No. 27-05-1849ORDINANCE NO.27-05-1 849 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,RELATING TO CREATING SUBSECTION 20-3.6(S)OF THE CITY'S LAND DEVELOPMENT CODE RELATING TO STORAGE OF RECREATIONAL VEHICLES IN ORDER TO FURTHER REGULATE ACCESSORY STORAGE OF SAME; PROVIDING FOR SEVERABILITY,ORDINANCES IN CONFLICT,AND AN EFFECTIVE DATE. WHEREAS,theCity of SouthMiamiLand Development Codedoesnot permit the storage of "camp trailers"orrecreationalvehiclesintherequiredfrontyard setback of properties within thecity;and, WHEREAS,the City has received several reports of recreational vehicles being parked overnightonpublicstreets,beingstoredinthefrontyards of singlefamilyhomes,and being usedforsleepingand dwelling purposes,all of whichdetractsfromtheaestheticharmonyand general orderliness of the City's residentialneighborhoods;and, WHEREAS,after review and consideration,the Planning Board has recommended creating subsection 20-3.6(S)entitled "Accessory Storage of Recreational Vehicles,"to prohibit sleepingin,orthe overnight parking of recreationalvehiclesonpublicstreetsandtoextendthe limitationonstorage of recreationalvehiclesinrequiredfrontyardsetbacks;and, WHEREAS,on July 12,2005,afteraPublic Hearing regarding the proposed amendment toSection20-3.6 of theLand Development Code,thePlanningBoardvoted3ayes2nays recommending denial of the amendment. NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA THAT: Section 1.Section 20-3.6(S)of theLand Development Code of the City of SouthMiami is hereby created and shall read asfollows: *** Sec.20-3.6(S)Accessory Storage of Recreational Vehicles. (1)Definitions. RecreationalVehicle (RV).Shallmeana vehicle self-propelled or capable of being towedandprimarily designed,constructedorconvertedtoprovidetemporarylivingquartersfor camping or recreational travel.Recreational vehicles shall include,but not be limited to.trailers, off road vehicles,trailer coaches,camping trailers,full-tent trailers,motor homes and mini-motor homes.Snort utility vehicles (SUV's^and vans designed for and containing ooating for tho tranoportation of not •more thannine (9)pcroono and containing rear and oidc windows shall not be conoidcrod recreational vehicles.A boat shall not be considered a recreational vehicle as defined and regulated by this section. (a)Norecreationalvehiclesshallbeparkeduponthestreetsorotherpublicplaces of the city between the hours of 7:00 p.m.on one day and 7:00 a.m.of the next day,except as provided below. (b)No recreational vehicles shallbeusedasa place of abode or dwelling while parkedwithinthe city,eitheronpublicorprivateproperty.Exceptionstothis provision maybe madeinthe case of city approved special events,or during acity declared state of emergency. (c)AnRVshallnotbeusedas temporary living quarters and may be parked inthe open, on sites containing a residence,subject to the following conditions: (i)No more than one (1)such RV shall be parked on such site. (ii)Such parking shallbelimitedtosuchRV owned or leased by the occupant-owner or occupant-lessee of thesite concerned.Aguest of the occupant-owner or occupant-lessee of thesite concerned withtheparking of suchRVbyguestshallbelimitedtoa period not to exceed fourteen (14)days. (iii)ThelocationforsuchparkedRVshallbeintherearyardorintheside yard to the rear of a line established by the front building setback line closest to furthcot #eg> the street and to the rear setback building line wherever possible,but in no event in front of such front building setback line.Such RV may be located in the side setback provided that a6 foot high wall,fence or landscaping is installed along the area adjacent to the parked RV shall be setbackfromoido property lincoatadistanceequivalentto the requiredoidc octbaok=i3g theprincipal building andshallbesetbackfromtherear property lineatleastten (10)feet. (iv)The RV parking areashallbe maintained ina clean,neat and presentable manner. (v)The RV shall be in a usable condition at all times and shall,at all times, haveattachedacurrentvehicleregistrationlicenseplate. (vi)No major repairs or overhaul work on such RV shall be made or performedonthe site,(oranyotherworkperformedthereonwhichwould constitute anuisance under existing ordinances). (vii)When parked onthe site,suchRVshallnotbeusedfor living or sleeping quarters,orfor housekeeping orstoragepurposesandshallnothave attached theretoany service connections lines,exceptasmayperiodicallyberequiredtomaintaintheRVandappliances. Page2 of3 Ord.No.27-05-1849 (viii)Such RV shall not exceed the maximum length,width,height and weight permitted under applicable provisions of the motor vehicle laws of the State of Florida;provided, however,the maximum length shall not exceed 4k*ffo4^£)forty (40)feet and the maximum height shall not exceed fifteen (15)feet. (ix)Such RV shall be secured so that it will not be a hazard or menace during high winds or hurricane. (d)A recreational vehicle may not be used as a commercial vehicle as defined by this Code or the City Code. Section 2.If any section,clause,sentence,or phrase of this ordinance isforany reasonheldinvalidor unconstitutional byacourt of competent jurisdiction,theholdingshallnot affectthe validity of the remaining portions of this ordinance. Section 3.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are repealed. Section 4.This ordinance shall be codified and included in the Code of Ordinances. BACKGROUND For many yearstheCityhas received reports and complaints that recreational vehicles arebeing parked overnight on public streets,being stored inthe front yards of single family homes,andbeingusedfor sleeping and dwelling purposes,allof which detracts from the aesthetic harmony and general orderliness of the City's residential neighborhoods. TheCity'sLand Development Code (Sec.20-3.6L)currently prohibits the storage of"camp trailers"in frontyard setback areas.Asidefromthis regulation therearenootherprovisionsrelatedtothe storage, streetparkingorlivinginarecreationalvehicle. Baseduponarecentcode enforcement issue related to recreational vehicles,theCity Commission requested theCity Attorney andthe Planning Department toprepareandprocessthe necessary legislationtorespondtotheseconcerns. LEGISLATIVE HISTORY In 2001 a proposed ordinance wasdraftedthat provided regulations forstorage of boats,trailersand recreational vehicles.InApril,2005thePlanningBoardconductedapublichearingonthedraft legislation.Anumberofresidentspresent,whowereboatowners,expressedconcernaboutthe proposed amendment andhowitwouldimpact them.The proposed legislationwasthen deferred bythe Board andthe City Commission. PROPOSED LEGISLATION(2005) Thecurrentproposedlegislationprovidesregulationsforthestorageandparking of recreational vehiclesonly.Thefollowingisa summary of theproposedregulations: Recreational vehicles are defined; LDC Amendment RV's August16,2005 Page 2 of3 •Prohibits overnight parking of recreational vehicles on streets or other public places; •Allows recreational vehicles tobe parked on sites containing a residence; •Requires recreational vehicles to have a current vehicle registration license plate; •Prohibits sleeping inor living in a recreational vehicle at any location in the City;* •Prohibits recreational vehicles from being parked or stored in the area forward of the front building line,inthe side setback area,or within 10 feet of the rear property line; •Provides specific restrictions onthe maximum size ofa parked recreational vehicle. STAFF OBSERVATIONS (1)The concerns expressed are issues that clearly affect quality of life within typical South Miami residential neighborhoods.Generally,theCity's residential neighborhoods consist of small and moderate size lots with minimal distances between homes and primarily facing two-lane streets.The parking of large recreational vehicles in the front yards of homes and on the street is visually unattractive,impedes traffic and contributes toa sense of overcrowding.A number of municipalities have adopted strict Land Development Code regulations concerning the parking and storage of recreational vehicles. (2)The proposed regulations are similar to those now in effect for unincorporated Miami-Dade. (3)It is important to note that certain property owners may be burdened by the ordinance,if they own recreational vehicles that they currently store in the front,side,or rear yard setbacks.The Board may wish to allow a "grandfather"provision,whereby recreational vehicle owners may apply for a temporary non-conforming statusduringthetimeperiodafterthe ordinance isenactedandthetimeownerscan complywiththenewregulations. PLANNING BOARD ACTION The Planning Board at its July 12,2005 meeting adopted a motion by a vote of3 ayes 2 nays recommendingdenial of theproposedRV regulations. CITY COMMISSION ACTION The City Commission at its first reading of the ordinance on July 26,2005 deferred action and suggested thatcertain sections ofthedraft legislation be revised.This included a clarification ofthe definition of a recreational vehicle.In addition the Administration's revision to subparagraph (iii)(p.2)on parking in the side setback is also included in the attached revised ordinance which shows new wording in bold and wording tobe removed in strikethrough.In order to respond to concerns related to "commercial vehicles"the Planning Department will prepare an amendment (separate ordinance)to the Land Development Codewhichwillclarifythecurrent definition ofthatterm. RECOMMENDATION The Administration is supportive of the need to provide regulations to guide parking and storage of recreational vehicles.Although the Planning Board recommended denial it appears from their minutes that several Board members wanted to adjust some of the proposed parking restrictions in order to respondtoconcernsexpressed. LDC Amendment RV's August16,2005 Page 3 of3 The Administration is proposmg that the setback limitations set forth in Sec.20-3.6(S)2(c)(iii)on p.2,be revised to read: (iii)The location for such parked RV shall beintherear yard orintheside yardtotherearofaline established bythe front building line closestto furthest #fes%the street and set back tothe rear building line wherever possible,butinno eventinfront of suchfrontbuildingline.SuchRV may belocatedin the side setback provided that a6 foot high wall,fence or landscaping is installed along the area adjacent tothe parked RV ohall be setback from nidc property linco ata distance equivalent to the required side setback for the principal building and shall beset back from the rear property line at least ten (10)feet. Speakers: NAME ADDRESS SUPPORT/OPPOSE CalRosenbaum 6101 Sunset Drive.Supported Mr.Rosenbaum agreed with the Planning Director.In addition,he suggested an amendment that would provide in the event ofa major catastrophe individuals may live in their RV's,if they obtain a temporary permit. Sheila Gabley Opposed Ms.Gabley stated she does not own an RV nor intends to buy one,however,she does not see RVs as a problem as long as the owner keeps the RV safely on their property.In addition,Ms.Gabley opposed the legislation becauseshedidnotthink it was needed. Edna K.Davis Opposed Ms.Davis opposed the legislation because she believed it would createaburden particularly with the rule that refers to the specific location and the required setbacks.In order to comply with the regulations she would need to pay a monthly fee to have the RV stored elsewhere or change the way my property is constructed. Bob Welch Opposed Mr.Welch stated that the amount of RV owners in the City is only 15.He also disagreed with the legislation because it regulated the RV's like the City regulates the building of ahouse. CarlForbis 6474 Manor Lane Opposed Mr.Forbis indicated he drove around the City in preparation for this topic and he counted only 11 RV in the City.He opposes the legislation completely. Ernie Lara Opposed Mr.LarastatedhehashadhisRVin the City since 1977 andhehadneverhada problem until recently when his neighbor called Code Enforcement.He complied with the citation with regards to the RV and does not agree with the legislation. Joe Salas 5958 SW 58 Terr Opposed Mr.Salas stated he has lived in the City for a number of years and heis satisfied with the City's regulations however,he opposes completely this legislation. Mr.Morton closedthepublic hearing. PlanningBoardMeeting July 7,2005 Page 4 of4 Board member Mr.Mann expressed concern over the fact that this legislation is picking one type of recreational vehicle over others.In addition,he commented that he believes that boat and RV regulation should be equal.He also stressed that the side and rear setbacks will create a hardship to the RV owners especially since some lots are small.Board member,Ms.Yates agreed with Mr.Mann inthatthe legislation signals outRV owners only.Furthermore,Ms.Yates indicated that either the regulation restricts everything equal orjustto leave the RVs alone. Mr.Mortonre-openedthepublic hearing. Ernie Lara Opposed Mr.Lara clarified to the Board the situation of his RV with the signage on it. CalRosenbaum 6101SunsetDrive.Neutral Mr.Rosenbaum indicated thatthe number of RV owners thathavebeen counted represent farless than ahalfofone percent ofthe population of South Miami.He also suggested that the Board inform the Commission they have reviewed the legislation but make no recommendation. Motion:Mr.Illasmovedtodenythe legislation.Noone seconded the motion. The motion died for lack of a second. Motion:Mr.Mannmadea motion to send this legislation backtothe Commission and letting them decide since they have directinput from the community.His comment tothe Commission wasthat they shouldmakethesidesetbackbetothe property line,and that all owners of RVs,boats,and other vehicles all have equal treatment.No one seconded the motion Discussion resumed in regards tothe motion onthe floor.Some Board members were confused about Mr.Mann's motion.Mr.O'Donniley clarified the motion at Mr.Morton's request by stating that perhaps the Commission needed to further study the legislation as drafted and address the hardships ofthe setbacks.In addition,Mr.Mann indicated he would not recommend approval of the legislation as written;however,he believed the legislation needed some tweaking made by the Commission specifically eliminating the side setback and consider incorporating a grandfatherclauseoption. At this point Mr.Mann withdrew his previous motion. Motion:Mr.Mann made a motion to deny the RV regulation as submitted. Mr.Illas seconded the motion.
