RESOLUTION NO,241-14-14335 A resolution resolving an appeal of a decision of the Environmental Review and Preservation Board regarding the denial of signage at 5740 Sunset Drive. WHEREAS,the Environmental Review and Preservation Board (ERPB)atits February 4,2014meetingfirstreviewedApplicationNo.ERPB14-006anddeferredtherequestfor signage installation fora tenant spacelocatedatthe5740SunsetDrive;and WHEREAS,on March 18,2014theERPBonce more deferred theitem,requesting additional modifications;and WHEREAS,on April 15,2014theERPB granted final approval tothe Application No. ERPB-14-006 with the condition that the sign "RazzleDazzle Barber Shop"be placed above the storefront window that is closest to the sidewalk,not on the fascia board and staffs conditions; and WHEREAS,sometime following theApril15,2014 ERPB meeting,the applicant installed thesignthatis currently onthebuilding;thesign being attached tothe projecting storefront,butalso extending outoverthealcoveopening,whereby onMay21,2014the applicantwasissuedaviolationnotice#0384forerectingasignwithproperapprovalsand without a building permit;and WHEREAS,onJuly22,2014 the applicant resubmitted revised plans tothe ERPB,asa continuation of Application No.ERPB-14-006requestingapproval of thesignthathadbeen installed,whereby the Board deferredtheapplicationtohavethesign installer furtheraddress how the current sign could be better secured tothe structure;and WHEREAS,on October 7,2014 the applicant returned tothe ERPB with revisions tothe fastening details as previously requested;and WHEREAS,on October 7,2014theERPBagainvoiced concerns on how thesignwas proposedtobeattachedtothestructure,andthatthesignthatwasinstalledwastwicethesize of thesign approved on April 15,2014;whereby the Board denied Application No.ERPB-14-006; and WHEREAS,Section 20-6.2(A)of theLand Development Code allows foran appeal of an ERPB decision tobe made totheCity Commission bythe applicant,interested citizens,orthe City administration;and WHEREAS,Section 20-6.2(E)of the Land Development Code provides that the City Commission may reverse,affirm,or modify any decision of the Environmental Review and Preservation Board on which therehas been anappeal. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Resolution No.241-14-14335 Section 1,The decision of the Environmental Review and Preservation Board made October 7,2014 regarding the approval of asignage installation located at5740 Sunset Drive is hereby overruled andthesignageisapproved. March 18,2014: Second appearance before the ERPB:The applicant resubmitted plans for review bythe ERPB.Itwasaconsensusthatthe Board wasnotreceptiveto allowing signage onthe fascia board,andthat the barberpoleberelocatedtotheentranceofthestore.Also,the Boardfelt thatthewordingabovetheentranceappearedtobe larger thantheproposed area.Because of this,the Board deferredtheitemwiththe condition thata drawing/picture thatisto scale detailing thecorrect location ofthe sign in relation toits surroundings besubmitted. July22,2014: Fourth appearance before the ERPB:The applicant submitted revised plans for reviewby the ERPB.Theplans submitted depicted thesignthatwasfoundtobeinviolationbyOfficer Bynum.Because of the recesseddesign of the storefront,the Board showed concernwith how the sign wouldbeattachedtothe building.Even thoughthebusinessownerstatedthatthe sign issupportedby anchors,the Board deferredthe application sothattheapplicantcouldwork withthe sign fabricator toaddressthe Board's concerns,andcomeupwithadesignthatwould adequately securethatportion of the signthat extended east of the storefront window overthe alcove entrance. October 7,2014: Fifth appearance beforethe ERPB:The applicant resubmitted plans for review bythe ERPB. The design submittedwas similar tothe design submittal from the July 22nd meeting;the difference was the addition of aluminum brackets to address the Board's concerns of how the sign wouldbe adequately secured tothe structure (Figure 5).Although the sign fabricator provided a revised design for securing the sign,the Board felt thatthe proposed signage would notbe securely fastened tothe building.The Board then reiterated thatthe original approval calledforthe sign tobeplacedabovethe projecting storefront window thatisclosesttothe sidewalk only and not as currently installed.The Board then denied the application,stating that thedesignthatwas originally approvedbythe ERPB in April shouldbeused. October 7,2014 Because the case was deferred from the July 22,2014 ERPB meetinganddeniedattheOctober 7,2014 ERPB meeting,the case will be scheduled for thenext available Special Magistrate hearing (November 20,2014). Pleasesee attached the PAID contract,which includes permitting fees.I take full responsibility for not researching his credentials prior to hiring him. I opened RazzIeDazzle Barbershop inFebruary2014,without asign.I knew this wouldn't draw much business in,since we were new to the area and did not have much exposure,due mainly to the narrow and awkward space in which we presently reside.
