WHEREAS,inaccordance with F.S.163.3177(6)(h)theCity of SouthMiamiisrequiredto amendits Comprehensive Planin order to provide additional policies inthe Intergovernmental Coordination Elemen;and WHEREAS,Comprehensive Plan Amendment 99-2,Exhibit"A",hasbeen prepared,which contains amendmentstothe goals,objectives,and policies of the Intergovernmental Coordination Elementall of whichamendments respond tothe changes inF.S.163.3177(6)(h);and WHEREAS,onOctober 26,1999,after Public Hearing regarding ComprehensivePlan Amendment99-2,the Planning Board,acting inits capacity astheLocal Planning Agency,voted 6-0to transmit totheCityCommission for their adoption,the Comprehensive Plan Amendment 99-2,Exhibit "A";and WHEREAS,theCity Commission desires to accept the recommendations of the Planning Board acting inits capacity asthe Local Planning Agency,and enact the aforesaid amendment. WHEREAS,onNovember 2,1999,after Public Hearing ,theCityCommission adopted by ordinance on first reading,Comprehensive Plan Amendment99-2,Exhibit"A";and WHEREAS,theSouth Florida Regional Planning Council atits January 3,2000 meeting found theCity's amendment package (DCA NO.00-R1),which includes Comprehensive Plan Amendment99-2,Exhibit "A",tobeconsistentwiththe Strategic RegionalPolicy Plan forSouth Floridaandfurther recommended itstransmittaltotheFloridaDepartment of Community Affairs; and WHEREAS,in response toa technical commentmade during thereviewperiodbytheMiami- Dade Public SchoolSystem,a clarification revision wasmadetoICEPolicy 1.3.3;and WHEREAS,in response toacomment from the Florida Department of Community Affairs,a newICE Policy 1.3.11 pertaining totheCity's participation intheCounty's Hazard Mitigation Plan was added;and Pane 2 of Ord.No.2-00-1704 WHEREAS,the Florida Department of Community Affairs ina communication dated February4,2000issuedan Objections,Recommendation,and Comments Report(ORC)stating thai:therewereno objections tothe City's amendment package (DCA NO.00-R1)which includes ComprehensivePlanAmendment99-2,Exhibit "A". NOW,THEREFORE,BEIT ORDAINED BYTHE MAYOR AND THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.Amendment 99-2 Exhibit "A"tothe South Miami Comprehensive Plan (DCA NO. 00-R1)containsamendmentstothegoals,objectives,andpoliciesofthe Intergovernmental Coordination Element,said amendments areinrespnsetothechangesinF.S.163.3177(6)(h),is herebyapprovedandadoptedasan amendment totheCity's Comprehensive Plan. Specifically,each local government must demonstrate the particular effects ofthe local comprehensive plan upon development of adjacent municipalities,thecounty,adjacent counties,the region,the state,andother agencies nothaving regulatory authority overthe use ofthe land. TheCityof South Miami's Comprehensive Plan has a separate chapter entitled, "Intergovernmental Element,"which has been approved bythe Florida Department of Community Affairs.The Chapter contains an analysis of howtheCity coordinates the impact of its Comprehensive Plan with other agencies of government. REVISIONS TO STATE STATUTES The contents of each local government's ICE is described inF.S.163.3177(6)(h),whichwas part ofthe original 1985 Growth Management Act.In 1996 this section was amended to require local governments to expand its ICE (Chapter)to demonstrate how it will provide coordination for specific planningissues.Theseare: CampusMaster Plans; SpecialDistricts; Annexation and Service Areas; Populationprojections; School Siting; Facilities Subject to Concurrency; Facilities with Countywide Significance; Problematic Land Uses;and Voluntary Dispute Resolution Processes. Page1 The1996legislationalsoprovidedthatafteramendingtheircomprehensiveplanstorespond totheaboveissues,alocalgovernmentshallhaveoneyeartoenterintoanagreementwith othergovernmentalagenciesin order to formalize the coordination process. The legislation further requires that local governments mustcompleteand transmit the plan amendments prior totheend of 1999.The Department of CommunityAffairs advised all local governments in Miami-Dade County thattheymustadopttheir amendments by October 1999. IMPACT ON THE CITY OF SOUTH MIAMI TheCity of South Miami's Comprehensive Plan needs tobe amended to respond tothe revised regulations.The Intergovernmental Coordination ElementintheCity's Comprehensive Plan was last changed in 1997 as part of an amendment package resulting from thefiveyear Evaluation and Appraisal Report (EAR).The amendment package atthat timewasreviewedbyDCAandwithsome suggested revisions,theamendment package was approved and adopted.The City's ICE Chapter,together with the goals,objectives,and policies was found acceptable by DCA tomeetthe statutory requirements ineffectat that time.TheCity's amendments to ICE Chapter,atthistime,should be limited tomeetingthe new statutory requirements which mustbe included inthe Comprehensive Plan bytheend of 1999. REQUIRED LEGISLATIVE ACTION Attached isa proposed Amendment 99-2,Intergovernmental Coordination Element (Exhibit "A")which isthe City's response tothenew ICE Statutory requirements.The amendment revises theCity's existing goals,objectives,and policies section in order to address the specific planning issues now contained in the Statute.Itis important to note that the City's proposed amendments do not respond to the Campus Master Plan issue.This requirement is only applicable to those jurisdictions in which a State University is located.The revisions to theICE Chapter mustbe adopted by ordinance and then submitted tothe Florida Department of Community Affairs. Objective 1.1 The City shall annually review the comprehensive plans of Dade County,Coral Gables and the equivalent planof the School Board other jurisdictions which impact the City ofSouth Miami,in order to identify and resolve conflicts with the City's Comprehensive Plan,including concurrency related issues. Policy 1.1.1 TheCity Manager shall oversee the implementation ofthe recommendations outlinedinthepriorsectionofthis element,including annexation andprovision of information. Policy 1.1.2 The Community Development Director shall:1)work through the MPO Technical AdvisoryCommitteetoachievecoordination of suchplanningissuesasroad widenings;and2)annuallyconferwithCounty,SchoolBoard,Pineorest,and Coral Gables planning officials.(971ER) Policy 1.1.3 If problemsarise (particularly onstreet widenings orlevelofservice)theCity shall use the informal mediation services of the South Florida Regional Planning Council. Policy 1.1.1 The City shallannuallyreviewthe comprehensive plansofMiami-DadeCounty. City of Coral Gables,the Vilage of Pinecrest and other abutting jurisdictions. Policy1.1.2TheCitywillannuallyreviewtheplansandreports of specialdistrictservice providersincludingbutnotlimitedto:Miami-DadeWaterandSewerAuthority:the South Florida Water Management District and the South Florida Regional Planning Council. Page 4 Policy 1.1.3 The City will coordinate with the above listed service providers that have no regulatory authority over theuse of landto develop recommendations that improve coordination of the City's concurrency management methodologies,systems,and levels of services. Policy 1.1.4 The City will coordinate with staffs of the independent special district authorities in order to resolve conflicts andto identify appropriate amendments to the City's Comprehensive Plan. Objective 1.2 The City will identify and implement procedures to allow for joint planning areas and theresolution ofissues generated injointplanningareas. Policy 1.2.1 The City shall confer with Miami-Dade County and other jurisdictions, as appropriate,toestablisha coordinated approach totheconsideration of future annexation efforts and to the delivery of municipal services to enclaves (unincorporated areas). Policy 1.2.2 The City will review the appropriateness of submitted annexation requests specifically to determine the levels of service to be provided,the cost of annexation to taxpayers, revenue estimates,expenditures,consistency and compatibility of development patterns,and the contiguity of proposed boundaries. Policy 1.2.3.The City shall coordinate with officials from Miami-Dade County,theCityof Coral Gables,and the Village of Pinecrest theFlorida Department of Transportation,the South Florida Water Management District and the South Florida Regional Planning Councilinorderto establish a planning process to identify,review,and address issues of mutual interest relating to abutting boundaries and to enter into agreements with these jurisdictions in regards to appearance,compatibility,service delivery,and mutual aid. Policy 1.2.4 The City mayusethe South Florida Regional Planning Council's dispute resolution process when necessary to mediate the resolution of conflictswithother local governmentsand regional agenciesasit pertains tolandusesandthe goals,objectives, and policies of the Comprehensive Plan. Policy 1.2.5 The City will participate asamember ofthe Miami-Dade Planners Technical Committee andwillencourageimplementation of co-operativepoliciesand proceduresas may bedeveloped bv the Committee. Page5 Objective 1.3 The City will identify and establish joint processes with other local agencies for collaborative planning on population proiections.school siting,facilities subject to concurrency,facilities with countywide significance,and problematic land uses. Policy 1.3.1 TheCitvwill coordinate with the Miami-Dade County Planning Department in order todevelopcountywide population proiections thatincludeexpectedgrowth and/or changes:said changes to be shown in the South Miami Comprehensive Plan. Policy 1.3.2 TheCitvwill advise the Miami-Dade Public School System of population proiections usedinitsComprehensive Plan asit relates tothefutureneedsforschool improvements and school expansions in South Miami. Policy 1.3.3 TheCitywill annually review the Miami-Dade Public School's 5.10.and 15-vear facility plans for siting of new schools and the expansion of existing schools within the City's jurisdiction for consistency with the City's Comprehensive Plan.This review will be done atthe staff leveland feeasb-bv attendance at public hearings conducted bv the Miami -DadePublicSchool System for specific siteplans Policy 1.3.4 TheCitvwillnotifythe School Board ofany proposed land use amendments tothe ComprehensivePlanwhichcouldimpacttheBoard'slong range facilityplans. Policy 1.3.5 Bv November.2000 theCitv shall enter into an interlocal agreement or other formal agreement with the Miami-Dade Public School System,as required bv Section 163.3177(6Vh¥2V Objective 1.2 Continue the pattern ofno land use conflicts between the City's development pattern and adjacentareas. Policy 1.2.1 South Miami officials shall maintain liaison with Coral Gables City officials inany planning or major development impacts in downtown South Miami. Objective 1.3 The City shallannually check with County andState officials to assure that level ofservice standards remain in coordination with these other governmental entities. Policy 1.3.1 In particular,City officials shall workwith State and County officials to agree upon acceptableroadwaylevel of servicestandards,and WASD relative to watera sewage andsolidwaste. Page6 Policy 1.3.6 The Citv will coordinate with the appropriate agencies in order to assure adequate provision of countywide facilities.These agencies shall include,butnot limited to. Miami-DadeWasteCollection-forwastedisposal:Miami-DadeTransitDepartment andthe Metropolitan Planning Organization formasstransit:andtheMiami-Dade PublicWorks Department andtheFlorida Department of Transportation for maintenance of roads and bridges. Policy 1.3.7 The Citv will coordinate with the emergency management program of Miami-Dade County by notifying the County of any current or future landuse policies or population changes which would affect hurricane shelters or emergency evacuation routes. Policy 1.3.8 TheCitv shall coordinate with the following agencies to assure thatits concurrency data andlevel of services (LOS)for roadways,drainage,and potable water supply are appropriate:Florida Department of Transportation.Miami-Dade CountyWaterand Sewer Department South Florida Water Management District,and the South Florida Regional Planning Council. Policy 1.3.9 TheCitvwill review its locational standards on problematic (unwanted)land uses in order to determine if conflicts exist between its regulations and neighboring jurisdiction regulations,and to consider how to resolve any conflicts found. Policy 1.3.10 TheCitvmay participate with Miami-Dade County,the South Florida Regional Planning Council,orother appropriate committees,in order to promote a more efficientregionalapproachtothelocation of problematicorunwantedlanduses. Policy 1.3.11 TheCitvwillparticipatewithMiami-DadeCountyintheplanningand implementation of the County's Hazard Mitigation Plan,asit impacts the Citv of South Miami. Objective 1.4 The Citywill implement a program to identify andresolve conflicts between its regulations and the land use ofneighboring jurisdictions. Policy 1.4.1 The Citv willnotifyandsolicit comments fromadjacent jurisdictions andtheSchool Board of anyrequestsforlanduse amendment variance,conditionalusesorsiteplan approvalswhichimpactpropertywithin500feet of apublicschoolorwithin500feet ofthe boundaries of an adjacent jurisdiction. Community Profile TheCityofSouthMiamiislocatedinthesouth-centralportionoftheMiami-Dade County urbanizedareaand encompasses atotalareaof approximately 1,552 acresor2.4squaremiles. Theestimatedpopulationin1998was 10,518.TheCityisentirelysurroundedbyunincorporated Miami-Dade County except forasmallborder with CoralGablesontheeast.Itcoversa rectangularshapedareathatis approximately definedbyBirdRoadonthenorth,DavisRoadon the South,Red Road'on the east,and Ludlam Road on the west.The City is noncontiguous between MillerDriveandBirdRoad with portionsoftheCity divided bysectionsof unincorporated Miami-Dade County. TheCityisbisected by U.S.Highway #1(US1)whichisasix-lane dividedhighway andthe primary arterial forthe southern portionof Miami-Dade County.Aportionofanelevated,rapid transit rail systemandtransit corridor issituateddirectlyalongsideUS 1,andruns parallel tothe highway through the City of South Miami. SouthMiamihasan established small town character made up often distinct single-family neighborhoods.Multiple-family housing isscattered throughout theCityattheperipheryof single-family neighborhoods.South Miamiresidentshavea variety ofretailservicescloseto home toserve them.The City isalso served by a pedestrian-oriented specialty retail district that servesasacore.The commercial uses serve both residents of South Miami andalarge number of non-residents.Thefuture land use map designatesneitherindustrialusesnoragriculturaluses. Theproposed amendment No.1totheCityofSouthMiami Comprehensive Plan FLUE would includeschoollocationandcollocation criteria.This amendment consistsofdataandanalysis,a new objectiveandtwo new policiesthat would be added totheCity'sFutureLandUse Element Thedataandanalysis,inpart,explainsthatSouth Miamifs permanentpopulationisprojectedto decreaseslightlybytheyear 2005,based upon thelimitedavailabilityofdevelopableland within the City to accommodate growth.TheCity's student age population is expected toremainstable duringthe next tenyears.However,sinceSouthMiamiMiddleSchooliscurrentlyoperating over-capacityat 142%utilization in1997-98andisprojectedto have a utilization of 166%inthe year2003-03,the 1998Facilities Work Program indicates that consideration is being given to significant expansion and/or replacement forSouthMiami Community MiddleSchool. Two new policies would be added that specifically address the statutory requirements by including language that the City of South Miami will encourage thecollocation of publicschools with parks,libraries,and community centerstothe extent possible.The Cityalso commits to coordination with Miami-Dade Public Schools. The following land use categoriesare identified in the existing Comprehensive Plan asthosein which public schoolsare explicitly listed asa permitted use: •Public and Institutional Uses •EducationalUses(asa sub-category of thePublic Institutional Useslanduse designation) •Parks and Open Space Contact with Miami-Dade County PublicSchools confirms that theagencydoesnotobjecttothe schoolsiting amendment asproposed.Staffanalysisconfirmsthatthisproposed amendment would notcreateany significant adverseregionalimpactsandiscompatible with thegoalsand policiesofthe SRPP. Proposed Amendment No.2 Proposed amendment No.2 would amendtheCity'sComprehensivePlanIntergovernmental CoordinationElement(ICE)pursuant toSection 163.3177 (6)(h)(4)F.S.which requireslocal governments toamendtheir adopted comprehensive planstoaddresstheintergovernmental coordination requirements by December 31,1999. Proposed amendmentNo.2would revise the current goal,objectives,and policies tocommit theCityto: •coordination with neighboring jurisdictions andspecialdistrict service providers.In addition,it would includeannualreviewbytheCityoftheplansandreports of these agencies; •identificationand implementation ofjoint planning areasandtheresolutionofissues generatedinjointplanning areas.Supporting policies would address annexation .issuesencompassinglevelsof services andcoststotaxpayersandwould commit the Cityto participation inthe Miami-Dade Planners'Technical Committee; •identification and establishment ofjoint processes with otherlocalagenciesfor collaborative planning on population projections,schoolsiting,facilities subject to concurrency and level of services,facilities with countywide significance,and problematic land uses;and •implementation of a program to identify and resolve conflicts between the City's regulationsandthelanduseofneighboringjurisdictions.Supportingpolicies would address notification of neighboring jurisdictions foranyproposals that may impact property within 500feet of apublicschooloradjacentjurisdiction. Contact with Miami-Dade County PublicSchools confirms thatthatagencyis working with the Citytoclarify some of the proposed language relatingtotheICE update.Council staff will continue to coordinate with the City andtheschool board to help resolve any outstanding issues. Staffanalysis confirms however thatthis amendment as proposed iscompatible with thegoals andpolicies of the SRPP and would not result in significant negative regional impacts. Proposed Amendment No.3 Theproposed amendment totheHousingElementtotheCity of SouthMiami Comprehensive Planhasbeen processed in response totheremedialaction recommended inthe1998 Stipulated Agreement with the Department of Community Affairs (DCA)by incorporating additional text,a new datatable,and revised objectivesandpolicies concerning affordable housing. Background: InFebruary1997,the City of SouthMiami proposed aseries of amendments tothe Comprehensive Planthatwererequiredasa result of the 5-year mandatory Evaluation and Appraisal Report (EAR). Following the submission oftheEAR amendments,theFloridaDCA issued anObjection, Recommendations and Comments (ORC)Report staring thatanaffordable housing needs assessment was missing.DCA recommended mat the City submit an amendment that includes affordable housing dataand additional policiesonaffordable housing. In August 1997,the City adopted a supplemental package of EAR amendments that included a new Housing objective(Objective1.3)and severalpolicies related to affordable housing. In October 1997,the DCA issued a Statement of Finding of Non-Compliance on the August 1997 submission fromtheCity.Itwas recommended thatremedialaction should includea measurable targetfor Housing Objective 1.3. •A Stipulated Settlement Agreement between the City andthe DCA was approved in April 1998. •In August of 1998,the City was required to confirm its stipulated settlement by amending the Comprehensive Plan document tostatethat certain studies willbedoneand policies will be revised.TheCity Commission adopted Ordinance No.12-98-1660 onAugust4, 1998 thatamended the Comprehensive PlanandincludedaninterimPolicy 1.3.6 that committedtheCityto complete the Housing Data and Analysis,and associated policies and objectives,based upon the Affordable Housing Needs Assessment bythe Shimberg Centerfor Affordable Housing. Proposed amendmentNo.3wouldrevisethetextof Objective 1.3byadding measurable affordable housing targets.Specific targets include the construction of 30 affordable housing units through programs and initiatives suchasthe Community Redevelopment Agencyand 100 additional unitsaspartofthe proposed Hometown Station project bytheyear 2005.It further projects the construction ofan additional 150 unitsof affordable housingthrough various programs/projects by the year2010toachieveareduction of thefuture deficit of affordable housing by25 percent Proposed amendmentNo.3would delete four policies andadd five new policies to support Objective1.3.New policieswould: •committheCity'sCommunity Redevelopment Agency(CRA)to implement itsNew HousingPrograminordertoacquirevacantpropertyandprovide financial assistance to constructatleast24 new affordable housing units; •promoteadditionalincentivesbytheCity'sCRAtoprivatedeveloperstoconstruct projects with affordable housing units; •supporttheeffortsof private organizations to construct atleastfive affordable housing units per year; •committheCityandtheCountytojointlysupportdevelopmentintheRapidTransit Zonetoencouragemixed-use/residentialmulti-family projects containingaffordable housing units;and •committheCitytoworkingwiththeSouth Florida Regional Planning Counciltohelp implement aregionalpolicytoaddressaffordablehousingneeds.
