Ord No 01-15-220801-15-2208 ORDINANCE NO.f 1 An Ordinance of the City Commission of the City of South Miami,amending Section 4-2(a)of the City Code adding drugstores,convenience stores and service stations as listed uses in the table of distance requirements regarding alcohol sale. WHEREAS,the Code of Ordinances currently doesnot provide forthesale of beerand winein drugstores,convenience stores and service stations;and WHEREAS,thesale of beerandwineforoff-premiseconsumptionisacustomaryusein a drugstore,convenience stores and service stations;and WHEREAS,theCityCommissionisdesirous of providingassistancetothecommercial areas oftheCitywhile mitigating adverse impacts,where possible,to surrounding properties. NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section1.Section4-2(a)(4)of theCity of SouthMiamiCode of Ordinancesis hereby amended to read as follows: Section4-2-Distance Requirements;nonconforming use;certificate of occupancy. (a)Distance requirements. (1)Distance from a church,school,or residential property shall bemeasuredbyfollowingastraighthorizontallinefromthe nearestpoint of thepropertyline of thepropertyonwhichthe proposed licensed establishment istobe located to the nearest point of thepropertyline of achurch,schoolorresidential property. (2)Inallother cases,distance shall be measured by following a straight horizontal line from the nearest point ofthe perimeter wallofthe proposed establishment tothe nearest pointofthe perimeterwall of theexistingestablishment. (4)Exceptionsfromthe aforementioned distance requirements from residential.Premises located in zoning districts which permit restaurantsandwhicharelocatedalongBirdRoad,RedRoad,and U.S.1(SouthDixieHighway)mayservenon-distilledalcoholic beverages suchas wine and beer,butno beverage containing distilled spirits,aspartofan approved restaurant use provided: a)nobarisprovided,b)foodisservedinconjunctionwithbeer and wine within or upon the premises at approved seating only, c)thesaleofwineandbeerislessthanhalfthetotal monthly sales, d)wine and beer are not removed from the premises,e)a permanent,opaquebufferisprovidedbetweenthepremisesand anyandalladjoiningpropertieswhicharezonedresidential,and f)forrestaurantslicensedafterDecember 17,2013,wineandbeer shall only be served between the hours of 11:30 a.m.and midnight.Distance requirements fromchurchesandschoolsshall be observed forall properties alongBirdRoad,RedRoad,and U.S.1 (South Dixie Highway).The restaurant shall provide the city with the restaurant's records ofits sales of food and beverages upon demand ofthecity manager,orhis designee,orofacity code enforcement employee. MIAMI 4411630.1 78496/45494 Ord.No.01-15-2208 (5)The restricted distances,listed in the subsection 4-2(a)(3) schedule,between premises thatsellwineand beer and another land use that is protected,shall not apply if the protected class of land use,listed inthe schedule,is located ina municipality other than the City of South Miami and provided that the ordinances of the adjacent,applicable municipality would notbe violated if the location of theandusesin question were reversed,i.e.,the church were located in South Miami andthe proposed storeor restaurant selling wine and beer were located in Coral Gables. Section 2.Codification.The provisions of this ordinance shall become andbemade part of the Code of Ordinances of theCity of South Miami as amended;thatthe sections of this ordinancemaybe renumbered or re-lettered toaccomplishsuchintention;andthattheword "ordinance"maybe changed to "section"orotherappropriateword. Section 3.Severability.If anysection,clause,sentence,orphrase of thisordinance isforanyreasonheldinvalidorunconstitutionalbyacourt of competentjurisdiction,this holdingshallnotaffectthevalidity of theremainingportions of thisordinance. Section 4.Ordinances in Conflict.Allordinancesorparts of ordinancesandall sectionsandparts of sectionsof ordinances indirectconflictherewitharehereby repealed. However,itisnottheintent of thissectiontorepealentireordinances,orparts of ordinances, thatgivethe appearance of beinginconflictwhenthetwo ordinances canbe harmonized or whenonlyaportion of theordinanceinconflictneedstoberepealedtoharmonizethe ordinances.Ifthe ordinance in conflict canbe harmonized by amending its terms,itis hereby amended to harmonize thetwo ordinances.Therefore,onlythatportionthatneedstobe repealed toharmonizethetwoordinancesshallberepealed.
