No. 04-03-1788ORDINANCENO.4-03-1788 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA RELATING TO CODE ENFORCEMENT PROCEDURES;AMENDING SECTION 2-25 (L)OF CHAPTER 2 THE CODE OF ORDINANCES ENTITLED "SCHEDULE OF FINES";PROVIDING FOR SEVERABILITY,ORDINANCES IN CONFLICT,AND AN EFFECTIVE DATE. WHEREAS,the City has reviewed fine schedulesfor Miami-Dade County andseveral municipalities;and WHEREAS,theCityhasfoundthatfeesfortheCountyandother municipalities are higherthanthosefeesincludedintheSouthMiamiSchedule of Fines;and WHEREAS,the City haschangedtheclassI,Zoning Violations toclass IV addingillegalunits. WHEREAS,theadministration recommends an amendment to Section 2-25 (1)of Chapter Two of theCode of Ordinancestoprovideforproperfeesbeingpaidtothe City forservicesprovided. SUMMARY OF REQUEST TheCityadoptedanewsystemforcodeenforcementfinesinAugust1999.Thenewsystem establisheda"courtesynotice"provisionwherehomeownersareprovidedanopportunityto remedyacodeenforcementproblemwithoutpayingafine.Acceptance of andcompliancewith this system has been excellent. DuringtheFY2002-03budgetprocesstheAdministrationperformedanevaluation of recurring revenuesources.Itwasagreedthatcertainfeeswouldrequire adjustment inordertobe comparabletoothermunicipalities. Areview of the City's codeenforcementchargeswarrantedminoradjustments.Specifically,the finesforseveralcategories of seriousviolationsorrepetitious violators are below standard levels. RECOMMENDATION Approvalis recommended. *TheordinancewasadoptedbytheCityCommissiononfirstreadingatitsJanuary7,2003 meeting.
