AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH
MIAMI,FLORIDA,RELATING TO THE LAND DEVELOPMENT CODE,SPECIFICALLY
REGULATIONS DEALING WITH PROVISIONS THAT ALLOW FOR THE REDUCTION
OF REQUIRED OFF STREET PARKING BY AMENDING ORDINANCE NO 8-99-1682 IN
ORDER TO CONTINUE FOR AN ADDITIONAL TWELVE (12)MONTHS THE
MODIFICATIONS MADE TO SECTION 20-7.6(B),AND THE SUSPENSION OF SECTION
20-4.4(G)AND SECTION 20-4.4(H)PROVIDING FOR SEVERABILITY,ORDINANCES IN
CONFLICT AND PROVIDING AN EFFECTIVE DATE.
WHEREAS,Sections 20-4.4(G),20-4.4(H)and20-7.6(B)of theSouthMiamiLand Development
Code all allow fora reduction in required off street parking;and
WHEREAS,the impact of theShops of Sunset onthe downtown parking supply has highlighted the
needto reevaluate parking regulations contained withintheSouthMiamiLand Development Code;and
WHEREAS,theCity Commission atits meeting onMay 4,1999,adopted Ordinance No.8-99-1682,
modifying and suspending theLandDevelopmentCodesectionsreferredtoaboveforaperiod of nine
months ;and
WHEREAS,theCityCommissionatseveralsubsequentmeetings,adopted ordinances extendingfor
additionalperiodsthemodificationsandsuspensionsoftheLandDevelopmentCodesectionsreferredto
above;and
WHEREAS,thepurpose of themodificationsandthesuspensionswastoafford staff andcitizensan
adequate timeperiodto reevaluate theCity's parking regulations and propose anynecessarychanges;and
WHEREAS,thenecessaryevaluationandstudiesarenotsufficientlycompletedtodeterminewhat
amendments are needed;and
WHEREAS,theCityCommissionappointedZoningTaskForceisintheprocess of reviewingthe
LandDevelopmentCodeincludingthe Hometown DistrictandtheOff-Streetparkingregulations;and
WHEREAS,itisappropriatetoprovideanadditionaltwelve (12)monthstoevaluateandreviewthe
provisions oftheLand Development Code which allowfor parking reductions;and
WHEREAS,theCityCommissiondesirestoenacttheaforesaidordinance.
NOW,THEREFORE,BEIT ORDAINED BYTHEMAYORANDTHECITY COMMISSION OF
THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.That Section 1 of Ordinance No.8-99-1682,adoptedbytheCity of SouthMiamiCity
Commission onMay4,1999 is hereby amended toreadasfollows:
Section 1:The automatic parking adjustments allowedpursuant to Section 20-7,6(B)ofthe South
MiamiLand Development,entitled "Required Parking,"areherebymodifiedfor aperiodof*
@ty sixty(60)months forthepurpose ofreviewing the effects and appropriateness ofthe
adjustment provisionsonthefuture developments,asfollows:

Section3:Section20-4.4(G),entitled"JointUseSpacesvia Special ParkingPermit,"is
hereby suspendedfor developments within the boundaries ofthe Hometown Districtforaperiod
ofninc (9)sixty(60)months forthepurpose ofevaluatingtheeffectsandappropriateness
ofthisprovisiononfuturedevelopments within theHometownDistrict.
Section4Ifanysection,clause,sentence,orphrase of thisordinanceisforanyreasonheldinvalid
Orunconstitutionalbyacourt of competent jurisdiction,thisholdingshallnotaffectthevalidity of the

hereby repealed.
Section 6 This ordinance shall be effective immediately after the adoption hereof.

BACKGROUND &ANALYSIS
In May 1999,the City Commission adopted Ordinance No.8-99-1682,which modified and
suspendedcertain provisions of theLandDevelopmentCodedealingwithreductionsinoff-street
parkingrequirements.Theordinancewasadoptedinresponsetoconcernsabouttheimpact of
theShops of SunsetPlaceonparkinginthedowntownarea.Itwasfeltthatcertainprovisions,
e.g.,reducedparkingnearMetrorailandreducedparkingbasedupon joint uses,shouldbe
suspended foraperiodofnine months.Inaddition,the ordinance modifiedtheparking
reductionsallowedintheHometownDistrictsothatduringthesamenine-monthperiodonlythe
City Commission couldapproveparkingreductionsforlarge projects.
Attheexpiration of theoriginalnine-monthperiod,theCityCommissionadoptedOrdinanceNo.
11-00-1713 extendingtheperiodforanadditionalninemonths.Severalsubsequentextensions
were adopted bythe City Commission

The purpose ofthe original nine-month period wastoallowtimeforstaffand citizens to
reevaluate theCity'sparking regulations andtomake necessary changes.This evaluation isnot
complete.TheCity's Zoning Task Force isinthe process of reviewing theLand Development
Code including the Hometown District andthe Off-Street Parking section.Itwouldbe
appropriate toallowone more additional period of twelve months (May 2004)to complete the
review andfor considering possible amendments.The attached ordinance amends the original
May 1999 ordinance by extending the modifications and suspensions fora period of sixty (60)
months.
On May20th,2003,theCity Commission approved the ordinance upon first reading.
RECOMMENDATION
Itis recommended thatthe proposed ordinance be adopted uponsecond reading.
