A Resolution ruling on the appeal from the decision of the Environmental
Review and Preservation Board regarding application to install non-
illuminated signage at 7000 SW 59th Place, South Miami, Florida
WHEREAS, the Environmental Review and Preservation Board (ERPB) at its
November 1, 2011 meeting reviewed Application No. ERPB -11 -081, and deferred the request
for signage at 7000 SW 59th Place, so the applicant could comply with modifications requested
by the Board; and
WHEREAS, on December 20, 2011 the applicant, resubmitted a revised signage request
to the ERBP based on the modifications requested by the Board at the November 1, 2011; and
WHEREAS, the ERPB at the December 20, 2011 meeting discussed the size and style of
the font being used on the proposed sign, made a motion modifying the design presented by the
applicant, and approved said motion by a vote of 4 yes; 0 no; and
WHEREAS, the applicant on January 5, 2012 filed an appeal to the decision of the
Environmental Review and Preservation Board, stating that they complied with the Board's
earlier (November 1, 2011) request for a modification to the proposed signage, and that the
recommendation by the Board changed from the previous meeting; and
WHEREAS, Section 20- 6.2(A) of the Land Development Code allows for an appeal of
an ERPB decision to be made to the City Commission by the applicant, interested citizens, or the
City Administration; and
WHEREAS, Section 20 -6.2 (E) of the Land Development Code provides that the City
Commission may reverse, affirm, or modify any decision of the Environmental Review and
Preservation Board on which there has been an appeal.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT:
Section 1. The decision of the Environmental Review and Preservation Board made on
December 20, 2011 regarding the application for approval of a signage installation located at
7000 SW 59th Place is hereby affirmed /reversed/reversed with the following instructions:
Section 2. This resolution shall be effective immediately upon adoption.

located. at 7000 SW 59th Place, South Miami, 'Florida; and providing an effective
date,
BACKGROUND:
The proposed permanent signage is located in the "MO" Mediun- Intensity Office
district, and pursuant to Section 20- 4.3(1)(5) The Land Development Code (All Other
Zoning Districts],: flat signage for this zoning district is permitted as follows:
FLAT SIGNS with a total aggregate sign area, not to exceed (2 0) percent of the area
of any building face; for the purpose of sign regulation, there shall be considered to
be onlyfour (4) facades to any building; no single sign shall exeeed:two hundred
(200) square feet in area Direct illumination is permitted,
At its November 1, 2011 meeting, the Environmental Review and Preservation Board
(ERPB) deferred a non - illuminated signage request for 7000 SW 59th Place [Exhibit A]
in order for the applicant to modify the design for "clarity" and to be consistent with the
other Laskin Hospital buildings, and consider the "hierarchy" of the signage in the
redesign; i.e. the name of the hospital and theservice(s) provided.
The applicant resubmitted the revised signage proposal to be heard by the SRPB at the
December 20, 2011 regular meeting [Exhibit B]. The redesigned sign complies with the
requirements of the City's Land. Development Code for "flat signs" and was presented to
the Board with a staff recommendation for approval. At that meeting Board discussed the
type of services being provided at that location and the size and style of the fonts being
used for the sign. The Board approved a motion [minutes attached] that further changed
the design, as presented. This recommended change is the subject of the applicants
request for an appeal to the 'ERPB decision. The applicant has also provided a draft
graphical depiction of the proposed sign based on the December 20, 2011 Board motion
[Exhibit C].
APPEAL ITEM:
The applicant provided a letter in conjunction with the appeal that was received by the
Planning & Zoning Department on January 5, 2012. Generally it states the following;
"Upon resubmitting the ERPB changed their recommendation to having all of the letters
in the logo and primary message match in size and color which completely contradicts
their first recommendation and makes no sense from a visual standpoint."
The Land Development Code (Section 20- 6.2(A)) provides that a decision made by the
ERPB may be appealed to the City Commission by the City administration, the applicant,
or an interested citizen. Attached is an appeal to case number ERPB -11 -081, filed by the
applicant, on January 5, 2012. The City Commission has 60 days from the filing date to
hear the appeal and enter a decision (reverse, affirm or modify the ERPB decision).
In order for the Commission to properly review the appeal, staff has attached the reports
for case number ERPB 11 -081 from November 1, 2011, and December 20, 2011; and the
minutes from those meetings.
20 -6.2 - Appeals.
(A) ERPB Decisions; Time; Standing to Appeal. All decisions and
recommendations of the environmental review and preservation board (ERPB)
shall be posted on the City Hall bulletin board immediately following the ERPB
meeting. An applicant may apply for a building permit after noon of the day after
the ERPB meeting, at which the application was given final approval, if all other
requirements for the permit have been met. An appeal of an ERPB final decision
or recommendation may be filed within thirty (30) days of the ERPB final
decision or before a building permit is issued, whichever comes first, by filing
same with the city clerk upon a form prescribed therefore. Appeals may be filed
by the applicant, a property owner, business owner, or resident of the City, the
city administration, or any interested citizens living in an abutting municipality
and within 500 feet of the property under review.
(B) Stay of Proceedings. An appeal stays all proceedings in furtherance of the
action appealed from, unless the officer from whom the appeal is taken certifies to
the city commission, after notice of appeal has been filed with him, that because
of the facts stated in the certificate a stay would, in the officer's opinion, cause
imminent peril to life or property or that because the violation charged is
transitory in nature a stay would seriously interfere with enforcement of the Code.
(C) Restraining Orders. If certification occurs in accordance with subsection (B)
above, proceedings may not be stayed except by a restraining order, which may
be granted by the city commission or by a court of record on application, on
notice to the officer from whom the appeal is taken and on due cause shown.
(D) _Appeal Hearing. The city commission shall hear and enter a decision on all
appeals within sixty (60) days of the date of filing said appeal, and shall provide
due notice of the appeal to the parties.
(E) Commission Action. The city commission may reverse, affirm or modify any
order, requirement, decision or determination appealed from and shall make any
order, requirement, decision or determination that in the city commission's
opinion, ought to be made in the circumstances.
(F) Modification Allowed. When practical difficulties or unnecessary hardships
would result from carrying out the strict letter of a Code provision, the city
commission may, in passing upon appeals, vary or modify any regulation or
provision of the Code relating to the use, construction or alteration of buildings or
structures or the use of land, so that the spirit of the Code is observed, public
safety and welfare secured, and substantial justice done.
(G) Prior Denials. The city commission shall not be required to hear an appeal or
application previously denied if it finds that there has been no substantial change
in conditions or circumstances bearing on the appeal or application.

Five months ago we submitted a permit application to install a non illuminated sign
at 7000 SW 590' Place in South Miami on behalf of Larkin Community Hospital.
The sign was in accordance with the regulations for size and content.
The design was rejected by the ERPB as they were concerned that the public would
confuse the Larkin Logo with the actual hospital building.
Per the board's recommendation we redesigned the sign and reduced the size so that the
purpose of the building would be the primary message and the hospital's logo would be
secondary.
We met with the hospital board of directors to convey this information and they agreed to
follow the ERPB's recommendation as there are many buildings in the Larkin
community and it is important to establish a criteria so all the buildings can display a
consistent image.
Upon re submitting the ERPB then changed their recommendation to having all of the
letters in the logo and primary message match in size and color which completely
contradicts their first recommendation and makes no sense from a visual standpoint.
We are asking for an appeal decision to be made so that we can move ahead with our
sign program following the ERPB's original recommendation.

APPEAL OF DECISION TO CITY COMMISSION
Pursuant to Land Development Code Section 20 -6.2 (A) an appeal of an ERPB final decision may be filed
within 30 days of the ERPB decision or before a building permit is issued whichever comes first. The appeal is
to be filed with the City Clerk upon a form prescribed by the Clerk. Appeals may be filed by the applicant, a
property owner, business owner or resident of the City, the City Administration, or an interested citizen in an

APPLICANT'S REQUEST:
The applicant is requesting approval 10 install two (2) non-illuminated wall signs on the
north and east elevations, at the above referenced address.
STAFF ANALISYS:
The proposed exterior signage is located in the "MO" Medium -Intensity Office district.
Pursuant to Section 20-4.3(1)(5) [All Other Zoning Districts], of the Land Development
Code (LDG), signage is permitted as follows:
FLAT SIGNS with a total aggregate sign area, not to exceed (20)
percent of the area of any building face; for the purpose of sign
regulation; there shall be considered to be only four (4) facades to
any building, no single sign shall exceed two hundred ('200) square
feet in area. Direct illumination is permitted.
The applicant is requesting approval for the installation of two (2) flat signs, to be
installed on the north and east fagades of the subject building. The first sign on the
north side will lace SW 70 Street, and the second sign on the east side will face SW 59
Place. Both signs are identical in design as follows: same size., coldr, and wording.
Please refer to the attached plans for a photograph illustrating the two proposed
locations.
The proposed sign copy will consist of three lines and read "LARKIN COMMUNITY
HOSPITAL", with a !ago of the letter "U' in cursive to the left hand side. The non-
illuminatecl sign finish will consist of an aluminum face and albmiryurn side returns, with

:proposed sign measures two (2) feet in heigh:t.uith a length of eight and a half (8.5) feet,
which equals approximately 17 square feet in area. The signs do.notexceed lie twenty

eighty square feet allows a sign sjze of up to 196 square feet at this north building face.
The east'fagade (1:4', h x 78' 1) at one thousand ninety tW.6 squarefeet allows asign size
of up to 2118 squa e feet at this east building face. Both signs do not exceed the two
hundred square feet allowed by code, therefore the proposed sign complies with the
regulations listed above for flat signs.
At this time, the applicant seeks sgnage approval for two (2) flat signs from the ERPB
RECOMMENDATION: Approval with the following conditions:
1) For the proposed sign to .be consistent wit, i the name of the business
indicated on the Florida Department of State, Division of Corporations;

to register with the City Clerk and pay an annual fee of $500 per Ordinance No, 44 -08 -1979. This applies to all

stated that this building is an outpatient center of Larkin Hospital.
Mr. Chandler asked if the applicant has a signage master plan. The applicant stated that staff

Ms McCain suggested that the landscape architect for the Linear Park and the residents meet
before the item comes back for review to the EIZPB. Ms. Cabrera stated that she will inform

Ms. McCain then stated that the ERPB application ERPB 11-071 for exterior paint should be
investigated to ensure that it was painted as per the Boards approval. Ms. Cabrera stated that staff
will look into the item. Ms. McCain added that the item appeared before the Board on October 4,
2011 meeting.
The ERPB thanked Mrs. Mark for her years of service as a member on the Board.

Background:
On November 1, 2011, the application's first appearance before the Environmental
Review and Preservation Board (ERPB) was granted deferral with suggestions. Mainly,
the Board expressed that for clarity this sign needs to be consistent with other buildings
by Larkin and to consider "hierarchy" in the redesign.
APPLICANT'S REQUEST:
The applicant is requesting approval to install two (2) non - illuminated wall signs on the
north and east elevations, at the above referenced address.
STAFF ANALISYS:
The proposed exterior signage is located in the "MO" Medium- Intensity Office district.
Pursuant to Section 20- 4.3(1)(5) [Ali Other Zoning Districts], of the Land Development
Code (LDC), signage is permitted as follows:
FLAT SIGNS with a total aggregate sign area, not to exceed (20) percent
of the area of any building face; for the purpose of sign regulation, there
shall be considered to be only four (4) facades to any building; no single
sign shall exceed two hundred (200) square feet in area. Direct

The revised signage proposal will consist of two lines that read "LARKIN COMMUNITY
HOSPITAL "., with a logo of the letter °L" in cursive to the left hand side. The second line
below will read "Counseling Services" in a different font. This newly redesign sign has
incorporated the Boards suggestion and hierarchy is expressed in the different size text
and the additional wording. The smallest of the two size text is being used that read

The applicant is req.t-1 esting approval 'far the i:nstaliation of two (2) flat sion.s, to be
installed on the north and east facades of the subject building. The first sign on the
north side will face SW 70 Street, and the second sign on the east side will face S V 59
Place. Both signs are identical in design as. follows: same size, color, and warding.
Please refer to the attached plans- for a photograph illustrating the bAio proposed
locations.
The newly revised non - illuminated sign finish will consist of a 1 inch deep plastic cut out,
as illustrated in the section detail. The proposed sign will. have two (2) inch deep
fabricated aluminum letters and one (1) inch cut-out plastic letters. The proposed sign
measures two (2) feet in height with a length of eight and a. half (8.5.) feet, which equals
approximately 17 square feet in area. The signs do not exceed the twenty percent
allowable of any building face. The north facade (14' h x 70' 1) at nine hundred eighty
square feet allows a sign size of up to 196 square feet at this north building face. The
east facade (14' h x 78' 1) at one thousand ninety two square feet allows a sign size of
up to. 218 square feet at this east building face. Both signs do not exceed the two
hundred square feet. allowed by code, therefore the proposed sign complies with the
regulations listed above for flat signs.
At this time, the applicant seeks signage. approval for two (2) flat signs from the ERPB.
.RECOMMENDATION: Approval with the following conditions:
1) Additional signage will require a separate submittal; and,
2) Any comments and concerns by the Board.

to register with the City Clerk and pay an annual fee of 5500 per Ordinance No. 44 -03- 1979. This applies to all
persons who are retained (whether paid or riot) to represent a business entity or organization to influence "City"
action, "City" action is broadly described to include the ranking and selection of professional consultants, and
virtually all - legislative, quasi-judicial and administrative action.
Action: Mr. Montana called the meeting to order at 8:50 A.M.

Ms. McCain stated that the two signs that the Planning Director Christopher Brimo is approving
is according to the LDC. Ms. Cabrera responded yes, that flat signs are permitted in an MO
district. Ms. McCain then stated that she recalled that the applicant came before the Board
previously regarding this item with the signage of Larkin Community Hospital for this building.
There was a discussion that there maybe confusion on the behalf of persons trying to distinguish
between this building and the actual hospital.
Ms. Schwartz stated that she feels that the signs are too large and that she would like to see the
font of counseling services reduced in size.
Ms. McCain asked the applicant if this building is occupied now. The applicant responded that it
will be renovated. She then asked what kind of counseling services will be done. The applicant
responded that he would need to speak to the owner regarding type of counseling services and
the modification of the sign. Ms. Schwartz stated that she feels that the signs are too large and
that she would like to see the font of counseling services reduced in size.
Motion: Mr. Welsh motioned to modify the proposed sign to increase the size of the font of
Counseling Services to the same height and font as Larkin Community Hospital. There was no
second to this motion.
The Board held a discussion regarding the proposed item.
Ms. McCain stated that when this item was seen previously by the ERPB on November 01, 2011,
the Board deferred the item due to the fact that the signs only had the name Larkin Community
Hospital. She then stated that they all agreed that there needs to be a distinction between this
building and the Larkin Community Hospital. She also stated that it was requested that revisions
be made to specify the uses of this building and it is now coming back as Counseling Services
and she does not have an objection to this.
Mr. Welsh withdrew his motion.

Ms. Cabrera stated that with the revisions being made that the Board needs to specify the design
layout regarding the size and height of the font, the logo and the positioning of the sign within
the requirements by the LDC. Mr. Montana stated that the fonts are different and wanted
clarification if it will remain as it is or be changed. The applicant responded that the fonts are
now going to match.
Motion: Ms. Schwartz motioned to modify the proposed sign to state the type of counseling
services, decrease the size of the sign to match the height and font of Larkin Community
Hospital and insert the logo on the left side of the sign between the two lines. This motion was
seconded by Mr.Welsh.
