AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI,FLORIDA RELATING TO BOARDS
AND COMMITTEES;AMENDING ORDINANCE NO.13-01-1744 BY
DECREASING THE COMMISSION FOR SENIOR CITIZENS
MEMBERSHIP FROM 15 TO 9;PROVIDING FOR SEVERABILITY,
ORDINANCES IN CONFLICT,AND AN EFFECTIVE DATE.
WHEREAS,theMayorandCity Commission of the City of SouthMiamiby
Ordinance No.13-01-1744,created a Commission for Senior Citizens to address the
critical needs of the older adults of South Miami;and
WHEREAS,nearlyaquarter of thepopulation of the City of SouthMiamiisover
60yearsold;and while the majority of theseareingood health andare economically
self-sufficient,thereisa significant number in need of special services,but whose needs
are often not identified;and
WHEREAS,the City of SouthMiamihasalready instituted a Senior Center which
providescertainservicestoseniorcitizens,itstillseemsthatthe majority of those
citizens who could benefit fromsuchandotherservicesare not being reached;and
WHEREAS,theMayorandCityCommissiondesiretodecreasethemembership
of the Commission For Senior Citizens from 15 to 9.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.OrdinanceNo.13-01-1744is hereby amended tochangethe
membership from15to.9 members.
(a)Appointmentand qualifications.Members of the Commission shallbeappointed
by theMayor with theadviceandconsent of theCity Commission asprescribedin
the City Charter.Membersshallbeeitheraresident of the City orhavea
principalplace of business intheCity of SouthMiami.Membersshall
demonstrateinterestinor knowledge aboutthestatus of thesenior citizens who
resideinthe City of SouthMiami.Amajority of the members shallbe60years of
age or more.
(b)Terms ofoffice.Inorderthattheterms of office of all members shall not expire at
thesame time,theinitial appointments tothe Commission shallbeasfollows:
eight (8)(5)of the members shallbeappointedfortwoyeartermsandseven (7)
(4)of the members shallbeappointedforthreeyearterms.Thereafter,appointed
members shallservefortwo-yearterms.

(c)Changeinnumber of members.The number of personsservingonthe
"Commission"may beincreasedordecreased by the City Commission basedon
thelevel of participationandneed.Inthe event of achangeinmembers,the
number of members that must bepresentto constitute aquorumforameeting
shallbe half the members plusone.Intheevent of anyincreaseinthenumber of
members,theterms of office shallbeprescribed by the City Commission.
(d)Chairperson,vice-chairperson,secretary.The Chairperson,vice-chairpersonand
secretaryshallbeelected by themembers of the Commission foraterm of one
year.The members may electanyadditional officers that they deemnecessary.
(e)Meetings,expenses.Regularlyscheduledmeetingsshallbeheld monthly atCity
Hallata convenient timetobedecidedbythe Commission members.The
membersmaychangetheplaceandtime of a particular meeting by motionanda
vote of themajority of thememberspresentataregularlyscheduledmeeting.
Regularand special meetings shall be scheduled,andnoticeshallbegiven,as
provided by die CityCode for meetings of theCity Commission;provided
however,thatscheduling special meetingsshallrequirewrittenrequest of a
majority of themembers of the Commission.Minutes shall bekept either by
recordingorinwritten form.Members shall servewithoutcompensation,but
shallbereimbursedfornecessaryandauthorizedexpensesincurredinthe
performance of thework of the Commission.Abudgetmaybe established bythe
CityManagerforthepurpose of fundingexpenses.
(f)Powers and duties.The powers and duties of theCommission shall include,but
notbelimitedto:1)toserveinan advisory capacitytotheMayorandCity
Commission bymaking investigations,studies,reports and recommendations in
respect toall matters pertaining tothe status of senior citizens (ages 60and over)
intheCity of South Miami including butnotlimitedto health,living conditions,
recreation,sources of information,exposuretocrime,general safety,
transportation,availability of employment,and discrimination and responsiveness
of governmenttotheneeds of suchcitizens of SouthMiami;2)tostudy,reporton
andrecommendneededimprovementsintheexistenceanddelivery of servicesto
theelderlysuchashealth,medical,social and recreational services;3)to appear
beforetheMayorandCityCommissiontodeliver reports,recommendations and
requestsfor assistance;and4)to perform suchotherduties,functionsand services
as may berequested by theMayorandCity Commission.
Section2.If any section,clause,sentence,orphrase of thisordinanceisforany
reasonheldinvalidorunconstitutional by acourt of competent jurisdiction,theholding
shallnot affect the validity of theremainingportions of thisordinance.
Section3.All ordinancesorparts of ordinancesin conflict with theprovisions
of thisordinancearerepealed.
Section4.Thisordinanceshalltake effect immediately uponapproval.

The Commission For Senior Citizens was created to address the critical needs of the older adults
