A Resolution extending the City of South Miami's moratorium on
issuance of permits to cut or otherwise kill all trees,with certain limited
exceptions,until the existing tree protection ordinance can be amended
to provide better protections.
WHEREAS,development of properties inthecityhas increased inpace;and
WHEREAS,theCity'stree ordinance states"Theintent of this section istoprovidea
mechanism to protect,reserve,and restore thetree canopy within theCity of South Miamiby
regulating the removal,relocation and trimming of trees";and
WHEREAS,developers haverecently obtained permits andcutdown extremely old,
slow-growing,nativetreesincludingDadeCountyslashpineandcabbagepalms,aswellaslarge
live oaks;and
WHEREAS,the residents andCity Commission of South Miami havenotbeen
convincedsuch destruction wasnecessarytoredeveloptheproperties;and
WHEREAS,on September 2,2014theCityadopted Resolution 177-14-14271which
prohibitedtheissuance of anytree removal permit,exceptfor nuisance speciesalready exempted
from requirements foratreeremovalpermit,tocutdown,removeorotherwisekillanytrees.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,THAT:
Section 1.The City hereby issues a extends the current moratorium onthe issuance of
any trees-removal permits,exceptfor nuisance speciesalreadyexemptedfrom requirements fora
treeremovalpermittocutdown,removeorotherwisekillanytreesandastotreeremoval
permits applied forin conjunction withsiteplansthathavebeen previously approved priortothe
adoption of themoratoriumresolution,providetheapplicantagreestonotifytheCityManager
of the date,timeandplace of theremovalbyemailatleast5businessdaysbefore
commencement ofthe removal action andthatthe failure to notify shall subject the applicant to
liquidateddamages of $250pertree.
Section 2.The City Manager's rights of emergency removal shall be retained.
Section 3 The moratorium shall expire on January 6,2015 orthe date thatthe City
Commission approves ordeniesarevisiontothetree protection.
Section 4.Ifany section clause,sentence,or phrase ofthis resolution isfor any reason
held invalid or unconstitutional bya court of competent jurisdiction,the holding shall not affect
thevalidity of theremainingportions of thisresolution.
Section5.This resolution shall take effect immediately upon adoption.
