An Ordinance of the City of South Miami,Florida,amending Section 2-7,
Administrative department;functions and duties;creating a cost recovery
administrative program.
WHEREAS,the City Administration has conducted a review of costs incurred by the
City forthe review of development applications andfor other City functions and transactions;
and
WHEREAS,theCity Administration findsthat existing fee schedules donotfully cover
theCity'scostsinthe administration andreview of applicationsandrequests;and
WHEREAS,theCity Administration findsthatitisinthebestinterests of theCityfor
theCitytorecoverthecostsforservicesrelatingtothereview of developmentapplicationsand
othertransactionswiththeCityfromthosepersonsderivingthebenefit of thereviewand/or of
the transaction,as provided herein;and
WHEREAS,theCityAdministrationfindsthatadoption of theseregulationsisinthe
bestinterestandwelfare of thecitizens of theCity.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section1.Section2-7 of theCity of SouthMiamiCode of Ordinancesisherebyamendedto
read as follows:
Section 2-7.Administration department;functions and duties.
£1}The administration department shall operate directly underthe supervision ofthe
citymanagerandshallconsist of the following divisionsandduties:

(2)Costrecoveryadministrativeprogram.
{a}Intent.Theintentofthis Ordinance isto provide fora procedure forthe recovery
of costs related tothe review required bythe City's Land Development Code and/or,
except as otherwise specified below,other City Code provisions .so that those persons or
entities,who apply foror request the City's review and/or approvalwillbethe ones who
bearthecosts of reviewand/orapproval.
(b)Applicability of provisions.The cost recovery required herein shall not apply to
applications or transactions that are originally initiated by oron behalf of the City.
(c)Cost recovery.Thecost recovery administrative program is hereby created as
follows:

(T)Tothe extent that any application for review and/or approval bythe City
under the City's Land Development Code or,except as otherwise specified below,
other City Code provisions which require review by City staff.City contractors,
agents or consultants,the actual costs for such review shall be passed ontothe
applicant.Costs fortheCity Attorney and/or any other outside contractors,agents
or consultants of the City shall be charged tothe applicant inan amount equal to
the actual hourly rate charged to the City.
(ii)Fees charged by Miami-Dade County to process building permits and
other development applications onthe behalf of the City shall not be affected by
this provision-
Cm)Unless prohibited bylaw,in circumstances in which the City prepares
closing papers,deeds,or other documents in conjunction with matters in which
the City holds a lien andis requested to subordinate its position,the City shall
charge the applicant a reasonable fee,as determined bytheCity Manager,inan
amount equaltothe actual costs incurred bytheCityforthe preparation of such
documents.
(iv)Application feesfor public hearings and other items involving City action or
review shallbeassetforthintheCity's adopted fee schedule,as amended.
Section 2.Codification.Theprovisions of thisordinanceshallbecomeandbemadepart
of theCode of Ordinances of theCity of SouthMiamias amended;thatthe sections of this
ordinancemayberenumberedorre-letteredtoaccomplishsuchintention;andthattheword
"ordinance"maybechangedto"section"orotherappropriateword.
Section 3.Severability.Ifanysection,clause,sentence,orphrase of thisordinanceis
for any reason held invalid or unconstitutional bya court of competent jurisdiction,this holding
shallnotaffectthevalidity of theremainingportions of thisordinance.
Section 4.Ordinances in conflict.Allordinancesorparts of ordinancesinconflictwith
theprovisions of thisOrdinancearerepealed.
Section 5.Effective Date.This Ordinance shall be effective immediately upon adoption.
