AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI,FLORIDA RELATING TO THE PERMIT FEE
SCHEDULE;AMENDING ORDINANCE 14-90-1454 AS AMENDED BY
ORDINANCES 6-92-1501,17-92-1512A,10-95-1583,AND 18-99-1692,
INCREASING SOME PERMIT FEES,ADDING NEW FEES,REPLACING
LAND USE APPLICATION FEES AND DELETING SECTION F-12 FROM
THE SCHEDULE,PROVIDING FOR SEVERABILITY,ORDINANCES IN
CONFLICT,AND AN EFFECTIVE DATE.
WHEREAS,theCity conducted anaudit of thePlanningandBuilding Departments
resultinginthe Consultant's recommendationtoprovideimprovedservicesduringthepermitting
process;and
WHEREAS,the Consultant's interview of theprocessusersindicatedtheir willingness to
payhigherfeesforimprovedservices;and
WHEREAS,theMayorandCity Commission desiretoadoptanewPermitFeeSchedule
allowingfundingforimprovedservices.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section1.That Ordinance 14-90-1454,asamendedby Ordinances 6-92-1501,17-92-
1512A,10-95-1583and18-99-1692isamendedbyreplacingthePermitFeeSchedulewiththe
amended Permit Fee Schedule attached to this Ordinance.
Section2.If anysection,clause,sentence,orphrase of thisordinanceisforany
reasonheld invalid or unconstitutional byacourt of competentjurisdiction,theholding shall not
affectthevalidity of the remaining portions of this ordinance.
Section3.Allordinancesorparts of ordinances inconflictwiththe provisions of this
ordinancearerepealed.

Section 5.This ordinance shalltakeeffectimmediatelyupon approval.

BACKGROUND AND ANALYSIS
TheCity periodically reviewsitsfeeschedulesin order todetermine if appropriate ratesare
beingchargedforCityservices.TheCityalsohasrecentlyhiredconsultantstoperformanaudit
of thepermittingprocessasitgoesthroughthe Planning andBuildingDepartments.The
consultantshavecompletedtheirstudyandmade several recommendationstotheCity,including
thehiring of additionalpersonneltomaketheprocessmore efficient anduserfriendly.
Thegroupinterviewedbytheconsultantswas representative of theprocessusersandincludeda
crosssection of largedevelopers,small contractors andownerbuilderswhoarepresentlyorhave
recently been involved intheprocess.
As part of thisauditthe consultants spent several hours interviewingtheusers of theprocessand
exploringtheirviewsfortheimprovement of the permitting process.Togethertheyidentifiedthe

areasthatneed improvement anddevelopedastrategytoimplementthoseimprovements.The
consultantspointed but thatthe improvements wouldrequirefundingandthegroupagreed that
theywouldbehappytopayhigherpermitfeesinexchangeforabetterandfasterprocess.
This ordinance includes the higher feesthatwill allow the implementation of the plan while
excludinghomeownersfromthefee increases.Minimumpermitfeesandfeesfornew
construction have been broken downintotwo categories;commercial and residential inorderto
accomplishthis.Thenewfeatureswillbringthepermitfeesclosertoactualcostsincurredbythe
Citywithout penalizing taxpayers.
Theproposed Schedule increasesfeesto a.scale thatis comparable tofeesatother municipalities
andtheCounty,althoughstilllowerthanmostCities.The new Countyfeeschedule includes-;
minimum feesthatrangefrom $113.35 to$203.80andKey Biscayne has increased minimum
feesto$125whileweareproposinga$100minimumfeeforcommercialdevelopment.
This Ordinance replaces items 1 through 12oftheLandUse Application Fees,whichhad
previously,.been deletedfor future clarification.These items havebeen replaced without any
changes to^me fee structure.It also includes a more reasonable fee for shop drawing review and
deletessection F-12,freepermitsforworkunder$1,000whichhasproventobeveryprofitable .

submitted bythe applicant,staff will estimate the value based on current prices forthetotalcost
of laborand materials.Constructionstartedpriortotheissuanceofapermit will notbeexempt
frompermitfees.
(G)REFUNDS,TIME LIMITATIONS AND CANCELLATIONS
Fees charged for a permit required by the South Florida Building Code,shall be refunded by
theBuilding Official subjecttothe following:

a)Permitfees of $200orless
b)PermitsrevokedbytheBuilding Official
c)Permitscanceledbycourtorder
d)Permitswhichhaveexpired
e)Permitsunderwhichworkhascommenced
f)The original permit holder when there isa change of contractor.
2.A full refund will be granted toa permit holder who takes outa permit covering work
outside Citylimits.
3.A full refund,less $200 or50%ofthe permit fee,whichever is greater,will be granted toa
permit holder who requests a refund provided that:
a)A written request is submitted to the City prior tothe permit expiration date;and
b)A validated copyofthe permit is submitted withsuch request.
