REVIEW AND APPROVALS Planning Board actinginitscapacityastheLocalPlanningAgency recommended approval on October 26,1999.The City Commission atits November 2.1999 meeting approved onfirst reading an ordinance which transmitted the proposed amendment tothe Florida Department of Community Affairs for their review and comments. SPECIFIC WORDING OF STATUTORY PROVISIONS Section 163.3177(6)(a),F.S.requires thatthe"futurelanduseelement must clearly identifythelanduse categories inwhichpublicschools are an allowable use.When delineating thelanduse categories inwhichpublicschoolsareanallowableuse,alocal government shall include inthe category sufficient land proximate to residential development tomeetthe projected needs for schools in coordination withpublic school boardsandmayestablishdiffering criteria for schools of differenttypeorsize.Each local governmentshallinclude lands contiguous toexistingschool sites,tothemaximum extent possible,withinthelanduse categories inwhichpublicschoolsarean allowable use." In1998,thisSectionwasamendedtoadditionallyrequirethatthe "future landuse element shall include criteria which encouragesthe location of schools proximate to urbanresidentialareastothe extent possibleandshallrequirethatthelocal government seektocollocatepublic facilities,suchas parks,libraries,and community centers,with schools to the extent possible." Thelanguage oftheStatutewas further amendedtoprovidethatalllocalgovernments mustcomply(amendtheir Comprehensive Plans)toincludetheschoolsiting data and policies by October 1,1999.If the deadline isnotmet,the Statute provides thata local government willbe prohibited from further amendments toits Comprehensive Plan. IMPACT ON CITY OF SOUTH MIAMI TheCity of SouthMiami's Comprehensive Plan needstobeamendedto respond tothe regulations adopted in 1998.TheCity's existing Comprehensive Plan refers brieflyto area schoolsintheRecreationandOpenSpaceElement,which includesalisting of the acreage andtype of public recreation facilities available ateach location. TheCity'sComprehensivePlandoesprovidefora Future LandUseMapcategory entitled"EducationalUses."whichallowsforpublicschooluses.Thelandusecategory is shown coveringthesitesoccupiedbytheCity'sfourpublicschools.This category specifically responds tothe requirement inthe Statute mandating thatthe future landuse map must allowforlocation of publicschools. The datainTable1.6indicatesthatfour ofthe five publicschools servicing SouthMiamiresidentswill beoverdesigncapacitywithinthreeyears.Seriousover-capacityisshownforSouthMiamiMiddle School(projectedutilizationinyear2003is 166%)andforSouthMiamiSeniorHigh(projected utilization inyear2003is 134%). PUBLIC SCHOOL SITING ANALYSIS Aspreviously stated,SouthMiami's permanent population is projected to decrease slightlybytheyear 2005.(1995-population 10,703;2005-population 10,472.)These projections arebaseduponthe limitedavailability of developablelandwithintheCitytoaccommodategrowth.Baseduponthese projections,South Miami's student age population is expected to remain stable during thenextten years. The projection of increasing over-capacity as shown in table 1-6 includes student enrollment from areas outsidetheCity's boundaries.The 1998 Facilities Work Program indicates that consideration isbeing givento significant expansion and/or replacement for South Miami Community Middle School.Thiswill require coordination between theCity and the School Board in order to assure the placement of proper land use categories topermit expansion andto investigate the possibility of collocation ofother public facilities. Objective 1.6 Recognizing the jurisdiction of Miami Dade Public School system,the Citv will continue in its efforts to actively pursue the advancement of quality public school education programs and physical facilities for South Miami residents. Policy 1.6.1 The citv shall participate with the Miami-Dade Public School System in review of criteriaandstandardsnecessarytoassureadequatepublicschool capacity,including new schools and expansion of existingschools. SouthMiamihasanestablishedsmall town character made up often distinct single-family neighborhoods.Multiple-family housingis scattered tihroughout theCityattheperipheryof single-family neighborhoods.SouthMiamiresidentshaveavarietyofretailservicescloseto hometoservethem.TheCityisalso served by a pedestrian-oriented specialtyretaildistrictthat serves asacore.The commercial uses serve both residents of South Miami and alarge number of non-residents.Thefuturelanduse map designatesneitherindustrialusesnoragriculturaluses. Theproposed amendment No.1totheCity of SouthMiamiComprehensivePlan FLUE would includeschoollocationand collocation criteria.Thisamendmentconsistsofdataand analysis,a newobjectiveandtwonewpoliciesthat would beaddedtotheCity'sFutureLandUseElement Thedataandanalysis,inpart,explainsthatSouthMiami'spermanent population is projected to decrease slightly by theyear2005,based upon thelimitedavailabilityof developable land within theCityto accommodate growth.TheCity's student agepopulationis expected toremainstable duringthe next tenyears.However,sinceSouthMiamiMiddleSchooliscurrently operating over-capacityat142%utilization in1997-98andisprojectedtohavea utilization of 166%inthe year 2003-03,the1998 Facilities Work Programindicatesthatconsiderationis being givento significant expansion and/or replacementforSouthMiami Community Middle School Two new policies would be added that specifically address,the statutory requirements by including language thatthe City of South Miami willencouragethecollocation of publicschools with parks,libraries,and community centerstothe extent possible.The City also commits to coordination with Miami-Dade Public Schools. The following land use categoriesare identified intheexisting Comprehensive Plan asthosein which public schools are explicitly listed asa permitted use: •Public and Institutional Uses •Educational Uses(asa sub-category of thePublicInstitutionalUses land use designation) •Parks and Open Space Contact with Miami-Dade County PublicSchoolsconfirmsthattheagencydoesnotobjecttothe schoolsiting amendment asproposed.Staff analysisconfirmsthatthis proposed amendment would not createanysignificantadverseregionalimpactsandiscompatible with thegoalsand policies of the SRPP. Proposed Amendment No.2 Proposed amendment No.2 would amend theCity'sComprehensivePlanIntergovernmental Coordination Element (ICE)pursuant toSection 163.3177 (6)(h)(4)F.S.which requireslocal governmentstoamendtheiradopted comprehensive planstoaddresstheintergovernmental coordination requirements by December 31,1999. Proposed amendment No.2 would revisethecurrent goal,objectives,andpoliciesto commit theCityto: •coordination with neighboringjurisdictionsandspecialdistrictserviceproviders.In addition,it would include annualreviewbythe City oftheplansandreports of these agencies; •identification and implementation ofjoint planning areasandtheresolution of issues generatedinjoint planning areas.Supporting policies would address annexation issues encompassing levels ofservicesandcoststo taxpayers and would commit the Cityto participation in theMiami-Dade Planners'Technical Committee; •identification and establishment ofjointprocesses with otherlocalagenciesfor collaborative planning onpopulationprojections,schoolsiting,facilities subjectto concurrency and level of services,facilities with countywide significance,and problematic land uses;and •implementation of aprogramtoidentifyandresolveconflictsbetweentheCity's regulations andthelanduseof neighboring jurisdictions.Supporting policies would address notification of neighboringjurisdictionsforanyproposalsthat may impact property within 500feetofapublicschooloradjacentjurisdiction. ContactwithMiami-Dade County PublicSchools confirms thatthatagencyis working with the Cityto clarify someofthe proposed language relating tothe ICE update.Council staffwill continuetocoordinate with theCityandtheschoolboardtohelpresolveany outstanding issues. Staff analysis confirms howeverthatthisamendmentasproposedis compatible with thegoals and policies ofthe SRPP and would notresultinsignificantnegative regional impacts. Proposed Amendment No.3 The proposed amendment tothe Housing ElementtotheCityofSouth Miami Comprehensive Plan hasbeenprocessedin response tothe remedial action recommended inthe 1998 Stipulated Agreement withthe Department of Community Affairs (DCA)by incorporating additional text,a new datatable,and revised objectivesandpoliciesconcerningaffordablehousing. Background: •In February 1997,theCityofSouthMiamiproposedaseriesof amendments tothe ComprehensivePlanthatwere required asaresultofthe 5-year mandatory Evaluation and Appraisal Report (EAR). •Following thesubmissionoftheEARamendments,the Florida DCAissuedanObjection, Recommendations and Comments (ORC)Report statingthatanaffordable housing needs assessmentwasmissing.DCA recommended thattheCity submit an amendment that includesaffordablehousingdataandadditional policies on affordable housing. •In August 1997,theCityadoptedasupplemental package ofEARamendmentsthat included a new Housingobjective(Objective1.3)andseveralpoliciesrelatedto affordable housing. •In October 1997,the DCA issued a Statement of Finding of Non-Compliance on the August 1997submissionfromtheCity.Itwasrecommendedthatremedialactionshould include a measurable targetfor Housing Objective 1.3. •A Stipulated Settlement Agreement between the City and the DCA was approved in April 1998. •In August of 1998,the City was required to confirm its stipulated settlement by amending the Comprehensive Plan document to state that certain studies willbedoneand policies willbe revised.The City Commission adopted Ordinance No.12-98-1660 onAugust4, 1998 thatamendedtheComprehensive Plan andincludedaninterimPolicy 1.3.6 that ._committedtheCityto complete theHousing Data and Analysis,and associated policies and objectives,based upon the Affordable Housing Needs Assessment bythe Shimberg Centerfor Affordable Housing. Proposed amendmentNo.3wouldrevisethetextof Objective 1.3byadding measurable affordable housing targets.Specific targets include the construction of30 affordable housing unitsthroughprogramsand initiatives suchastheCommunityRedevelopmentAgencyand 100 additional unitsaspartofthe proposed Hometown Station project bytheyear 2005.It further projects the construction ofan additional 150unitsof affordable housingthrough various programs/projects by the year2010to achieve a reduction ofthefuture deficit of affordable housing by 25 percent Proposed amendment No.3woulddeletefour policies andaddfivenewpoliciestosupport Objective 1.3.New policies would: •commit theCity's Community Redevelopment Agency(CRA)to implement its New HousingPrograminordertoacquirevacantpropertyandprovidefinancialassistanceto construct atleast24 new affordable housing units; •promoteadditionalincentivesbytheCity'sCRAtoprivate developers toconstruct projects with affordable housing units; •support theeffortsofprivateorganizationstoconstructatleastfiveaffordablehousing units per year; •commit the City andthe County to jointly support development in the Rapid Transit Zone to encourage mixed-use/residential multi-family projects containing affordable housing units;and •commit the City to working with the South FloridaRegional Planning Council tohelp implement aregionalpolicyto address affordable housing needs. Council staff review confirms thatthe amendment as proposed would not create any significant adverseregional impacts andiscompatible with thegoalsandpolicies of the SRPP.Inaddition, the proposed amendment supports regional transportation goalsandpolicies.Councilstaff acknowledges the efforts thatthe City has undertaken toincrease affordable housing opportunities,including working closely with Habitatfor Humanity which has targeted South Miami for construction of new homes for low and moderate-income families.
