A Resolution declaring that the personal property,described in the attached
list,is "surplus"and authorizing the City Manager to sell the "surplus"items at
auction.
WHEREAS,Section 2-4.7 titled:"Surplus city-owned property"of the City of South
MiamiCode of Ordinances states that all personal property owned by the Cityshall not besold
unless and untilitis declared to be surplus property by resolution of the City Commission;and
WHEREAS,the City Manager is recommending that the attached list of personal
property items be classified as "surplus"because said property serves nouseful function forany
activity or in any location within the Cityand should besold to the highest bidder bywayofa
City auction or as otherwise provided in section 2-4.7 of the City Code of Ordinances;and
NOW THEREFORE BEIT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE
CITYOF SOUTH MIAMI,FLORIDA THAT;
Section 1.The personal property described in the attached listof property is "surplus"
andCity Manager is hereby authorized to dispose of the items in accordance with the procedure
set forthin section 2-4.7of the CityCodeofOrdinances,includingsaleatpublic auction.
Section 2.Severability.Ifany section,clause,sentence,or phrase of this resolution is
foranyreasonheld invalid orunconstitutionalbyacourtof competent jurisdiction,this holding
shall not affect the validityof the remaining portions ofthis resolution.
Section3.EffectiveDate:Thisresolutionshalltakeeffectimmediatelyuponapproval
by the City Commission

Personal Property isdefined as temporary or movable property.
Any personal property that is classified obsolete,orno longer
economical or efficient to keep,or that serves no useful function for
any activityorin any location within the City,needs to be declared
as "surplus"by the City Commission per Section 2-4.7 of the Code
of Ordinances.
Section 2-4.7titled:"Surpluscity-ownedproperty"of the Cityof
South Miami Codeof Ordinances states that all personal property
owned by the City shall not be sold unless and untilitis declared to
be surplus propertybyresolutionofthecity commission.TheCity
Manager is recommending thatthe attached listof personal
property items be classified as "surplus."While some of the
personal property items declared surplus are in good orfair
condition,they serve nousefulfunctionforanyactivityorinany
location within the City andshouldbesoldtothe highest bidderby
way of aCity auction.

Sec.2-4.7.-Surplus city-owned property.
(a)items of personal property ownedbythecity shall notbesoldunlessand until itis declared tobe surplus
property by resolution of the city commission.
(b)Thecitycommissionshallnotconsider declaring anyitemofpersonalpropertytobesurplusunlessthecity
manager has affirmatively recommended such action thereon.
(c)Upondeterminationbyresolutionbythecitycommissionthatanitemofpersonalpropertyissurplus,thecity
manager is hereby authorizedtoselltothehighestbidderatpublicsaleor,ifapprovedbythe commission by
resolution,atpublicauction,saiditemofpersonalpropertyafteradvertisingthedate,timeandplaceofsaid
saleorauctiononcea week forthree(3)consecutive weeks ina newspaper ofgeneral circulation inthecity.
Thecitymanagershallhavethe right toacceptorrejectanyorallbids.Intheeventthepersonal property shall
beofferedforsaleorauction,andnobidsshallbereceivedtherefor,itshallbe deemed thatsuchpropertyhas
novalueandthecity manager inhisdiscretionmayorderit destroyed orotherwise disposed of.
(d)Thissectionshallnotapplytostolen,abandoned orconfiscatedpersonalpropertywhichhascomeintothe
city's possession.
