ORDINANCE NO.08-04-1815 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,AMENDING ORDINANCE NO.15-02-1783 RELATING TO BOARDS AND COMMITTEES;AMENDING SEC.2-26.8 OF THE CODE OF ORDINANCES,ENTITILED "BUDGET AND FINANCE COMMITTEE; AMENDING MEMBERSHIP REQUIREMENTS;AMENDING DUTIES AND RESPONSIBILITIES;PROVIDING FOR SEVERABILITY;PROVIDING FOR ORDINANCES IN CONFLICT;AND PROVIDING AN EFFECTIVE DATE WHEREAS,theCity of SouthMiamirecognizesthatakeyfunction of governmentissoundfiscal management and careful budget preparation inordertobeableto provide ahighlevel of municipal services toits residents and businesses;and WHEREAS,the preparation of the City's budgetisahighly specialized area of endeavor requiring expertise and/or experience which is normally limitedto professionals within thefinancial management, accounting,auditing and municipal management fields;and WHEREAS,The City Commission recognizes itsdutyto provide sound oversight for adoption of anannual budget and of appointed staffs'administration of city operations,and; WHEREAS,TheCityCommissionbenefitsfromexpertcounsel,independent of appointedstaff, in providing said oversight,and; WHEREAS,The City Commission alsorecognizesthelawful non-interference provisions of the City Charter and the City Manager's contract. NOW,THERFORE,BE IT ORDAINED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA THAT: Section 1 TheCity of SouthMiamiCode of OrdinancesSection2-26.8 entitled "Budget and Finance Committee,"is amended to read as follows: (Note:New wording inbold-underlined;wordingtoberemoved indicated by strike-through) Sec.2-26.8.Budget and Finance Committee. (a)Name.ThereisherebycreatedaBudgetandFinanceCommittee.The committee shallconsist of at lca3t five and no more than five nine members. (b)Purpose.Thepurpose of thecommitteeistoprovideadviceand recommendations totheCity Commission Mayor and City Commission andto administration regarding the adoption and implementation of financiallysoundannualbudgetsandinvestmentpolicies.To accomplish thispurpose, the committee is charged withreviewingandevaluatingthedraft proposed budget,the City's investments,employee pension andotherretirementaccountsrevenueandexpendituresonatleasta quarterly baoio,examining ways to preserve existing revenue sources and exploring additional funding sources;overseeing department performance reviews,giving advice tothe City Commission eity commission and the administration on projected earnings of investments and desirable or necessary further investments,revenue,expenditures revenue,expendituresand strategic planning (which includes analyzing existing service levels and determining sufficiency and appropriateness').changes tothetypes and levels of government services provided bytheCity,and making recommendations regarding the proposed millagc rateandthe annual budget forensuingfiscal ycara.The Committee shallalsoreviewthe annual comprehensive audit report. Orel.Amending Budget Committee Sec.2-26.8Code of Ordinances 1 Ord.No.08-04-1815 (c)Membership,terms.Members ofthe committee shall be appointed bythe Mayor as provided for bytheCity Charter.The Mayor and City Commission shall attempt to include representatives of the local business community,residents;and accounting and finance experts,4and employees or representatives of cityemployees'collective bargaining groups inthe membership of the committee.The initial appointments tothe committee shall be for a term that expires on September 30,2005.Thereafter, appointments shall be staggered for terms of one,two and three years.Appointments to fill any vacancy onthe committee willbe for the unexpired term.Onememberofthecity commission andTheCity Manageror designee mayserveasnonvotingan ex officio members of thecommittee. (d)Meetings,quorum.Regularly scheduled meetings shall beheldat least quarterly atcityhallata convenienttimetobedecidedbythecommittee members.Themembersmay change theplaceandtime of a particular meetingbymotionandavote of the majority of members present ata regularly scheduled meeting.Amajority of themembersingood standing shallconstituteaquorumnecessarytohold meetingsandtakeaction.Additionalspecialmeetingsmaybescheduledandnoticeshallbegiven,as providedinthecitycodeforspecialmeetings of thecitycommission;provided,however,thatscheduling special meetings shallrequirethevoteorwrittenrequest of amajority of themembers.The committee shallappointa chairperson andavice chairperson.The chairperson shallconductallmeetings.Inthe absence of the chairperson,thevice chairperson shall conductthemeeting.Allmeetingsshallbeproperly noticed,opentothepublicandminutesshallbekepteitherbyrecording or-and inwrittenform. Members shallserve without compensation. (e)Administrative assistance.TheCity Manager ordesigneeshallprovidethecommittee members with copies of quarterlyandannual financial reportsforthegeneralbudgetandretirement accounts as soon as they areavailable following theclose of thequarterandthefiscalyear.The annual auditreportshallbeprovidedto committee memberswithin15days of deliverytothe City by the independent auditors.Ledgersandotheraccount reports shallbeprovideduponrequestbythecommittee. The andthe proposed budget shallbe delivered tothe committee members notlaterthanthedate it-is thev are delivered tothecity commissioners.The Committee's reasonablerequestsforledgersandother account reportsshallbemadetothe City Manageror designee andshallbe provided tothe Committee in a timely manner.The City Managerordesigneeshallprovideassistancetothe committee,provided that all requests are submitted in writing.Should the City Managerfindany Committee request for information orassistanceunreasonableordisruptivetothenormaloperations of theCity,the City Manager may deny therequest,providing tothe Committee written groundsforthedenial.The Committee may,upon a majority vote,appealthe City Manager's denialtothe City Commission...t-»« performing department reviews. (f)Reports.The committee shallprepareareport of its budget andfinance review tothe City Commission ator before thefirstpublichearingin accordance with subparagraph Kb),its projected anticipatedvariationsto revenue andexpenditures,if any,it3department performance reviews and suggested changes,if any,to the type,levelandfrequency of services,staff andcapitalnccd3,cost of services and administrative structure,anditshall notify the city commission accordingly.The committee shallpresentareporttothecity commission atleastquarterly,andmoreoften if itforecastssignificant variations in anticipated revenue and expenditures.Additionally,the committee shallpresent the first departmentperformancereviewwithinthreemonths of enactment of thisordinance,andthenquarterly reviewsforadditionaldepartmentsuntilalldepartmentshavebeen reviewed by the committee,after which further reviews shall be conducted atthedirection of thecity commission. (g)Sunshine laws.All meetings of the committee and of anytwoormorepersonsappointedto thecommitteearesubjecttothe Florida SunshineLaw requirements fornoticeandpublicmeeting.All documents,includingemailcommunications,prepared bythe committee ora committee memberare public records. (g)Sunshine laws.All meetings of the committee and of any twoor more persons appointed tothe committee are subject tothe Florida Sunshine Law requirements for notice and public meeting.All documents,including email communications,prepared bythe committee or acommitteememberarepublic records. Section2.Ordinance No.29-01-1760,creating Section2-26.8 of thecode of ordinances,entitled "Budget Review Committee"is repealed.Acopy of the repealed ordinance is attached to this ordinance as exhibit "1."
