AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI,FLORIDA,DECLARING A WEATHER
EMERGENCY PURSUANT TO SECTIONS 14.05 AND 14.12 OF
ORDINANCE NO.11-93-1539;GIVING THE CITY MANAGER THE
NECESSARY AUTHORITY AND DIRECTING HER TO TAKE ALL
NECESSARY AND APPROPRIATE ACTIONS TO PREPARE FOR AND
RESPOND TO HURRICANE KATRINA;PROVIDING FOR
SEVERABILITY,PROVIDING FOR ORDINANCES IN CONFLICT;AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS,pursuant toitsmunicipalhomerulepowersto prepare forand respond to
weatherand other emergencies,theMayorandCity Commission of theCity of SouthMiami
enacted Ordinance no.11-93-1539,entitled "Emergency Management;"and
WHEREAS,the Emergency Management ordinance provides forthe City Manager or
herdesigneetorecommendadeclaration of aweatheremergencypursuanttosections14.05and
14.12,anduponsuchdeclaration,toexercisepowersrelatingtoevacuation;curfewand
designation of restrictedareas;suspensionorregulation of thesale of alcoholicbeverages,
ammunition,firearms,explosivesandcombustibles;prohibitiononpricegouging;wateruse
restrictions;suspension of localbuilding regulations;regulation of theuseandrationing of fuel,
iceand other essential goods;and emergency procurement procedures;and
WHEREAS,HurricaneKatrina,onoraboutAugust25,2005,wasclassifiedasa
categoryIhurricaneandtheState of FloridaremainedunderadeclaredState of Emergency;and
WHEREAS,theMayorandCity Commission believeitisnecessarytodeclareaweather
emergencyandtoorganizeallavailableCityresourcestopreparefor,respondtoandrecover
fromallthreatstothesecurity,safetyandhealth of thepeople of SouthMiami.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,THAT
Section 1.Aweatheremergencyresultingfromthethreat of imminentdamagefrom
Hurricane Katrina is declared to exist as of this date.
Section2.TheCityManagerisauthorizedanddirectedtoexerciseallnecessaryand
appropriate powers under Ordinance no.11-93-1539 to accomplish emergency management
duringtheduration of this emergency.TheCityManagershallreporttotheCommissionatits
nextregularlyscheduledmeeting,unlessaspecialmeetingiscalledearlier,a preliminary
assessment of thedamagecausedbythehurricane,allactionstakeninresponsetothe
emergency,theeffectiveness of theemergencymanagementstructure,theestimatedcost of the
response,furtheractionswhichmayberequired,contractswhichmustbereviewedandratified
by the commission andany emergency budget appropriations which may be requested.

BA CKGROUND AND ANALYSIS
OnAugust25,2005,HurricaneKatrinawasclassifiedasacategoryI hurricane andtheNational
Hurricane Center declaredahurricanewarningfortheentire southeastern coast of theState of
Florida.TheState of FloridawasplacedunderaState of EmergencydeclaredbytheGovernorin
anticipation
TheCity'sEmergencyManagementordinanceprovidesfortheCityManagertorecommenda
declaration of aweatheremergencypursuanttosections14.05and 14.12,anduponsuch
declaration,toexercisepowersrelatingtotheprotection of theCityanditsresidents,including
evacuation;suspension of localbuildingregulations;regulation of theuseandrationing of fuel,
iceandother essential goods;and emergency procurement procedures.
Considering thethreatthatthis hurricane presented totheCityofSouthMiami,theCity Manager
feltitprudenttoexercisethe provisions ofthe Emergency Management ordinance and
recommends that the Commission declare a weather emergency beginning on August 25th,2005.
