No. 15-00-1717ORDINANCE NO.15-00-1717 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OFSOUTHMIAMI,FLORIDA,RELATING TOBOARDS; TRANSFERRING SEC.2-26.1,ENTITLED "COMMISSION FOR WOMEN"TO SEC.2-26 AND CREATING SEC.2-26.1 ENTITLED "JUNIOR COMMISSION FOR WOMEN";PROVIDING FOR SEVERABILITY,ORDINANCES INCONFLICT,AND AN EFFECTIVE DATE. WHEREAS,the Mayor and City Commission of theCity of South Miami created sec.2-26.1,of theCity of SouthMiamiCode of Ordinances,entitled "Commission for Women"1;and, WHEREAS,theCommission for WomenandMayorandCityCommissionhave determined thatthereisanimportantneedtocreateaJunior Commission for Women to address the critical needs of the young women of South Miami of all backgrounds;and, WHEREAS,theMayorandCity Commission desiretocreateaJunior Commission for Women. NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.Sec.2-26.1 of theCity of SouthMiamicode,entitled "Commission for Women"is renumbered to Sec.2-26. Section 2.Sec.2.26.1 of the code is created to read: Sec.2.26.1.Junior Commission for Women. (a)Created,composition.ThereisherebycreatedaJunior Commission for Women.The commission shallconsist of leasteight(8)members. (b)Appointmentandqualifications of members.Members of the commission shallbeappointedbytheMayorasprovidedforintheCity Charter. Membersshall:(1)eitherbearesident of theCity of South Miamiora studentataSouthMiamischool,(2)beage 13 throughaseniorinhigh The Municipal CodeCorp.,whichcodifiesthecity'sordinances,designatedthecommissionastheCommitteeon theStatusof Women.Itwillbedirectedtochangethenameinthenexteditionofthecity'scode. Page 1 of4 school;(3)be involved in at least one extra-curricular activity;and (4) maintain at least a "C"grade point average.An applicant must present two recommendationsfromeithercurrentand,or,former teachers andone recommendation from a person who is not a member of the applicant's immediate family attesting to the applicant's good character and leadership ability.The Commission for Women shall review all applications and make recommendations for appointment tothe mayor. (c)Terms of office.Inorderthattheterms of office of all members of the commission shall not expire at the same time,the initial appointments tothe commission shall be as follows:Vi of the members shall be appointed for two years and XA of the members shall be appointed for three years.In theevent the number of initial appointments to the commission makes up an odd number,then one more person shall be appointed for two years.Thereafter, appointed members shall serve for two years or until a successor is appointed. Appointments to fill any vacancy on the commission willbe for the unexpired term. (d)Change in number of members.The number of persons serving onthe commissionmaybe increased or decreased bythecity commission based on the level of participation by young women.In the event of a change in members,the number of members that mustbe present to constitute a quorum for a meeting shall behalfthe total members plus one.In theevent of any increase inthe number of members,the terms of office shall be prescribed by the city commission. (e)Chairperson and vice-chairperson.The chairperson and vice-chairperson shall beelectedbythe members of thecommission for aterm of one year. Themembersmayelectany additional officersthattheydeem necessary. (f)Removal.Whenany member fails to attend three consecutive meetings withoutanexcused absence,themember shall beremovedbythecity commission.An "excused absence"shall include,but notbe limited to,an absenceresultingfromadeathinthefamily,or of ateacheroraclose personal friend,a personal orfamilyillness,beingout of townon personal business,field trips or other school-related matters,or vacation,and preparing for final examinations,and shall be subject tothe approval of the chair.An action of the commission shall not be nullified because one or more of its membersare later determinedtobedisqualifiedfromholdingthat office. (g)Liaisonwith Commission for Women.Thechairpersonorthevice- chairperson of thecommissionwill attend monthlymeetings of the Commission for Women;likewise,the Commission for Women shall Page2 of4 designate two members who shall attend meetings of the Junior Commission for Women on a rotating basis.The designated persons shall attend meetings in a non-voting ex officio capacity.Failure to attend a meeting as an ex officio member shallnotcount against the member asan unexcused absence. (h)Meetings,expenses.Regularly scheduled meetings shall be held monthly at cityhallataconvenienttimetobedecidedbythe commission members.The members may change the place and time of a particular meeting by motion and avote of the majority of members present ata regularly scheduled meeting.A majority of the members ingood standing shall constitutea quorum necessary tohold meetings andtake action.Regular and special meetings shall be scheduled,and notice shall be given,as provided in the city code for meetings of thecity commission;provided,however,that scheduling special meetings shall require the written request of amajority of themembers ingood standing.Minutes shall bekepteitherby recording orinwritten form. Membersshallservewithoutcompensation,butshallbereimbursedfor necessaryandauthorizedexpensesincurredintheperformance of thework of thecommission.Abudgetmaybe established bythecity manager for the purpose of funding expenses. (i)Powersandduties.Thepowersandduties of the commission shallinclude, but not be limited to: (1)Toserveinan advisory capacitytothe Commission for Women andto theMayorand City Commission by making investigations,studies, reportsand recommendations inrespecttoallmatterspertainingtothe status of young women inthe City of South Miami andin South Miami schools;including the working,educational and living conditions of young women;education and training;health,teen pregnancy and exposure to predatory crimes;availability of quality and accessible health services,educational,family and psychological counseling services;availability of meaningful employment for young women; discrimination andresponsiveness of government totheneeds of young women. (2)To study,reportonand recommend needed improvements inthe existence and delivery of needed medical,educational,criminal and social services. (3)To appear before the Commission for Women and the Mayor and City Commission to deliver reports,recommendations and requests for assistance. (4)To perform otherduties,functionsand services as may be requested by the Commission for Women andthe Mayor and City Commission. Page 3 of 4 Section 3.Ifany section,clause,sentence,orphrase of this ordinance isforany reasonheld invalid orunconstitutionalbyacourtofcompetentjurisdiction,theholding shallnotaffectthe validity of the remaining portions of this ordinance. Section 4.All ordinances or parts of ordinances inconflictwiththe provisions of this ordinance are repealed. Section 5.Theprovisionsof this ordinance shallbeincludedintheCityof South Miami Code of Ordinances. Section 6.Thisordinanceshall take effect immediately upon approved. It seemed hopeless thatthe band would get another spot at Gusman on such short notice. The only alternative they came upwithwas Immanuel Presbyterian Church,6605N. Kendall Dr.,next door to the school. "The church isa lot smaller and it doesn't have a stage," said Silvia Winitzky,a member of Gulliver's Cultural Arts Committee and mother of Danny,a bassoon player inthe band. It was then that Bobby Keet- ing,Gulliver Academy's music director,and Joe Catalano from the drama department,started calling UM trying to somehow findan opening,so the band could perform at Gusman. They found a spot forMay 23—andthe performance took ona special meaning for both Canstonguay andthe students. "It gaveusa purpose because it was dedicated to Mr.Can stonguay's grandfather,"said Danny Winitzky,16. The Cultural Arts Commit tee started posting fliersandre- mailing invitations for the event. 'We had no idea what the turnout would be,"said Silvia Winitzky.'But the theater turned out about 85 percent full." Since Canstonguay took over the program at Gulliver 3V:years ago,he has been aim ingfor growth. When he arrived there were only 11 members in the band, and now there are 86 students involved with the program. 'I started rebuilding the pro gram from the bottom up,"he said. And this year's performance proved hewas reaching his goal. 'We always doa combined program with the academy,but this year we split up because we're both growing and devel oping rapidly,"Canstonguay said."Gulliver is usually known for sports teams,but we're try ing tolet the community know that Gulliver has an outstand ing music program."
