WHEREAS,theMayorandtheCity Commission of theCity of SouthMiamihavereceivedand reviewed an application filedby RP1-SM,LLC,aFloridalimitedliability company,seekingtore-plat propertylegallydescribedasTract 8,lesstheWest 100 feet thereof,andthewest25feetofSW60 AvenueadjoiningTract8whichwasvacatedbyCityResolution81-05-12060,REVISEDPLATOFA PORTION OF THE AMENDED PLAT OFPALMMIAMI HEIGHTS,according tothePlat thereof,as recorded inPlat Book 43,Page37 of the Public Records of Miami-Dade County,Florida;and WHRERAS,the Miami Dade County plat committee meton November 21,2014and recommended approval of the tentative plat subject toany provisions enumerated in their approvalletter, and subject tofinalplat approval bytheCityandCounty;and WHEREAS,the replat application requests a subdivision of said parcel intofive buildable single-family lots;and WHEREAS,the Planning Department reviewedthe application in accordance withtheland development regulations of theCity of SouthMiamiandwith Resolution 81-05-12060,andfindsthe application in compliance. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.ThattheFinalPLATOFDAVISOAKS,asfiledbyandon behalf of RP1-SM,LLC and legally described in Section 2,pursuant to section 20-4.2(b)oftheLand Subdivision Regulations,and labeled as "Exhibit A",is hereby approve ,and subject tothe following conditions,and/orother conditions deemed appropriate bytheCity Commission: 1.Compliance withthe conditions ofthe Miami-Dade County approval of application No. T-23506-4-REV; 2.Compliance withcurrentCity Land Development Code requirements. 3.Compliance withthe City's tree removal and canopy mitigation requirements. 4.Compliance with the City's Public Works requirements forany driveways,sidewalks or other improvements. 5.Compliance withtheprovisions of Resolution81-05-12060. 6.Demolition ofthe existing one-story structure prior to issuance ofa development permit. 7.Compliance with any Miami-Dade County Environmental Resource Management requirements priortofinalrecording of thisplat. BACKGROUND: OnJune 11,2014,anapplicationfor Tentative Plat(applicationno.T-14-006)review wasfiled bythe owner oftheproperty,RP1-SM,LLC,inordertodivideoneexistingtractofland locatedat 6001 SW80thStreet (Figure 1)into five single family lots asshownin Figure 4.This property also includesaportionofSW60thAvenue,anunimprovedright-of-waythatwas abandonedandvacatedby Resolution No.81-05-12060,andrecordedinthepublic records of Miami DadeCounty.Theexistinghome,andotherstructureswillbedemolished prior tothe construction of the new singlefamilyresidences. Following submittaltotheCity,thepropertyowner submitted forreviewto Miami-Dade County,pursuanttoChapter28ofthe County Code.Theproposalwastodivide the 1.31 acre tracttocreatefive buildable lotsasdepictedinthe Figure 4proposed plat,withlots1through3 fronting SW79thStreet,and lots 4&5 fronting SW80thStreet.The Miami Dade Piatt Committee approvedtheproposedTentative Plat (application no.T-23506-3-REV)on September5,2014.Pursuant to Chapter 28oftheCountyCode,thepropertyownerthen submittedfor Final Plat reviewtotheCityofSouth Miami City Commission. On October 21,2014,theCityCommissionreviewthe Final Plat requestdescribedaboveand deferred theitemonthe grounds thatthe applicant's useofthe vacated right-of-way was contrary to the stipulation of the vacation stated in Resolution No.81-05-12060.The Commissionsuggestedtheapplicantconsiderotheroptionsforthesubdivisionofthetract,and presentthoseoptionsatafutureCommissionmeeting. OnNovember6,2014,the applicant presentedthe original proposal,and four additional options for Commission review.However,the applicant indicated thatthe original request was still themost feasible proposal andrequested approval ofthat Final Plat.The Commission failed toapprovethemotion for Final Plat Davis Oaksbyavoteof1 aye;4 nays. Analysis: The applicant has resubmitted Plat alternative 2thathadbeen presented tothe City Commission on November 6,2014,to Miami Dade County Piatt Committee for review (Figure's 2&2A).This proposal whilenot optimal,does not utilize any square footage ofthe vacated 60th Avenue right- of-way for lot computations.Although it does utilize the right-of-way for "frontage"requirements alongSW79 Street.It hadbeen previously determined bythe City Attorney thattheuseofthe vacated right-of-way for frontage and setbacks wouldbe permissible underthe provisions of Resolution No.81 -05-12060. Theapplicant submitted a "revised"Tentative Platto Miami-Dade County (application no.T- 23056-4-REV),thatwasreviewedandapprovedonNovember21,2014.Althougha"new"lot configuration forthe Final Plat (Figure 2A)is being presented tothe City for consideration,the applicantis still requesting thatthe Commission give favorable consideration to,andapproveas the Final Platfor Davis Oaks,the original proposal presented tothe City Commission onOctober 21,2014(Figure4).Staffhasalsoincludedthepreviouslotanalysisforthisearlierproposal, shouldtheCommissionwishtoconsiderthisoptionfor Final Plat approval.
