Ord No 26-14-2204ORDINANCE NO.26-14-2204 An Ordinance amending Chapter 2,Article I,Sec.2-2.1 (K),titled "Decorum"of the City of South Miami's Code of Ordinances. Whereas,ittakesasubstantialcommitment of timeandhardworktobeagood commission member;and Whereas,theboardand commission processconductedinanorderly manner isessential tothe successful function of aCitygovernment;and Whereas,therights of citizenstobeheardarepreservedthroughtime-limitedand orderlyspeechinmeetings of theCity Commission andBoardsduringpublicremarksandcertain hearingsand workshops;and Whereas,therights of citizenstoobservepublicandmonitormeetings of theCity Commission is assured via electronic means;and Whereas,disorderlyanddisruptiveconductatpublicmeetingsinterfereswiththe successfulfunction of Citygovernment. NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section1.Chapter 2,ArticleI,Section 2-2.1 subsection (J)and(K)of theCitycodeare amended as follows: (J)MANNER OF ADDRESSING COMMISSION;TIME LIMIT.No person shall address the commission fromthe audience.Eachperson addressing the commission shall stepuptothepodiummicrophone,shallgivehisorhernameandaddressinanaudible toneofvoiceforthepublic record,andunlessfurthertimeis granted bythe commission, shall limithisorher address to five (5)minutes or until statements appear tobe repetitive orobstructiveasdeterminedbythepresidingofficer.Allremarksshallbeaddressedto the commission asa body and notto any member.No person,other than the person having the floor,shall be permitted to enter into any discussion,either directly or through a member ofthe commission,without the permission ofthe presiding officer.No question shallbe asked a commissioner except through the presiding officer. (K)DECORUM. (1)Bycommission members.Whilethe commission isinsession,themembersmust preserveorderanddecorum,andamembershallneitherbyconversationorotherwise delay or interrupt the proceedings or the peace of the commission nor disturb any member while speaking or refuse to obey the orders of the commission orits presiding officer,exceptasotherwise provided.Commissionmembersshallturnoffall communication devices other than those used to view commission agenda items and those devices shallhave their external communication either disconnected or deactivated Page 1 of3 Ord.No.26-14-2204 duringthetime between thestart of a commission meeting andthetimethatsuch meeting is adjourned for the day.Members maynot make any electronic communication ortake picturesfromthedaisandmembersmustexittheChambertoanswerincomingmobile phone calls unless permitted bythe chairman. (2)By persons.Any person whomakes making slanderous or intentionally rude, uncivilor otherwise personal impertinent remarks,or slanderous remarks andwho refuses or fails to desist from making such remarks after being instructed to do so,or who shall become boisterous in the Commission Chamber and who refuses or fails to desist from such conduct after being instructed to do so shaH may be forthwith barred from furtheraudiencebeforethecouncilremovedfromthe podium andfromCityHallforthe duration of thatmeetingatthedirection of by thepresidingofficer,unless permission-te continuebegranted overruled bya majority vote of the commission.No clapping, applauding,heckling,orverbaloutburstsshallbepermittedforanyreason,includingfor thepurpose of supportingoropposinganymatter,anyspeakerora speaker's remarks.No signsorplacardsshallbeallowedtobedisplayedinanymannerotherthanwhenused fromthepodiumto express an opinion or display facts.Signstobeusedatthe podium must be brought into the Commission Chambers ina manner soas not to unnecessarily displaytheircontentuntilthesignisbroughttothepodiumimmediatelybeforethesign is displayed fromthe podium inthe Commission Chamber.Persons exiting the CommissionChambershalldosoquietly.Theuse of acousticmobilecommunication device,suchasphones,inthe Commission Chamber isnot permitted whilethe Commission is in session.Phone ringers and other devices that emit sound must be set to silentmodetoavoiddisruption of proceedings.IndividualsmustexittheChamberto answer incoming calls.No camera flash options shallbeusedbythepublicduringany portion of the meeting except during recognition andaward ceremonies. Section 2:Codification.Theprovisions of thisordinanceshallbecomeandbemade part of theCode of Ordinances of theCityofSouthMiamiasamended;thatthesections of this ordinance maybe renumbered or re-lettered to accomplish such intention;andthattheword "ordinance"maybechangedto "section"orother appropriate word. Section3.Severability.Ifany section,clause,sentence,orphraseofthis ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction,this holding shallnotaffectthevalidityofthe remaining portions ofthis ordinance. Section4.OrdinancesinConflict.All ordinances orpartsof ordinances andall section and parts of sections of ordinances in direct conflict herewith are hereby repealed.However,itis not the intent of this section to repeal entire ordinances,or parts of ordinances,that give the appearance of being in conflict when the two ordinances can be harmonized or when only a portionofthe ordinance inconflictneedstobe repealed to harmonize the ordinances.Ifthe ordinance in conflict can be harmonized by amending its terms,itis hereby amended to harmonize the two ordinances.Therefore,only that portion that needs to be repealed to harmonize thetwo ordinances shallbe repealed.
