An Ordinance amending 20-6.1(A)(3)(a)(i),(ii)and (iii)of the land
development code to reduce the number of votes required to pass,on first
reading,ordinances and resolutions that require two readings.
WHEREAS,manyordinancesandsomeresolutionsrequiretworeadingswithapublic
hearing atthe second reading;and
WHEREAS,theCityCharterandmanyordinancesrequireasuper majority orfivevotes
forthe enactment ofsome ordinances butdonot specifically requirethatthe ordinance bepassed
onfirstreadingwitha super majority vote;and
WHEREAS,theCityCommissioncouldbenefitfrompubliccommentsbeforean
ordinanceisenactedandbeforeitis rejected onfirstreadingbytheCommission;and
WHEREAS,manytimestheCityCommissionisdeprived of thebenefit of public
commentsbecausetheordinancediesatfirst reading,beforethepublicisallowedtocommenton
the proposed ordinance;and
WHEREAS,thereisnocharterprovisionthatprohibitsthepassage of anordinancethat
requires a super majority vote,on second reading,from being passed onfirst reading bya simple
majority vote;and
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section1.Section20-6.1,(A)City Commission,isherebyamendedtoreadas follows:.
(3)Procedures.
(a)Voting.All ordinances and resolutions thatrequiremorethanonereading
forpassageorenactmentshallbepassedonfirstreadingbyamajorityvote.
i.Exceptforthoseitemslistedin(ii)and(iii)below,notlessthan
three (3)affirmative votes ofthecity commission shall be required to
approve pass or enact an agenda items.
ii.Withthe exception set forth belowin (iii)a four(4)affirmative
votesofthecity commission shall be required tofor final approved ofa
change tothe adopted Comprehensive Plan,a rezoning when a properly
written protest is filed,a variance,a special use,a special exception,ora
plannedunitdevelopment.
iii.Five (5)affirmative votes ofthe city commission shall be required
toenactanamendmenttolanduseanddevelopmentregulationsinany
manner to make them less restrictive.
Section2.Codification.Theprovisions of thisordinanceshallbecomeandbemade
partofthe Code of Ordinances oftheCityof South Miami as amended;thatthe sections ofthis

ordinancemaybe renumbered or re-lettered to accomplish such intention;andthattheword
"ordinance"maybechangedto"section"orotherappropriateword.
Section 3.Severability.If anysection,clause,sentence,or phrase of this ordinance is
foranyreasonheldinvalidorunconstitutionalbyacourt of competentjurisdiction,thisholding
shallnotaffectthe validity of the remaining portions of thisordinance.
Section 4.Ordinances in Conflict.Allordinancesorparts of ordinancesandall
sections andparts of sections of ordinances indirectconflictherewithareherebyrepealed.
However,itisnottheintent of thissectiontorepealentireordinances,orparts of ordinances,
thatgivetheappearance of beinginconflictwhenthetwoordinancescanbeharmonizedor
whenonlyaportion of theordinanceinconflictneedstoberepealedtoharmonizethe
ordinances.Ifthe ordinance in conflict canbe harmonized by amending its terms,itis hereby
amended to harmonize thetwo ordinances.Therefore,onlythatportionthatneedstobe repealed
toharmonizethetwoordinancesshallberepealed.
Section5.EffectiveDate.Thisordinanceshallbecomeeffectiveupon enactment.

We are indeed blessed to live in
acountrywherewearefreeto
formourownpersonalopinions
-andtofreelyexpressthem
underprotectionoftheFirst
Amendment ofthe Constitution.
Ihavebeenaskedmanytimes
duringthiselectioncyclewho
Iamgoingtovoteforand why.
Ihaverefrainedfrommaking
a decision until after the
CutlerBayCandidateForums.
Unfortunately,onlyone
mayoralcandidatewaswilling
toparticipateintheforums.
Art Nanni attended theforums,
answeredquestionsfromthe
voters,stated his vision forthe
Town,discussed concerns and
issues,and outlined his solutions
for those concerns.Mr.Nanni
expresseddisappointment
thathewasunabletoopenly
debatehisno-showopponent,
PeggyBell,regardingher
record.It seems she did not
want to talk about her record.
And I understand that -itisa
dismallitanyofsponsoringand
votingforresident-unfriendly
ordinances.
Mr.Nannie opponenthas
insteadchosentoruna campaign
isolated from the voters.She is
usingadsandbrochureswith
thesameoldpoliticalone-liners
and sound bites -no substance
and no solutions.
Mr.Nannihasalonghistory
of publicservicehereinCutler
Bay,hasreachedouttoand
engagedtheresidents,andhas
demonstrated his willingness
tolistentoandrepresentallthe
citizensofCutlerBay.
From what Ihave seen,thisis
notthecasewithhisopponent.
Sheisintolerantofanyone
whodoesnotagreewith
her,andonlylistenstothose
whosaywhatshewantsto
hear.She attacks those who
disagreewithher.AsIsee
it,ifelected,shewillgovern
asanoligarchic "ruler"
favoringthosewhosupport
her(includingalobbyist
whoservesashercampaign
"consultant")rather than serve
asanelected representative for
allthecitizensofCutlerBay.
Ipreferarepresentativeofand
for all the citizens.
I will vote for Art Nanni for
Mayor of CutlerBay.
In the race for Council Seat
One,EdWolmershasa long
historyofcivicinvolvement
andservicetoour community.
Hisopponent,theincumbent,
doesnot,isa"no-show",and
isa "me-too"on the Council.
For4yearsSeatOnehasbeen
