RESOLUTION NO.003-15-14342 A Resolution authorizing the waiver of certain special events feesandcosts for Rotary Foundation of South Miami,Inc.,to hold its 32rd Annual South Miami Rotary Art Festival on Sunset Drive. WHEREAS,SouthMiamiRotary,501(c)(3),has submitted aSpecialEvent Application;and, WHEREAS,forthepast 31 yearstheSouthMiamiRotaryArtFestivalhasbeenheld intheCity of SouthMiami,andsponsoredthroughSouthMiamiRotary;and, WHEREAS,theapplicanthasrequestedpermissiontoholditseventonFebruary 21 & 22,2015;and, WHEREAS,theapplicanthaspaidforthedeposit($500),application($60), administrativefee ($100),andStreetandpolebannerfees($600),totaling$1,260;and, WHEREAS,the applicant willpayforall services rendered bythe Police and Public Works Departments inan estimated amount of $12,218;(Police$7,740andPublicWorks $4,478);and, WHEREAS,the applicant has requested a waiver from obtaining signature of approval froma majority of the business affected bythe street closure,all provisions pertaining to road closure costs andlost parking revenue,and requirement thatcosts of police andany other department employment tobe paid prior tothe permit being issued;and, WHEREAS,the applicant has requested a waiver forthe cost of street meters inthe amount of $3,200 ($25.00 X64 parking metersXtwodays),andthecostforthestreet closureinthe amount of $475(1,900linearfeetx.25),plustheMOTfee of $200;foratotal amount of $3,875;and WHEREAS,the applicant has attached acopy of Resolution #275-13-14093;dated the 17th of December,2013,waiving the street meters an and street closure cost for the 2014 event,Resolution #243-12-13800;datedNovember20,2012;waivingthestreetmetersand street closure costforthe 2013 event,and Resolution #229-11-13543;dated December 20, 2010;waiving the street meters and street closure cost forthe 2011 event. WHEREAS,Resolution #229-11-13543,dated December 20,2011,waived the requirements for payment of thefeeforthestreetclosurefortheeventheldin 2012;and, WHEREAS,Resolution#243-12-13800,datedNovember20,2012,againwaivedthe proposed street closure feefor the 2013 events;and, WHEREAS,the applicant isrequestingthatitnotbeassessedstreet closure fees,as hasbeendoneinthe past pursuant toResolutions#229-11-13543 and 243-12-13800 from 2011 and 2012 respectively. Kindly note that overall net parking revenues increase in South Miami as a result ofboth the Chamber and RotaryArt Festivals.The thousands of patrons that visit the festivals fill up the municipal parking garage and other metered locations throughout the Town Center that typically would not be filledduring the same hours of operation. Profits from our festival are used tofund an annual college scholarship fora South Miami student We have been giving scholarships to needy children in South Miamiforat least 20 years. Our free dictionary and atlas project in conjunction with the Miami-Dade Public Library System awards over 3000 dictionaries and atlases to South Miami 3rd and 5 grade students,respectively,as well as to several at-risk schools throughout the county. We would be happy to innumerate some of our other projects whichvary according to needs of the community and the world not the least of which was the lighting of Rotary FieldatMurrayParkin South Miami. Prior to 2011 the Cityof South Miami providedgrantstonon-profits such as Rotarytohelp defray PoliceandPublic Works expenses incurred.In the past few years we understood thatyouhad budget problems,but we continued to show theCityasa sponsor inour publicity in hopes thatyouwouldbeableto returntothat status when budget allows,hopefullythisyear.The city has alwaysrecognizedthevalueof our art festival to bring many return visitorsto South Miami raising awareness of all thatthecityhastooffer. WHEREAS,the Mayor andCityCommission of theCity of SouthMiami desiretocontinuetoencouragetheexistence of theannualSouthMiamiArtsand Crafts Festival;and, WHEREAS,forthepast22yearstheRedRoad Merchant's Association (RCSMandRSMA)sponsoredtheSouthMiamiArtsandCraftsFestival;and, WHEREAS,RCSMand RSMA arenolonger interested in sponsoring the event;and, WHEREAS,the Rotary Club of South Miami (Rotary)would liketo continue the event,sponsor the event,and have the event recognized asan annual event supported bythe Mayor andCityCommission;and, WHEREAS,ifthe Mayor and City Commission agree,the Rotary would liketo rename theeventthe "South Miami Rotary Arts Festival;"and, WHEREAS,Rotary would like the City's annual special event permit policy adopted under resolution 27-03-11576,tobe waived as to this annual event, as the art festival has been a long standing event and popular event in the City; and, WHEREAS,the city shall annually allocate funds to support the city's "in- kind"police services for the event,in order to assist with defraying the costs of the Rotary'seffortstosponsorthe event;and, WHEREAS,the Mayor and City Commission agree to close Sunset Drive fortheannualevent;and, Additions shown by underlining and deletions shown by overstriking. Res.No.85-06-12226 WHEREAS,Rotary shall coordinate withtheSouthMiamiPolice Department regarding scheduling and coordinating the event and ensuring proper security fortheevent;and, WHERAS,Rotary shall not be required to pay any additional rental charges to the city for the special event,but,may be required to pay for necessary clean-up services;and, WHEREAS,Rotary shall notbe required to reimburse theCityforlost parking revenues;and, WHEREAS,the Mayor andCity Commission desire toprovide "in-kind" assistance tothe Rotary by providing police services tothe Rotary for the annual event;and, WHEREAS,Rotaryshallbe required toobtainpublicliability insurance coverage,whichpolicyshallnamethecityasanadditionalinsuredforthedate, time,andlocation of the sponsored event,inthe amount of $1,000,000,priorto the event date. WHEREAS,theMayorandCityCommissiondesiretowaivethe requirements of resolution 27-03-11576 forthisevent,anddesiretorenamethe event the "South MiamiRotary Arts.Festival." NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLOERD A,AS FOLLOWS: Section 1.All organizations sponsoring approved special events using public property or public streets within the City of South.Miami must reimburse the City for all City revenue loses,and City expenditures associated withthe approved special event Section 2.All organizations sponsoring special events using public property or public streets within the City of South Miami must receive approval by resolution from the South Miami City Commission.The resolution must include the estimated reimbursement amount tobe paid to the City for all City revenue loses and City expenditures associated with the approved special event Section 3.The resolution described in Section 2 above may also specify an additional monetary contribution to be made by the organization to the City;the resolution shall specify as how the additional monetary contribution istobe used bythe City. Section 4.All organizations sponsoring an approved special event which closes a public street within the City of South Miami,must provide in advance,a petition signed bya majority of businesses facing the street affected bythe approved special event.
