No. 09-00-1711ORDINANCE NO.9-00-1711 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA RELATING TO DELETING SECTION 15-67 TRAINS OBSTRUCTING STREETS;MAXIMUM TIME ALLOWABLE;PENALTY;PROVIDING FOR SEVERABILITY, ORDINANCES IN CONFLICT,AND AN EFFECTIVE DATE. WHEREAS,Section 15-67 of theCity Code of Ordinances establishes maximum times for a train to obstruct traffic at the intersection of a street and a railroad track;and WHEREAS,nosuchcrossingsexistwithinthecorporatelimits of theCity of the South Miami;and WHEREAS,theMayorandCity Commission hasexpressedtheirdesiretohave theCity's Code of Ordinances brought uptodateby deleting obsolete material;and NOW,THEREFORE,BEIT ORDAINED BYTHEMAYORANDCITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.Section 15-67 of theCode of Ordinances of theCity of South Miami currentlyreadsasfollows: Section15-67 Trains obstructing streets;maximum time allowable;penalty. Nolocomotiveortrain of carsshallbeallowedto obstruct any street orcrossing in the city for a longer time than five (5)minutes,and any person having charge of such locomotive or train permitting the same to remain fora greater length of time than the above,shall be punished as provided in section 1-8 ofthis Code.(Code 1926,102) Section 2.TheCity Commission hereby amends Section 15 to delete Section 15-67. Section 3.Ifany section,clause,sentence,or phrase ofthis ordinance isforany reason held invalid or unconstitutional byacourtof competent jurisdiction,the holding shallnotaffectthevalidity of theremainingportions of thisordinance. Section4.Allordinancesorpartsofordinancesinconflictwiththe provisions of this ordinance are repealed.
