A Resolution contributing to the memorial services for Mr.Hans Huseby
and amending or repealing Resolutions #27-03-11576 and/or #155-03-11705.
WHEREAS,OnSaturday,November29,2014,Mr.HansHuseby,owner of Team
FootWorks passed away;and,
WHEREAS,theCity of South Miamihaslostan amazing person whowasagreat
supporter of theCity of South Miami;and
WHEREAS,Mr.Hans Huseby wasan incredible contributor tothe Red Sunset
Merchants Association formanyyears.Heworked tirelessly fortheSafeStreet Halloween and
for Santa's Elves Parade events held within South Miami on Sunset Dr.He was the model of a
man,who understood thevalue of sharinghisloveand devotion tothe South Miami
community;and
WHEREAS,Team FootWorks would like to hold a memorial service in front of the
Team FootWorks store on Sunset Drive (SW 72 Street)between SW 57 Court to SW 57 Avenue
(RedRoad),andasan alternate City staff has suggested the closure of SW57 Court from Sunset
Drive (SW 72 Street)to SW 73 Street;and,
WHEREAS,theCitywouldliketocontributetotheservicein memory of Mr.Hans
Huseby.
WHEREAS,Mr.John "Hans"Huseby willbe greatly missed bythe City of South
Miami;and
WHEREAS,Resolution #27-03-11576,passedinearly2003,required all organizations
sponsoringapprovedspecialeventsusingpublicpropertyorpublicstreetswithintheCity of
South Miami to reimburse theCityforallCity revenue lost,andfor costs incurred bytheCity
associated with the approved special event.Italso required approval of the City Commission by
resolution which was required to include the estimated reimbursement amount tobe paid tothe
Cityforlost revenue andCitycosts.EachSpecialevent which results in closing a public street
within the City was required to provide,in advance,a petition signed bya majority of businesses
facing the street affected bythe approved special event and if the sponsoring organization had
been allocated monetary grants inthe adopted City Budget,the organization was required to
reimburse the City fromthe designated monetary grant.
WHEREAS,later in2003 Resolution #155-03-11705 was adopted amending section 4 of
Resolution No.27-03-11576 which sets forth a policy requiring a signature petition of a majority
of businesses facing the street affected bythe approved special event.Resolution #155-03-
11705 granted an exception tothe petition requirement for certain events that are listed below:

NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.Resolutions #27-03-11576 and/or #155-03-11705 are herebyamended and/or
repealed as follows:repealed.
Section 2.The City Manager is authorized to waive the following feesto cover allfees
forthe Hans Huseby memorial services.
Section 3.If any section clause,sentence,orphrase of this resolution isforanyreason
held invalid or unconstitutional byacourt of competent jurisdiction,the holding shallnotaffect
the validity of the remaining portions of this resolution.
Section 4.This resolution shallbecomeeffective immediately upon adoption byvote of
the City Commission.

Background:On Saturday,November 29,2014,welostan amazing personwhowasagreat
supporter of the City ofSouth Miami.Mr.HansHusebywasan astounding man,
with a positive attitude.He was an incredible contributor to the Red Sunset
Merchants Associationformanyyears.Heworkedtirelessly for the Safe Street
Halloween and for Santa's Elves Parade events held within South Miami on Sunset
Dr.Hewas the modelofaman,who understood the valueofsharinghisloveand
devotionto the South Miami community.John "Hans"Huseby will begreatly
missed.
Theeventistobea "memory of services"relatingtohis life andisexpectedtobe
attended bysomewherebetween500andonethousandpeople.The family
requested the closure of Sunset Drive (SW 72 Street)between SW57CourttoSW
57 Avenue (RedRoad),and staff has suggested an alternate site ofSW57Court
from Sunset Drive(SW72 Street)to SW73 Street.The event willbeheldon
Wednesdayfrom6:00p.m.-9:00 p.m,therefore requiring theroadwaytobe
closed from 4:00 p.m.-10:00 p.m.

OF THE CITY OF SOUTH MIAMI,FLORIDA,MODIFYING
RESOLUTION NO.27-03-11576 RELATED TO SPECIAL
EVENTS,IN ORDER TO REVISE A POLICY RELATED TO
REQUIRING A SIGNATURE PETITION FROM BUSINESSES
IMPACTED BY A SPECIAL EVENT;PROVIDING AN
EFFECTIVE DATE.
WHEREAS,public property and public street locations within the City of South Miami are used
by organizations for special events which are beneficial tothe City and its residents;and
WHEREAS,theCity Commission atits February 18,2003 adopted Resolution No.27-03-11576
which set forth policies on funding special events*costs for special events,and policies tobe followed by
organizationssponsoringspecialeventswithintheCity;and
WHEREAS,Section 4of Resolution No.27-03-11576 sets forth a policy requiring a signature
petition of businesses impacted byastreetspecialevent;and
WHEREAS,theCity Commission desires to clarify the above policy by specifying that certain
long standing special events are exempt from the policy pertaining toa signature petition of businesses
impactedasset forth,in Section 4 of ResolutionNo.27-03-11576.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI,FLOIRDA,AS FOLLOWS:

OF THE CITY OF SOUTH MIAMI,FLORIDA,RELATED TO
SPECIAL EVENTS,SETTING FORTH A POLICY ON FUNDING
SPECIAL EVENTS AND COSTS ASSOCIATED WITH SPECIAL
EVENTS AND;PROVIDING AN EFFECTIVE DATE.
WHEREAS,public property and public street locations within theCityofSouth Miami areused
byorganizationsforspecialeventswhichare beneficial tothe City andits residents;and
WHEREAS,such special events may require City services and resources tobe expended inorder
toprovide security,cleanup,banner hanging,street blocking,covering of parking meters;and
WHEREAS,theMayorandCity Commission desire set forth apolicy requiring reimbursement
totheCityforallrevenueslostorexpendituresmadeforspecialevents.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI,FLOIRDA,AS FOLLOWS:
Section1.All organizationssponsoring approved specialeventsusingpublicpropertyorpublic
streetswithintheCity of SouthMiamimustreimbursetheCityforallCityrevenueloses,and
Cityexpendituresassociatedwiththeapprovedspecialevent.
Section2.All organizations sponsoring special eventsusingpublicpropertyorpublicstreets
withintheCityofSouthMiamimustreceive approval by resolution fromtheSouthMiamiCity
Commission.Theresolutionmustincludetheestimatedreimbursementamounttobepaidtothe
CityforallCityrevenuelosesandCityexpendituresassociatedwiththeapprovedspecialevent.
Section 3.TheresolutiondescribedinSection2abovemayalsospecifyanadditionalmonetary
contribution tobemadebytheorganizationtotheCity;theresolutionshall specify ashowthe
additional monetary contribution istobeusedbytheCity.
Section 4.Allorganizationssponsoringanapprovedspecialeventwhichclosesapublicstreet
withintheCity of SouthMiami,mustprovideinadvance,apetitionsignedbyamajorityof
businesses facing the street affected bythe approved specialevent.
Section 5.All organizations sponsoring approvedspecialeventsusingpublic property orpublic
streets within theCity of South Miamimustagreein writing astopaythe actual the amount of
City revenue losesandfinalCityexpendituresassociatedwiththeapprovedspecialevent.
