped lotonanangle making itdifficultforany expansion on the northend of the property.Consideringthisisalargelot that I payfull property taxes on,I feel that myuse of the landis very limited. Since this isan older house constructed in1956 the amenities are not upto today's standards;suchas the small closets,bathrooms,no laundry areaandsmallgarage space.Our new plans opt fora2car garage which many of the houses in the area enjoy;asa growing family with multiple vehicles,itis very difficult to store items and keep our vehicles safe.We cannot expand the existing garageasitis located next to an existing pool.Our proposal requests that the new garage be situated 7.61 from the property lineas we have no other option for this expansion.Thisis currently an open space with no specimen tress and will not impact the surrounding nature. With much consideration anda great deal of thought,we feel this proposal will benefit us without impacting our neighbors or the community or environment.I kindly ask the commission grant a variance to allow my family to enjoy what many other new homes do.
