ORDINANCE NO.02-15-2209 An Ordinance amending Section 20-4.2 of the City of South Miami's Land Development Code to add criteria for the City's approval of a plat or re-plat tentatively approved by the Miami-Dade County. WHEREAS,Section 20-4.2 of the City's Land Development Code provides forthe process of subdividing parcels of landintheCity of SouthMiami;and WHEREAS,Section 20-4.2 deferstothe Miami-Dade County platting process of Chapter 28 of the Miami-Dade County Code of Ordinances;and WHEREAS,Miami-DadeCountyplattingordinancerequiresthatatentativeplatmust beapprovedbytheCity of SouthMiamibeforeitcanobtainfinalCountyplatapproval;and WHEREAS,Section20-4.2doesnotprovideanycriterialfortheapproval of aplatthat hasbeententativelyapprovedbytheMiami-DadeCountyplattingdivision;and WHEREAS,theMayorandCityCommissioners of theCity of SouthMiamidesireto enactcriterialfortheapproval of aplatthathasbeententativelyapprovedbytheMiami-Dade County platting division. NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.Section 20-4.2 Land subdivision regulations,is hereby amended toreadas follows:. (A)ApplicableRegulations.Thesubdivision of alllandwithinthecityshallbe subjecttoChapter28 of theMiami-DadeCountyCode of Ordinancesandadministered bytheMiami-DadeCountyDepartment of PublicWork.However,finalplatapproval mustbeapproved by theCityCommissionandmeetthesamerequirements of Subsection CB)(2\(3)and (4^of this Section as set forth below. (B)Platted Lot Compliance.Everybuildingor structure hereafter erected,moved or structurally altered within thecityshallbelocatedona platted lot,except thatthecity commission maywaive platted lotcompliancein accordance with section 28-4 of the County Code andthe procedures setforthbelow.Atleastten (10)days prior tothe planning board review of the application for waiver of plat,the subject property shallbe posted by the Planning Department withanotice of thedateand time of the planning meeting onall roadways that abutthe property.In addition,10 days prior tothe meeting of the City Commission to consider either a waiver of plat ora tentative plat approved in accordance with Chapter 28,notice of thedateand time of the City Commission meeting shall be provided toall property owners within afive hundred-foot radius of the subject property. (1)Waiver-of-Plat.A waiver-of-plat maybe approved bythecity commission. (2)Prior to city commission approval,the application,forany subdivision approval shall be reviewed by the planning board.The subject property shall be posted ten (10) Page1 of3 Ord.No.02-15-2209 days prior tothe planning board review of the application,and mailed notice shallbe provided toall property owners within afive hundred-foot radius of the subject property. fa)Anything regarding property division shallgo before the Planning Board. (S3)City Commission Findings.Prior to approving a waiver-of-plat,thecity commission shall usethe following guidelines: (a)The building site created bythe proposed waiver-of-plat willbe equal toor larger than the majority of the existing building sitesand of the same character asthe surrounding area(thisshallbe demonstrated usingcopies of the official plat mapsforthe subject property and surrounding neighborhood).Surrounding area is defined asall abutting lots within thesamezoning district,includingthosethatare diagonal tothe property and separated bya street,provided the street is non-arterial.In addition,thelot frontage of the subject property shallbenotlessthanthe average of thelot frontage of lotswithinthesamezoningdistrictandwhichare300feetoneitherside of thesubject property orup until a traffic intersection whichever isless and which shall include the lots within the property tobeplatted. (b)Thebuildingsitecreatedbytheproposedwaiver-of-platwillnotresultinexisting structures becoming nonconformingastheyrelatetosetbacksandotherapplicable regulations of theseland development regulations. (c)Thebuildingsitecreatedbytheproposedwaiver-of-platwillbefree of encroachments from abutting buildable sites. (34)Additional Conditions.Thecity commission may designate such additional conditionsinconnectionwithawaiver-of-plataswill,initsopinion,assurethatsuch waiver-of-platwillconformtotheforegoingrequirements. (45)AdditionalApplication Requirements.Aspart of therequiredfinalplatorwaiver- of-plat application,applicantsshallbe required tosubmitaproposedsiteplanforthe resultingbuildingparcels,anexistingtreesurvey(maybeincludedinpropertysurvey) whichshallindicateanyproposedtreeremovalorrelocationnecessary,and,if so,the appropriate city application fortree removal or relocation. Section 2.Codification.The provisions of this ordinance shall become andbemade part of theCode of Ordinances of theCity of SouthMiamiasamended;thatthesections of this ordinancemayberenumberedorre-letteredtoaccomplishsuchintention;andthattheword "ordinance"maybechangedto "section"orother appropriate word. Section 3.Severability.If anysection,clause,sentence,orphrase of thisordinanceis forany reason heldinvalidor unconstitutional byacourtof competent jurisdiction,this holding shallnotaffectthevalidity of theremainingportions of thisordinance. Section 4.Ordinances in Conflict Allordinancesorparts of ordinancesandall sections andpartsof sections of ordinances in direct conflict herewith are hereby repealed. However,itisnottheintent of thissectiontorepealentire ordinances,orparts of ordinances, thatgivetheappearance of beinginconflictwhenthetwoordinancescanbe harmonized or whenonlyaportionofthe ordinance in conflict needstobe repealed to harmonize the ordinances.Ifthe ordinance in conflict canbe harmonized by amending its terms,itis hereby amended to harmonize thetwo ordinances.Therefore,only that portion that needs tobe repealed toharmonizethetwoordinancesshallbe repealed.
