BACKGROUND: In November 2013,Gloria Betancourt submitted an application tothe City for preliminary review ofa tentative platthatwas being filed with Miami-Dade County.A tentative plat application No.T-23437-2- COR was also filed with Miami Dade County,pursuant to Section 28-4 of Miami Dade County Code and Section 20-4.2 of the City's Land Development Code.The applicant owns the property specifically locatedatthesoutheastcorner of SW68thAvenueandSW72Street,withinan RS-2 Semi-Estate Residential zoning district andis requesting this replat in order divide the property into two buildable residentiallots.Theparenttractiscurrentlyvacant. Only 25-feet of right-of-way exists along that portion of SW 68th Avenue,and the pavement width for vehicles between SW 74th St.and SW 72nd St.(Sunset Drive)is approximately 10-12 feet,which creates a dangerous condition for two-way traffic.The applicant is providing an additional 25-feet of right-of- way onthe east side of SW 68th Avenue for the necessary roadway and drainage improvements as part of this final plat,and pursuant to Section 20-4.2(C)of the land development code,which states the following: (1)Sidewalks,curbs,gutters,drainage and paving shall be installed by the developer in accordance with Chapter 28ofthe County Code and other applicable city requirements,unless such can be andarewaivedordeferredbythecity commission. I" ! ! ! ! 35 T J » s- 8 S S 5 r . » i ^ IQ CS - t f y T M I T SJ P V E T ma W O — > 3 3 3 / 4 0 2 / 2 RIGHT-OF-WAY IMPROVEMENT AGREEMENT BETWEEN CITY OF SOUTH MIAMI, ANDREW GRANDIO &CYNTHIA TAVERNA THIS AGREEMENT is entered into on the *5 day ofCE^uc^,2efi-by and between ANDREW GRANDIO &CYNTHIA TAVERNA (jointly referred toas "Owiier")and the CITY OF SOUTH MIAMI,a political subdivision of theState of Florida and WHEREAS,Owner ownsreal property (theProperty)locatedintheCityand generally described by tax folio number 09-4035-000-0020 and located at the southeast corner of the intersection of SW 68 Avenue and SW72 Street and legally described on Exhibit "A"attached hereto;and WHEREAS,Owner hasan application forFinal Plat pending with City andthe City's Code (specifically Section 17-9)requires an agreement to accompany any proposed plat of lands in order to provide for"the construction of street paving,parkways and other improvements within such proposed subdivision as wellasthe public right-of-way adjoining therealestatein accordance withthecity's specification"and; WHEREAS,in order to comply withSection 17-9 of theCity of SouthMiamiCode,the Owner andthe City hereby enterintothis Agreement to accompany Owner's pending plat request basedonthetermsand conditions contained herein. NOW,THEREFORE,in consideration of the mutual promises,covenants and conditions hereinstated, the parties stipulate and agree as follows: 1.Theabove referenced recitalsaretrueand correct and incorporated hereinbyreference.All references totheword"City"shallmeantheCityManagerunlessthewordisuseinacontextthat indicates that it means theCity of SouthMiami. 2.TheOwnershall,priortotheissuance of anypermitsfor construction ontheproperty,other thanpermitsfortheright-of-wayimprovements,constructtheright-of-wayimprovementsreflectedona sketchsubmittedwiththeproposedPlat of GrandioseSubdivision,andasapprovedandrequestedor requiredbyMiami-DadeCounty("MDC")(hereinafterreferredtoasthe "Improvement")which improvements shall include the dedication oflandonSW68Avenuetoachievea dedicated right-of- way of fifty(50)feetforthatportionofSW68Avenuethatabutsandrunsparalleltothewestboundary ofthePropertytogetherwithpaving improvements tothesoutheastcorneroftheintersectionofSW68 AvenuewithSW72Streetinaccordancewiththecity'sspecificationsandattheexpense of theowners of thelandtobesubdivided.TheworkontheImprovementshallnotcommenceuntiltheworkis approved inwriting ("Approved Work")bytheCity Manager andtheDirectorof Public Works for the City. 3.Apermitforverticalconstructiononthepropertymaybeissuedbutonlyifitisissued contemporaneously with,orafterthe issuance of,thepermitforthesubdivision improvement.Neither permitmaybeissueduntiltheCity Manager issues the approval ofthe subdivision work ("Approved Work"),andtheverticalconstructionpermitshallnotbeissueduntilallappropriategovernmental agenciesapprovethefinalplatandupontimelydeliveryofallrequired insurance,bondsandlettersof credit required by this agreement. 4.TheabovereferencedImprovementmaybeamendedbytheCity Manager ("Modified Improvement")atthetimethatheapproves of theWork.TheImprovementortheModified Improvement,whicheveristheApprovedWork(alsoreferredtoasPhaseI),maybesecuredbya performance bondorirrevocablestandbyletter of creditwithanexpirationdate of atleasttwoyear's followingthedate of issuance of thenoticegivenbytheCityManagerfortheApprovedWork.PhaseI shallbe ccfypipted withinone(1)yearfromthedateoftheissuanceofnoticeof the Approved Weffc, Page 1 of5 &November 14,2015 or within a shorter time if aletter of credit is issued inlieu of a performance bond tosecuretheperformance of theApprovedWork,inwhichlattereventtheApprovedWorkmustbe completed nolaterthanoneyearbeforetheexpiration of theletter of creditoroneyearfromthedate of the issuance of thenotice of Approved Work,butinanyevent Phase Ishallbe completed withinone year of thedate of submission of thefinalplatforapprovalbytheCity Commission,whichever isthe shorter period of time. 5.If theCity Manager modifiesthescope of the improvement to something lessthanisrequired or suggested by MDC,then,following construction of the Modified Improvement,theCity Manager may,in his/her sole discretion,and within two years of thedate of this agreement,notify Owner that the improvement shall conform tothe improvement suggested or required by MDC ("the MDC Improvement")anditshallbe designated asPhaseH.TheMDC Improvement/Phase IIshallbe completed within one year of thedatethatthe Owner received the notification fromthe City Manager that theCity requires the construction of theMDC Improvement. 6.Owner shall deliver tothe City an irrevocable standby letter of credit for Phase II which shall remain in effect foratleastoneyearfollowingthe completion of PhaseH.Owner shallalso deliver to theCitythe standard Cityrequiredpaymentand performance bondsand insurance policies (including the decimation page of thepoliciesandallrequired endorsements),thatarenormallyrequiredbythe Cityforpublic construction projects,forPhaseI,beforethe performance of any of the construction of therequired improvements asrequiredinSection17-9 of theCity'sCodefortheWork.Owner may deliver an irrevocable standbyletter of credit,inlieu of a performance bondforPhaseI.The performance bond/letter of credit shallremainin effect foratleastone year following thedate of completion of Phase I.The amount of the Performance Bond/irrevocable standby letter of credit for PhaseIshallbe$14,300.00andtheamount of theirrevocablestandbyletter of creditforPhaseIIshall be $18,000.00.TheOwnershallberesponsibleforallcostsandfeesrelatedtotheinsurance,the Payment and Performance Bonds as well as for the cost of the letter of credit.The letter of credit for Infy Phase II shall remain in full force and effect for four years from the date of this agreement Novembe^yj 14,2014,or,if Owner is not timely notified to perform the MDC Improvement,the City Manager shall / issue aNotice of Cancellation of the Phase II letter of credit which shall be notiarized by the City Clerk l^jC andacknowledgingthattheissuer of theNoticeofCancellationistheCityManagerfortheCityof/ SouthMiami.Therequiredinsurance,theBondsandletter of creditshallbedeliveredtotheCityatthe time of deliveryofthisfullyexecuted Agreement.IftimelynotifiedtoperformPhaseII,theOwner shallprovidetheCity,within10daysofsuch notification,with insurance policies (including the declarationpageofthepoliciesandallrequired endorsements),thatarenormallyrequiredbytheCity forpublic construction projects,forPhaseH.Failure totimelydeliverthe insurance policies,including thedeclarationpage of thepoliciesandtherequired endorsements,therequiredbondsandtheletterof creditshallbeconsideredasubstantialbreach of thisAgreement. 7.Ownershallsatisfyallstate,countyandCityplanreview,permitting andconstruction standards. 8.AllnoticesgivenorrequiredunderthisAgreementshallbedeemedsufficientifsentby certifiedmail,returnreceiptrequested,bycustomaryelectronicmeans,includingfacsimile
