BACKGROUND: 2013 OnAugust6,2013,the applicant 6520 Development LLC,following Planning Board review and recommendation,came beforethe City Commission withtwo waiver of plat applications within an RS-3 zoning district.One application was for the north portion ofthe site with three lots;one application for the south portion ofthe site with four lots,on property located at 6520 SW 56th Street.At that Commission meeting,the waiver of plat for the north portion was approved by Resolution No.163-13-13981;the waiver of plat for the south portion was denied by Resolution No.164F-13-13982.Subsequent to this Commission meeting,the applicant chose to abandon the waiver of plat and move forward with a replat of the property located at 6520 SW 56th Street. 2014 On May 16,2014,Application No.T-14-005 for tentative plat review was filed with the Planning &Zoning Department by the owners of the property,6520 Development,LLC,and subsequently Application No.T-23499-2-CORR was also filed with Miami Dade County, pursuant to Section 28-4 of Miami Dade County Code.The application was to subdivide the single tract of land located at 6250 SW 56th Street into nine (9)new buiidable,single-family lots. The Planning &Zoning Department conducted a review of application No.T-14-005 for a tentative plat ofthe referenced property.A copy ofthe tentative plat review letter is included inthe backup for reference. On October 21,2014 the Miami Dade County Environmental Quality Control Board (EQCB) recorded Board Order No.14-55,approving a variance for the installation of septic tanks and drainfields as a means of domestic waste disposal,limited tono more than four (4)non- complying lots depicted onthe tentative plat.Lots 1 and 6of Block 2,and Lots 1,2,and 3of Block 1meetthe County's minimum lot size requirements for septic tanks.In discussions with the Miami Dade County Attorney for environmental resource management,lot size calculation for septic tanks is determined based on the County's definition of "sewage loading",under Chapter 24,Section 24-5 oftheCounty Code.The definition states: Sewage loading shall mean the estimated average amount of waste watergenerated by the actual andprojecteduse ofapropertyasa function ofthe unsubmerged area ofsaidproperty. Abuttingeasementsand rights-of-way shallbeincludedtothecenterlinesthereofin calculating theunsubmergedarea oftheproperty. Therefore,in calculating whetheralotmeetsthe minimum sizerequirementof 15,000 square feetforseptictanks,theCountyusesthe square footage ofabuttingright-of-way(tothecenter line)in their calculations.Lots1and6 of Block2,andLots1,2,and3 of Block1 utilize the squarefootage of theabuttingright-of-wayalongSW56thStreetandSW65th Avenue.The remaining 4-lots were grantedavarianceby the EQCB.TheMiamiDade County Environmental QualityControlBoard report is included foryourreference. Atreeremovalpermit application was filed bythe applicant on July 18,2013,andapermitfor treeremovaland mitigation wasissuedon March 4,2014 priortothe revisions tothetree ordinanceandtree moratorium.Thetrees were removed accordingto the permit issuedon March 4,2014.Additionally,atreereplacementbondwas filed bythepropertyowner,with the Cityon November 11,2014,andisincludedforreference. Public works reviewed the proposed final platandprovidedthefollowing comments: Yardwastepickupcannotbe combined withdifferentpropertyowners;acentralizedarea beingproposedwillnotbeacceptable.The development will needtoutilizeaprivatebulk trash haulerforthispurpose.Theproposed sidewalks indicatedon drawing thatwasreviewed meets therequirements.Public Works willaddressanyconcernsrelatedto drainage and infrastructurethatmay arise when construction documents when submitted forpermitreview. The final platasproposedmeetstheminimumrequirementsforthe RS-3 single-family residentialzoning district,andisconsistentwiththeprovisionsofthe Cityfs comprehensive plan.
