A resolutionrelating toan appeal of a decision of the Environmental
Review and Preservation Board regarding the approval of a signage
installation located at 5701 Sunset Drive.
WHEREAS,the Environmental Review and Preservation Board (ERPB)atitsJuly1,
2014 meeting reviewed Application No.ERPB 14-041 andapprovedwithconditions,therequest
forsignage installation fora tenant spacelocatedattheShopsat Sunset Place,5701Sunset
Drive;and
WHEREAS,onJuly 21,2014theapplicant,SaulSigns,filedanappealtothedecision of
the Environmental Review and Preservation Board claiming thatthe board only approved one(1)
of the three (3)signs that were proposed;and
WHEREAS,Section 20-6.2(A)of the Land DevelopmentCode allows foran appeal of
an ERPB decision tobe made totheCity Commission bythe applicant,interested citizens,orthe
City administration;and
WHEREAS,Section 20-6.2(E)of the Land Development Code provides thattheCity
Commission may reverse,affirm,or modify any decision of the Environmental Review and
Preservation Board on which there has been an appeal.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.That the appeal of the decision of the Environmental Review and Preservation
board made July 1,2014 regarding the approval of a signage installation located at5701 Sunset
Drive is gra]nited for the installation of one-blade sign in compliance
with the City code size requirements (3 square feet).
Section 2.Severability.If any section clause,sentence,or phrase of this resolution isfor
anyreasonheld invalid or unconstitutional byacourt of competent jurisdiction,theholdingshall
notaffectthe validity of the remaining portions of this resolution.
Section 3.EffectiveDate.Thisresolutionshallbecomeeffectiveimmediatelyupon
approval bythe City Commission.

When originally reviewed by staff,itwasfound that both the entrance signand the
storefront sign complied with the regulationsfor Flat Signs.Pursuantto Section 20-
4.3(l)(5)of the Land Development Code,
FLAT SIGNSwitha total aggregate signarea,not to exceed twenty (20)
percent of thearea of anybuilding face;forthe purposes of sign
regulation,there shall be considered to be only four(4)facadesto any
building;nosinglesignshall exceed two hundred (200)square feet in
area.Direct illuminationis permitted.
However,when reviewing the blade sign,itwas found that it exceeded the maximum
squarefootageallowedforhanging signs.Pursuant toSection 20-4.3(0(5)ofthe Land
Development Code,
One (1)HANGINGSIGN per establishment,not to exceed three (3)
squarefeetinareaeach.Signsshall be uniform in size and design within a
single property but may varyinlettering style and color,provided that
they are compatible and coordinated with other signsforindividual
establishments in the same development Indirectilluminationis
permitted.
Because members ofthe ERPB feltthattheamountof signage thatwasbeingproposed
was excessive,applicationNo.ERPB 14-041 wasgrantedapprovalwith the condition
thatonly the entrance sign (sign over the door)beapproved.
Analysis:
On July 21,2014,the applicant submittedan application to appeal the approval of
ERPB-14-041 tothecitycommission.The applicant feltthatbecausethesubjectstoreis
recessed backby approximately ten (10)feet,itwouldn'tbe immediately visible tothe
malls'pedestrian traffic.Theapplicant also stated that because other tenants in the mall
have similar signage,they should be allowed to install their signage as originally
intended.Pursuant toSection 20-6.2(A)ofthe Land DevelopmentCode,a decision
madebythe ERPB maybeappealedtotheCity Commission bytheCity administration,
the applicant,or an interested citizen.The City Commission has 60 days from the filing
date to hear the appeal and entera decision (reverse,affirm or modify the ERPB
decision).The filing ofthe appeal stays all actions or proceedings related tothe
development oftheproperty.

As part ofthe appeal package,the applicant submitted photographs of signage for
various tenantsoftheShopsat Sunset Place.After an inspection thatwas conducted by
staff,itwas found thatwhilea small percentage of tenants have signage similar towhat
the applicant is proposing,a majority ofthe signage withintheShopsatSunset Place
complieswiththe Signage Master Plan,which has beenusedbystaff since its adoption
bytheShops.The photographs below indicate the existing tenantswhohave signage
similarto the applicants'request:

As shown on the attached BuildingB Partial Elevation,sheet A-G4.07,only one sign
locationis shown for tenant space 1-A18,thelocationforU.S.PoloAssn.Accordingto
the plan,the signlocation that was approved forthis tenant spacewasasignthatwas
mounted behind the building face,and not onit.Basedonthis,the onlysignthatcould
beinstalled that would be in compliance with the signagemasterplan would bethe
entrance sign.
Conclusion:
TheCity Commission mayapprovetheapplicant'sappeal,thereby approvingthe
additionalsignage,deny the appealorrefer the applicantbacktothe ERPB for
reconsideration.If the Commission shouldapprovetheappeal,itis recommended that
thesizeofthehangingsignbereducedsothatitisincompliancewiththe hanging sign
regulations that are listed above.

Thetwo exterior signs servewiththe purpose of making thestoremore visible tocustomereyes,
sincethestorelocationrecedesback20feetfrom plaza hallways thatdoesnotallowcustomerto
easily locate the store.
We appeal tothis decision duetothe fact thatthereareotherstoreswithinthesame plaza that
have multiple exterior signs throughout the place.For example,Buffalo Wild Wings has a Cabinet
Boxatstoreentrance,bladesignlessthan5feetawayfromstoreentrancealongwitha Channel
Letter sign facing 57th Avenue.
All we ask isto have approved the store front signs.We do notneed exterior signs on any major
streets.Weonlywantthem inside the plaza bythestore.The Plaza has approved all ofour signs we
areonlyhavingissues with the city's preference.
On September 2nd@ 7:00 pm I will be attending a board meeting atthe city building /zoning
department to present the argument we have in regards tothe signage we plan to install.It's only
fair to allow a store front sign for us when other companies in the plaza have multiple signs near and
far in the same location.

Staff Analysis:
The applicant is proposing to install a total of three (3)signs onthe exterior surface above
the storefront for the U.S.Polo Association,anew tenant in the Shops at sunset Place.
Because two (2)ofthe three (3)signs are considered tobe flat signs,Section 20-4.3(0(5)
All Other Zoning Districts,of the Land Development Code,provides the following
regulations for flat signs:
FLAT SIGNS with atotal aggregate sign area,nottoexceedtwenty (20)
percent of the area ofany building face;for the purposes of sign regulation,
there shall be considered to be only four (4)facades to any building'no
single sign shallexceedtwo hundred (200)square feet in area.Direct
illumination ispermitted.
Located directly above the entrance leading into the store,the first proposed illuminated
sign will consist ofa white colored sign box with two (2)lines of push thru letters that will

read"U.S.POLO ASSN/'inredcolored letters and "since 1890"inblackcoloredletters.
The company logo,polo players,will be placed above the wording.The sign box will
have a height of sixteen (16)inches,a length of seventy-seven (77)inches,and a sign area
of approximately 8.53 square feet.The company logo will have a height of thirty-eight
(38)inches,a length of twenty-two (22)inches,and a sign area of approximately 5.81
square feet.It is important to note that because they are attached together,both the sign
box and the company logo are considered to be one sign even though separate
dimensions were provided for each of them.After review of the proposed sign,it was
found that it complies with the regulations listed above for flat signs.Also,when
combined,the square footage would be increased to 14.34 square feet,which complies
with the regulations listed above for flat signs as well.
Thesecond proposed;illuminated sign will be mounted tothe wall above the storefront
and will have similar text.This sign will consist of clear acrylic letters that will read "U.S.
POLO ASSN."in red colored letters and "SINCE 1890"in black colored letters.The sign
will have a total height 26.5 inches,a total length of 198 inches,and a sign area of
approximately 36,47square feet.After review ofthe proposed sign,it was found that it
complies with the regulations listed above for flat signs.
The third sign will be mounted to the column adjacent to the entrance into the store.
Considered tobea hanging sign,Section 20-4.3(0(5)All Other Zoning Districts,of the
Land Development Code,provides the following regulations for hanging signs:
One(1)HANGING SIGNper establishment,nottoexceed three (3)square
feetin area each.Signs shall be uniform insizeand design within a single
property,butmay vary in lettering style and color,provided that they are
compatible and coordinated with other signs for individual establishments in
thesamedevelopment Indirect illumination is permitted.
The proposed non-illuminated double-sided sign will consist ofthe company logo ona
white colored background.Mounted tothe column with bolts,the proposed sign will have
a height of twenty-four (24)inches,a length of twenty-four (24)inches,anda sign areaof
approximatelyfour (4)square feet,whichexceedsthesize regulations listed abovefor
hangingsigns.
Conclusion:
PursuanttothesignagemasterplanfortheShopsatSunsetPlace,itwasfoundthat only
onesignlocationisallowedper unit.Whileboth flat signscomplywiththeflatsign
regulations,onlyonecanbelocatedonthe building.Also,even though the photographs
provided show retail stores inthe mall that have hanging signs,there areno approved

locations onthesignagemaster plan.Because ofthis,staffcanonlysupportone (1)ofthe
proposed flat signs,anddenythe remaining proposed signs.
Recommendations:
Staff recommends Approval for only one (1)ofthetwo (2)flatsignswiththefollowing
conditions:
1.Noelectrical wiring isto be exposed;
2.All signage from theprevioustenantmustberemoved,andanydamagetothe
building repaired;
3.Anyadditionalsignagewill require aseparateapplicationtothe ERPB for reviewand
approval;and,
4.Any comments and/orsuggestions from the Board.
Staff recommends Denial for one (1)ofthetwo (2)flat signs,andthe hanging sign withthe
following comments:
Because the signage master plan for the Shops of Sunset Place only allows for one (1)sign
location for the unit,onlyone (1)sign can be approved.However,pursuant to Section 20-
4.3(L)ofthe Land Development Code,other typesof signs,not expressly permitted by
regulations stated in Section 20-4.3(1),maybe approved bythe Environmental Review and
Preservation Board (ERPB)when the following conditionsaremet:
1.Thattheproposedsignisnot prohibited bySection 20-4.3(E);
2.That the proposed sign conforms tothe Florida Building Code and other code
regulations,asapplicable;
3.That the proposed additional sign onthe building does not occupy more than 30%
ofthe facade on which it is proposed tobe installed or more than 20%of any
window area;and
4.Detached signs maybe permitted on any commercial property with the approval of
the Environmental Review and Preservation Board,including detached signs that
exceedthepermitted location andheight standards set forth in Section 20-4.3(1).
Staff recommends the following conditions should the Board decide to approve the
remaining flat signand/orthe hanging sign:
1.The hanging sign should be reduced so that it complies with the regulations for
hangingsigns;
2.No electrical wiring istobe exposed;
3.All signage from the previous tenant must be removed,and any damage to the
building repaired;
