Res No 201-14-14295RESOLUTION NO.201-14-14295 A Resolution of the City of South Miami to encourage Florida Power &Light Company ("FPL"),the Public Service Commission and the state legislature to give electrical utility customers a larger percentage for their net metering credit if the customers contribute their excess electricity toa non-profit charity. WHEREAS,net metering allowscustomers of Florida Power &Light Company ("FPL")to offsettheirelectricityusagewithelectricitythecustomergeneratesusingsolarpanelsonahomeora wind turbine.These installations are connected toa bidirectional meter,which will measure thenet quantity of electricitythatthecustomeruses("retailmeter").Theretailmeterspinsforwardwhenthe customeruses electricity fromFPL,anditspinsbackwardwhenthecustomergeneratesexcess electricity(thereby "exporting"electricitytotheelectricgrid).Aspecialretailmeter(alsocalledthe "netmeter")isrequiredtoallowforthe"netting"of usageandgeneration,especiallywhentheremay be exporting of electricity. WHEREAS,thenetmetering tariff isaschedule of therates,charges,termsandconditions affecting howFPLandother electrical distributors treatanet metering customerwhen providing net metering or other distribution services to customers. WHEREAS,underthepresentnet-meteringtariff,FPLlevelsupwithsolarover-producersin December,butonlypaysthevalueoftheavoidedfuelcosts(~3cents/kilowatt-hours "kWh"),rather thanthefullvalue ofthepowerwhichis 9-11 cents/kWh;and WHEREAS,one concern isthatFPL would demand thatsolar producers donate their surplus every month,which would damage net-metering because a producer could not bank surplus power from asunnyApriltocoveradeficitinacloudyJune;and NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.TheCityshallnegotiatewithFPL,andlobbythePublicService Commission and the state legislature to change thenet metering tariffso that customers who generate their own electricity can donate theirnet surpluspower annually toa non-profit charity forthe fiill write-off value and to have FPL make a year-end power donation in the customer's name,amounting to the banked surplus of theproduceracrossthecalendaryear. Section 2.Severability.If any section clause,sentence,or phrase of this resolution is for any reason held invalid or unconstitutional bya court of competent jurisdiction,the holding shall not affect thevalidity of theremainingportions of thisresolution. Section 3.Effective Date.This resolution shall become effective immediately upon adoption byvote of theCityCommission. PASSEDANDADOPTED this7th day of October ,2014.
