AN ORDINANCE OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA
RELATING TO SOLID WASTE;AMENDING SECTION 11-21
(C);AND 11-23 (A)OF THE CODE OF ORDINANCES
ENTITLED "EXTENT OF SERVICE AND POINTS OF
COLLECTION"AND "REFUSE COLLECTION FEE
SCHEDULE"RESPECTIVELY,ADDING SPECIAL PICK-UP
SERVICES FOR SPECIAL BULK TRASH;PROVIDING FOR
SEVERABILITY,ORDINANCES IN CONFLICT,AND AN
EFFECTIVE DATE.
WHEREAS,theCity of SouthMiami maintains aPublicWorksDepartmentthatoversees collection
servicesinregardtorefuseandgarbagecollectionintheCity;and;
WHEREAS,theCityCommissionwishestoamendSections 11-21 (c)and 11-23 (a)of Chapter
Eleven oftheCode of Ordinancestoprovideforpick-upservicesforSpecialBulk Trash andfor proper feesbeing
paidtotheCityforservicesprovided.
NOW THEREFORE,beit RESOLVED bythe MAYOR AND CITY COMMISION of the CITY OF
SOUTH MIAMI,FLORIDA:
Section1.That Section 11-21 (c)of Chapter Eleven of theCode of Ordinancesishereby
amended as follows:
Sec.11-21 Extent of Service and Points of Collection.
(c)Otherdomestictrash.Domestic trash that cannotbe containerized or bundled shallbeneatlystacked
orplacedatthecurbinfront of the owner's propertyforspecial mechanized collectionattheconvenience of the
city.Domestictrash exceeding the maximum allowable volume maybepickedupatextracosttotheownerof
thepremisesassetforthinsection 11-23 of thischapter.Pick-upservicesforthe City's PublicWorks
DepartmentshallprovideSpecialBulkTrash.SpecialBulkTrashshallbedefinedasRefrigerator.Stove.Air
Conditioner.Washer.Dryer.Microwaves.Water Heater.Paint cans.Furniture and other Goods designated bv the
City MangerorPublicWorksDirector.PropertyownersandresidentsshallcontactthePublicWorks
Departmenttoarrangeforspecialpick-upservicesbeforeplacingspecialbulktrashat curbside.
(c-0 Propertyownersorresidents of propertyhavetwooptionsforthedisposal of SpecialBulkTrash:
(a)SpecialBulkTrashcanbepickedupthe City atextracosttotheowneror resident of the
property assetforthinsection 11-23 of thischapter.
(b)Property ownerscanusetheservices of a private contractor forthe disposal of suchitems.
However,property ownersorresidents of thepropertyshallnotifyPublicWorksDepartment
of theoptionselectedandPublicWorksDepartmentshallspecifydatetoplacetrashoutfor
private contractors topick-up.

Sec.11-23 Refuse Collection Fee Schedule
(a)Domestic garbage anddomestictrash

Section 2.If anysection,clause,sentence,orphrase of thisordinanceisforanyreasonheldinvalid
or unconstitutional bya court of competent jurisdiction,theholdingshallnot affect thevalidity of theremaining
portions of this ordinance.
Section 3.Allordinancesorparts of ordinancesinconflictwiththeprovisions of thisordinanceare
repealed.
Section4.Thisordinanceshallbecomeeffectiveimmediatelyafteradoptionhereof.

BACKGROUND &ANALYSIS
The attached ordinance is being submitted to establish a Special Bulk Trash pick-up service for
appliances,furniture and other goods prohibited from landfill.To date,the Public Works
Department pick-up appliances and dispose of them weekly at no cost to residents.Last year's
overhead cost for providing the service is estimated as $10,000.00.In an effort to cover the
department's overhead,the attached ordinance (Section 11-23 (a)),if approved,will establish a
$35.00 fee for each Special Bulk Trash.The definition of Special Bulk Trash has been added to
Section 11-21 as:Refrigerator,stove,air conditioner,washer,dryer,microwave,water heater,
paint can,furniture and other goods designated by the City Manager and Public Works Director.
Section 11-21(C)1-b further give residents'option to contact private contractors for pick-up
services.However,property owners or residents must contact Public Works Department to ask
for a date that the Bulk Trash could be placed at curbside for the private contractor to pick-up.
The ordinance was approved on first reading at the January 7,2003 meeting.At that the time,the
Commission requested staff to address regulation concerns brought up during the meeting.Staff
is still reviewing the concerns and will present recommendations to the Commission at a later
date,followed bya comprehensive flyer to the residents.
