AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
SOUTH MIAMI,FLORIDA,RELATING TO HOME OCCUPATIONS;AMENDING
CHAPTER 20 OF THE CITY OF SOUTH MIAMI LAND DEVELOPMENT CODE
BY AMENDING SECTION 20-2.3 ENTITLED "DEFINITIONS"IN ORDER TO REVISE
THE DEFINITION OF HOME OCCUPATION;BY AMENDING SECTION 20-2.3(D)
ENTITLED "PERMITTED USE SCHEDULE"TO ALLOW HOME OCCUPATIONS
ASA PERMITTED USEIN RESIDENTIAL ZONING DISTRICTS;BY AMENDING /
SECTION 20-3.6(P)ENTITLED"OCCUPATIONALLICENSES-HOME
LOCATION PERMITTED"IN ORDER TO REVISE CONDITIONS FOR HOME
OCCUPATIONS;BY AMENDING SECTION20-5.5,ENTITLED "APPLICATIONS
REQUIRINGPUBLICHEARINGS,"INORDERTOELIMINATEPUBLICHEARINGSFOR
HOME OCCUPATIONAL LICENSES;BY AMENDING SECTION 20-6.1 (B)(3)(e)TO ,
ELIMINATE PLANNING BOARD REVIEWOF HOME OCCUPATIONAL LICENSES,
PROVIDING FOR SEVERABILITY;ORDINANCES IN CONFLICT;AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS,thePlanningandZoning Department has initiated a program toupdate,clarify,and
improve the provisions of the City's Land Development Code and to update provisions ofthe City's Land
Development Code;and
WHEREAS,afterreviewandconsiderationthePlanningandZoningDepartmenthasdeterminedthat
the current regulationsregarding home occupations need tobe revised dueto inconsistency;and
WHEREAS,thePlanningandZoning Department has recommended amendingcertainprovisionsof
theLand Development Codeas follows:Section 20.2.3 torevisethedefinition of homeoccupations,
Section 20-3.3(D)to clarify that home occupations area permitted use,Section 20-3.6(P)to revise the
conditionsonhome occupations,Section 20-5.5 to eliminate requiredpublichearingsforhome
occupational licenses,Section 20-6.1(B)(3)(e)to eliminate Planning Board review of home occupational
licenses;and
WHEREAS,onMarch14,2000afterpublic hearing regardingtheproposedamendmentstoSections
20-2.3,20-3.3(D),20-3.6(P),20-5.5,and Section 20-6.1(B)(3)(e)oftheLandDevelopmentCode,the
Planning Boardvoted5-0totransmitthe proposed amendments totheCityCommission;and
WHEREAS,theCityCommissiondesirestoaccepttherecommendations of thePlanningBoardand
enact the aforesaid amendments.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND THE CITY COMMISSION OF
THE CITY OF SOUTH MIAMI,FLORIDA:

Section 1.That Section 20.2.3,"Definitions,"of theSouth Miami Development Code is hereby
amended to read as follows:
Section 20-2.3 Definitions.
Occupational license -homelocation.An"occupationallicense-homelocation"isan
occupationconductedasanaccessoryusetoaresidentialuseinaresidentialunitandisinaccordance
withtheprovisions of Section 20-3.6(P).(Ord.No.1-92-1496,1-7-92^1 Theincidentaltaking of office
workhomeandcompleting same,byapersonhavingabusinessaddressotherthantheresidence,
shall not constitute the establishment of ahome office andshall continue tobe permitted in
conjunctionwitharesidentialusewithoutregardtotheprovisions of Section20.3.6 (P)of thisCode.
Section2.ThatSection 20-3.3(D)entitled,"PermittedUseSchedule"of theSouthMiamiLand
Development Codeishereby amended toreadas follows:

(1)Oooupational lioenses—homo location"Home Occupations shallbe permitted inan
occupied residential unitprovidedtheycomplywiththefollowing:
(a)Occupationalactivitiesattheresidentialunitshallbeclearlyincidentaland subordinate to
the residential activities.
(b)Allemployeesworkingattheresidentialunitshallallresideandoccupyat-theresidential
unit,astheirprimaryresidence.
(b)Nogoodsforresaleor services shallbe dispensed directlyonthesite.
(d)Noinventory of goodsshallbe kopt onthosite.
(d)Nogoodsshallbe displayed forsaleoras samples onthesite.
0(e)No customers shall be serviced in person onthesitein any way nor shall the occupation
be conducted inanyway which would necessitate customers visiting thesite.
(f)(g)All goods,material and/or equipment,other than motor vehicles,which are used off the
siteshallnotbestoredonthesite oxcopt indoors and/or inmotor vohiolos.
(h)(g)No signs relating to the home occupation or any business shall be located on the site.
(h)Thereshallbenochangeintheoutsideresidentialcharacter of thebuildingor premises,
including swale area,asa result of the conduct of such home occupation.
(i)There shall beno increase in traffic at the site asa result ofthe occupation.
(j)There shall beno increased demand on city services at the site asa result ofthe
occupation.

(3)Permissiontohaveahomeoccupationshallrequirethesubmission ofahomeoccupation
licenseapplicationtotheBuildingDepartment.Theapplicationmustbe accompanied by:
(a)If the applicant forahomeoccupationdoesnotownthe property on which the business
willbe operated,anotarizedstatement of authorization to conduct the business onthe
premisesfromthepropertyownermustbesubmittedalongwiththeapplicationform
before a license is issued.
(b)Aswornaffidavitonaformpreparedbvthe City,whichformconfirmsthatthehome
occupation will conform toallofthe standards containedhereinandagreeingthatthe
City,uponprobablecausetobelievethatthereisaviolation of oneormore of the
standardsso stated,mayinspectthepropertytodetermine if thereisaviolation.Failure
toallowan inspection will result inthe automatic cancellation ofthe certificate ofuse
and occupational license.Failure to correct code violations,after notice,willalso result
inthe cancellation of thecertificate of useand occupational license.
(4)An occupational license and annual certificate ofuseshallbe obtained forany home
occupation.
Section 4.That Section 20-5.5,entitled "Applications Requiring Public Hearings"oftheSouth
Miami Land Development Codeis hereby amended toreadas follows:
Section20-5.5 Applications requiring publichearings.
The following procedures shall be followed for all applications requiring a public hearing before the
planning board and city commission,including all applications for rezoning,text amendments,special
uses,andvariancesandhomooooupationallicenses.
Section 5ThatSection 20-6.1(B)(3)entitled "Planning Board:PowersandDuties"ishereby
amended to remove subparagraph (3)(e):Section 20-6.1(B)(3)Planning Board;Powers and Duties:
Section 20-6.1(B)(3)Planning Board;Powers andDuties:
(e)Tho Board shall review and mako rocommondations onall initial applications forthe
issuanoo of homeoooupationallicenses.
Section 6.All ordinances orpartsof ordinances in conflict withthe provisions ofthis ordinance are
herebyrepealed.

Section7.If anysection,clause,sentence,orphrase of thisordinanceisforanyreasonheldinvalid
orunconstitutionalbyacourt of competentjurisdiction,thisholdingshallnotaffectthevalidity of the
remainingportions of thisordinance.
Section 8.This ordinance shalltakeeffect immediately atthetime of its passage.
