No. 17-01-1748ORDINANCE NO.17-01-1748 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA AMENDING SECTION 4-6 (DEFINITIONS OF ESTABLISHMENTS;HOURS OF OPERATION; DEFINITION OF ALCOHOLIC BEVERAGES)OF THE CODE OF ORDINANCES OF THE CITY OF SOUTH MIAMI,CHANGING THE TIME OF PERMITTED SALE OF ALCOHOLIC BEVERAGES IN RESTAURANTS ON SUNDAY FROM 1:00 PM TO 11:00 AM; PROVIDING FOR SEVERABILITY,ORDINANCES IN CONFLICT, AND AN EFFECTIVE DATE. WHEREAS,Section4-6 of theCityCode of Ordinancesdealswiththehours whenalcoholicbeveragesmaybesoldwithintheCity of SouthMiami;and WHEREAS,inadjacentjurisdictionstheordinancesregulatingsuchactivityare muchless stringent;and WHEREAS,the disparity can have a negative effectupon restaurants in South Miami;and WHEREAS,theCity Commission desirestoeliminatethisdisparity;and NOW,THEREFORE,BEITORDAINEDBYTHE MAYOR ANDCITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section1.Section4-6 of theCode of Ordinances of theCity of SouthMiamiis amended to read: Sec.4-6.Definitions of establishments;hours of operation:definition of alcoholic beverages. (a)Definitions of establishments.[For purposes ofthis section,the words and terms defined inthissubsectionshallhavethe following meanings:] (1)Baror lounge meansa commercial establishment devotedprimarilytothesale of alcoholicbeveragesforconsumptiononthepremises,andwhere entertainment may be provided. (2)Restaurant meansanybuildingorstructureor portion thereof whichserves cooked,fullcoursemealsdailypreparedonthepremises,andwhichcontains servicebarsforon-premisesconsumptiononly. (b)Hours ofoperation.Itshallbeunlawfulfornayperson,corporationorentity orentitylicensedfortheon-premisesconsumption of alcoholicbeveragesto sellor offer forsalesuchalcoholicbeverages,ortobeopenforbusinessafter 5:00a.m.onanydaynorbefore 11:00 a.m.onanydaybutSunday.On Sundays,alllicensed establishments shall notsellorofferforsalesuch beverages before 1:00 p.m.exceptthat restaurants,asdefinedinSection4-6 (a)(2)shallbepermittedtosellorofferforsalesuchbeveragesonSundays beginning at10:00a.m. (c)Alcoholicbeverages defined.Alcoholic beverages asusedinthissectionand throughoutthisCodeshallbedefined as:distilledspiritsandall beverages containing one-half of onepercentormorealcohol by volume. Section2.TheCityManagerisdirectedto prepare suchdocumentsasare necessarypursuanttoMiami-DadeCounty Charter 1.01 (A)(16)(countyisto...approve municipalregulationsonhours of sale of alcoholicbeverages). Section3.If anysection,clause,sentence,orphrase of thisordinanceisforany reasonheldinvalidorunconstitutional by acourt of competent jurisdiction,theholding shall not affect the validity of theremainingportions of thisordinance. Section 4.All ordinancesorparts of ordinancesin conflict with the provisions of thisordinancearerepealed. BACKGROUND AND ANALYSIS CurrentlytheCityprohibitsalcoholsalesin restaurants before 1:00 PMonSunday.This ordinance was enacted in 1958. Therehasbeenaproliferation of indoorandoutdoorrestaurantswithintheCity.Many of these locations offer breakfast andwishtosellalcoholicbeverageswiththesemeals. Ourneighbors,CoralGablesand Miami-Dade County,arelessrestrictiveintheirSunday sales ordinances.Coral Gables allows restaurants tosellas of 7:00AMon Sunday,while Miami-Dade Countyallows 10:00 AMforbeerand 1:00 PMforall other beverages. Theproposedchangewouldaffectrestaurantsonly.Allothersestablishmentswouldstay asprevious.Additionally,pursuanttoMiami-DadeCountyCharter(1.01)(A)(16)any changemustbe presented totheCounty Commission forapproval.
