AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI,FLORIDA,RELATING TO RIGHTS-
OF-WAY;APPROVING A LICENSE AGREEMENT BETWEEN THE
CITY AND XO FLORIDA,INC.TO INSTALL,OPERATE AND
MAINTAIN TELECOMMUNICATIONS SYSTEMS IN THE
MUNICIPAL RIGHT-OF-WAY;PROVIDING FOR SEVERABILITY,
ORDINANCES IN CONFLICT,AND AN EFFECTIVE DATE.
WHEREAS,theMayorand City Commission of the City of South Miamiowns
andoperates rights-of-way in which telecommunications companies desiretoinstall,
operateand maintain telecommunications systems;and,
WHEREAS,within thelastfewyearsthe United StatesCongressandtheFlorida
Legislatureenacted sweeping telecommunications reformlegislationtopromotethe
development of nationalandinternational telecommunications systems;and,
WHEREAS,the Federal Telecommunications Act of 1996,47 U.S.C.§253(c),
preservesthe power of theCitytomanagetheuse of its rights-of-way by
telecommunications companiesona competitively neutraland nondiscriminatory basis;
and,
WHEREAS,theMayorandCity Commission enactedOrdinanceno.5-99-1679
onMarch2,1999,toregulatetheuse of the City's rights-of-ways by telecommunications
companies;and,
WHEREAS,the City received a completed application by XO Florida,Inc.to
install,operateand maintain a telecommunications system inthe City's rights-of-way,the
CityManagerrecommends approval of theapplicationonthebasesthattheapplicant
satisfiesthetechnical,legaland financial qualificationrequirements,andtheCity
Attorney recommends approval of theattachedstandardlicenseagreement.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.The License Agreement Between The City of South Miami,Florida
and XO Florida,Inc.which isannexedtothisordinanceasApp.1,isapprovedandthe
CityManageris authorized to execute anddelivertheagreementon behalf of theCity.

Section 2.If any section,clause,sentence,or phrase of this ordinance isforany
reason held invalid or unconstitutional bya court of competent jurisdiction,theholding
shallnot affect the validity of the remaining portions of this ordinance.
Section 3.All ordinances orparts of ordinances in conflict with the provisions
of tins ordinance are repealed.
Section 4.This ordinance shalltake effect immediately upon approved.

Subject:Ordinance relating toapproval of license agreement for telecommunication

Discussion:The city hasbeen requested bya telecommunication company toinstall
telecommunication equipment inthe city's rights-of-way.An ordinance is presented for
commission action.
The power of thecityto regulate service providers islimitedto managing the physical
installation,use and maintenance of telecommunications equipment in the city's rights-of-
way.Federallegislation(theFederalTelecommunicationsAct of 1996.47U.S.C.§253(c))
requireslocalgovernmenttoallowtelecommunicationcompaniestoutilizemunicipalrights-
of-wayona non-discriminatory,competitively neutralbasis.The Florida Legislature
regulatestheamount (1 %of grossreceiptsonrecurringlocalservicerevenues)thatlocal
governments may charge foruse of the rights-of-way.
TheMayorandCity Commission enacted Ordinance no.5-99-1679 onMarch2,1999,to
regulatetheuse of the City's rights-of-waysbytelecommunicationcompanies.The
ordinance provides forthecityandthe service provider toenter into a license agreement.The
ordinanceandthe agreement provideforcarefulmanagement of thelocation of physical
facilitiesintherights-of-way.TheCityAttorneypreparedastandardagreementforuseby
alltelecommunicationcompanies.TheCityManagerisresponsible for determiningthatthe
companyhasthelegal,technicaland financial abilityto install,operate andmaintainthe
facilities.IhaveadvisedtheCityManagertoacceptFloridaPublicSen-iceCommission

certificatesasadequateevidence of ability.
Itisexpectedthatapproval of the agreement willhavea moderate,positiveeconomicimpact.
Thedirectcoststothecityshouldbecoveredbytheapplicationfeeandanyapplicable
pennit fees.Itisnotpossibletodeterminetheamount of revenuethecitywillreceivefrom
recurringlocalservicerevenues.Licensefeesarepaidtothecityonaquarterlybasis.
Recommendation:Approve the proposed ordinance onfirstreadingand schedule second
reading and public hearing.
