An Ordinance amending the City of South Miami Land Development Code Section
20-7.12 Permitted Uses;(A).Storefront Uses within the Hometown District Overlay,
to amend its title and to reference special use status and requirements for schools.
WHEREAS,onJanuary 18,2011 theCityCommissionapprovedOrdinanceNo.05-11-
2078,amendingSection 20-3.3(D)PermittedUseSchedulechangingtheusecategoryfor
schoolsfroma permitted use,toaspecialusereview;and
WHEREAS,Ordinance No.05-11-2078 also amended Section 20.3.4 Special Use
Conditions,providing specific requirements forthereviewandapproval of schoolfacilities;and
WHEREAS,schools are permitted withintheSR-Specialty Retail zoning district
following a special use review and approval;and
WHEREAS,Section 20-7.12(A)of the Hometown District Overlay permits schools asa
storefront use,butdoesnot reference the provisions adopted by Ordinance No.05-11-2078;and
WHEREAS,Section 20-7.2 (B)provides that if there isa conflict between any of the
provisions of Article 7andany other requirement of the Land Development Code then the
provisions of Article 7 shall take precedence and control;and
WHEREAS,itis the Administration'sintent to correct the inconsistency between both
land development code sections andthen proposed amendment would provide the reference to
the requirements of Ordinance No.05-11-2078.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.Section 20-7.12 of theCity of South Miami Land Development Codeis
hereby amended to read as follows:
"20-7.12 Permitted and Special Uitses-andParking Requirements.
Theuses below are applicable to both new and existing buildings inthe
Hometown District:

Outdoor dining is permitted ofrightin special pre-approved areas(see Regulating Plan).
Inadditiontotheusesabove,monumentalcivicbuildingusesareencouragedinthe
Hometown Districtandin particular forcertain strategically locatedsites.Civicbuilding
usesshallinclude,forexample:City,county,state,orfederalbuildings,includinglibrary,
postoffice,meetinghall,administrative offices,performanceplace,policesubstation,
and similar uses.

Section 2.Codification.Theprovisions of thisordinanceshallbecomeandbemade
part of theCode of Ordinances of theCity of SouthMiamiasamended;thatthesections of this
ordinancemaybe renumbered orre-letteredtoaccomplishsuchintention;andthattheword
"ordinance"may be changed to "section"or other appropriate word.
Section 3.Severability.If anysection,clause,sentence,or phrase of thisordinanceis
forany reason held invalid or unconstitutional byacourt of competent jurisdiction,this holding
shallnot affect the validity of the remaining portions of this ordinance.
Section 4.Ordinances in Conflict.All ordinances orparts of ordinances andall
sections and parts of sections of ordinances in direct conflict herewith are hereby repealed.
However,itis not the intent of this section to repeal entire ordinances,or parts of ordinances,
that givethe appearance of being in conflict when the two ordinances can be harmonized or
when only a portion of the ordinance in conflict needs tobe repealed to harmonize the
ordinances.If the ordinance in conflict canbe harmonized by amending its terms,itis hereby
amended to harmonize thetwo ordinances.Therefore,onlythat portion that needs tobe repealed
to harmonize thetwo ordinances shallbe repealed.

Background:
Arecent review of the land development code evidenced ascrivenerserror between
Ordinance No.05-11-2078,adoptedbythe City Commission in January 2011,and the
Hometown Overlay District Section 20-7.12 Permitted Uses.
Ordinance No.05-11-2078 amendedthepermitteduseschedule Section 20-3.3(D),
changing theuse category for schools from apermitteduse,toause review.The
amendment also provided specific requirements for the review and approval ofa
school facility.Schools are permitted within the SR -Specialty Retail zoning use district
following special usereviewand approval bytheCity Commission.
Section 20-7.121 (A)ofthe Specialty Retail -Hometown District Overlay also permits
schools as a "storefront use",but did not reference the provisions adopted by
OrdinanceNo.05-11-2078.Thisproposed amendment will makebothcodesections
consistent with the adopted review process.
Recommendation:
It is recommended thatthe Commission approve the proposed amendmentto Section
20-7.12of the land development code.
