No. 05-03-1789ORDINANCENO.5-03-1789 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,RELATING TO NOISE, AMENDING ARTICLE III,SECTION 15-91,OF THE CODE OF ORDINANCES;CHANGING THE DATE AND TIME WHEN CONSTRUCTION NOISE IS PERMITTED,PROVIDING FOR SEVERABILITY;PROVIDING FOR ORDINANCES IN CONFLICT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS,The Cityhas received numerous complaints about excessive constructionnoiseinthelatehours ofthe evening,and WHEREAS,The noisehascreatedhardshipsas well asa nuisance tothe residentsand immediate neighborhoods,and WHEREAS,It would beappropriateto amend the City Code,Article HI, Section 15-91,"Noise",(PileDrivers,steam shovels,pneumatic hammers,etc),to reducethe time in which thistype ofnoiseispermitted without permission. NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.Article III,Section 15-91,"Noise"of the Code of Ordinances (PileDrivers,steam shovels,pneumatic hammers,etc.),is hereby amended to include the following language: Article III.Noise Section15-91(PileDrivers,steam shovels,pneumatic hammers,etc) Itshallbe unlawful foranypersonin conducting any building operationsonMonday-Saturdays between thehours of 10p.m. 7p.m.and7a.m.,andalldayon Sundays,tooperateoruseany pile-driver,steamshovel,pneumatichammer,derrick,steamor electrichoistorother apparatus,theuse of which isattendedby loudorunusualnoise,except by written permission of theCity Manager,and then only incase of emergency. Section 2.All ordinancesorparts of ordinancesin conflict with the provisions ofthisordinanceareherebyrepealed. Section3.If anysection,clause,sentence,orphrase of thisordinanceis foranyreason held invalid or unconstitutional by a court of competent jurisdiction,this holding shallnot affect the validity of the remaining portions ofthisordinance.
