No. 34-01-1765ORDINANCE NO.34-01-1765 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA RELATING TO CODE ENFORCEMENT PROCEDURES;AMENDING SECTION 2-25(L)OF CHAPTER 2 THE CODE OF ORDINANCES ENTITLED "SCHEDULE OF FINES";PROVIDING FOR SEVERABILITY,ORDINANCES IN CONFLICT,AND AN EFFECTIVE DATE. WHEREAS,theCityhasreviewedfineschedulesforMiami-DadeCountyandseveral municipalities;and WHEREAS,theCityhasfoundthatfeesfortheCountyandothermunicipalitiesare higherthan those feesincludedintheSouthMiamiSchedule of Fines;and WHEREAS,SouthFloridaBuildingCodewillbesuperceded by thenewFloridaBuildingcode inJanuary1,2002;and WHEREAS,theFloridaBuildingCodedoesnotincludeafineforcommencingworkwithouta permit,whenapermitisrequired. WHEREAS,the administration recommendsan amendment to Section 2-25 (1)of Chapter Two of theCode of OrdinancestoprovideforproperfeesbeingpaidtotheCityforservicesprovided. BACKGROUND AND ANALYSIS Theattached ordinance onfor second reading and public hearing,amends Section 2-25(1)of Chapter 2oftheCodeof Ordinances forthe City of South Miami to provide for proper fees paid totheCityforservicesprovided. The City has reviewed fine schedules for Miami-Dade County and several municipalities.The City has found that fees forthe County and other municipalities are higher than those fees includedintheCity of SouthMiamiSchedule of Fines.ItwasalsodeterminedthattheSouth Florida Building Code will be superceded by the new Florida Building Code in January 1,2002. ThisOrdinanceprovidesfortheincrease of certainfeesandtheaddition of others. RECOMMENDATION Approval is recommended.
