No. 13-03-1797ORDINANCE NO.1 3"03-1 797 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,RELATING TO THE CITY OF SOUTH MIAMI CITY CODE,CREATING SECTION 2-26.10 ENTITLED "PARKING COMMITTEE,"IN ORDER TO CREATE A PARKING COMMITTEE FOR THE CITY OF SOUTH MIAMI;PROVIDING FOR SEVERABILITY;PROVIDING FOR ORDINANCES IN CONFLICT;AND PROVIDING AN EFFECTIVE DATE. WHEREAS,the City's Land Development Code currently contains a provision fora Hometown District Parking Committee;and, WHEREAS,theCity Commission desiresthatsaid committee bebroadenedandexpanded to include the entire city;and WHEREAS,in order toachievethisaim,theCityCodemustbe amended to include reference tothe Parking Committee; NOW,THEREFORE,BEIT ORDAINED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.That Section 2-26.10 entitled "Parking Committee,"of the City Code,is hereby created to read as follows: Sec.2-26.10.Parking Committee (a)Created.There is hereby created a parking committee forthecity.Said committee shall consist of seven (7)private citizens.Theseven(7)private citizens shall include two (2) commercial landowners,two (2)business owners and/or merchants,and three (3)residents of South Miami. (b)Appointment and terms ofmembers.Members of saidcommitteeshallbeappointedbythe mayor with the advice and consent of the city commission to two (2)year terms or until their successor is appointed. (c)Chair,vice-chair,and staff.The members shall elect the chair and vice-chair of the committee.The City Manager or designee shall serve as the executive secretary to this committee. (d)Quorum.A quorum shall be four (4)members and an affirmative vote of a majority of the memberspresentshallberequiredtopassuponanymatterthecommitteerecommends. (e)Duties.Parking in South Miami mustbe developed and managed both asan element of infrastructure critical to enhancing South Miami's tax base through economic success of the City,andasanimportantamenityenhancingandprotectingthequality of lifewithinSouth Page1 of 2 Ord.No.13-03-1797 Miami.To that end,the duties of the board shall be as follows: (1)Meet at least once every three months. (2)To provide oversightofthe supply,convenience,safety,and management of parking. (3)The committee shall report tothecity commission noless than annually on the state of parkinginSouthMiamiandshallfromtimetotimemakerecommendationstothecity commission for changes in the parking system,for the fees paid into the Parking Infrastructure Trust Fund,and for the allocation of trust fund monies. (f)Previous Ordinance.ThisordinanceshallsupersedeandreplaceSection 20-7.6(A)ofthe Land Development Code."Hometown District Parking Committee."The former Hometown District Parking Committee is hereby replaced bv the Parking Committee created by this Ordinance. Section 2.All ordinances orparts of ordinances in conflict withthe provisions of this ordinance are hereby repealed. Section 3.Ifany section,clause,sentence,or phrase of this ordinance isforanyreason held invalid or unconstitutional bya court of competent jurisdiction,this holding shallnotaffect the validity of the remaining portions of this ordinance. Section 4.This ordinance shall be codified and included in the Code of Ordinances. Section 5.This ordinance shalltake effect immediately atthe time of its passage.
