ORDINANCE NO.16-14-2194 An Ordinance amending the City of South Miami's Code of Ordinances Chapter 5,Article 1,Section5-1to refine the City's designation asa wildlife sanctuary. WHEREAS,widespread application of general insecticides killsall arthropods, including pollinators suchas bees,moths,and butterflies,and predators suchas lacewings, dragonflies,ladybird beetles,and spiders that serve as biological controls forpest species and whichreproducemuchmoreslowlythantheirprey, WHEREAS,newresearchconductedatFloridaInternationalUniversityontoxicityof the sprayed insecticides usedlocallyfor mosquito control hasshownthese substances aredeadly tobutterflieswhenusedattheconcentrationsappliedformosquitocontrol;and WHEREAS,widespreadapplication of insecticidestocontrolinsectpestsisultimately ineffective becauseoftherapid of evolutionof insecticide resistancein fast-reproducing invasive speciessuchasthemosquito Aedes egypti,andbecauseanyadultblacksaltmarsh mosquitoes killedbyinsecticidesarereplacedbynewlyemergedadultsthenextday;and WHEREAS,thelargestbatinNorthAmerica,Floridabonnetedbat {Eumops floridanus),residesinSouthMiamiandis federally listedasanendangeredspeciesbecauseof populationdeclinesduetoinsecticidespraying;and WHEREAS,theSchausswallowtailbutterfly (Papilioaristodemus)was exterminated fromtheFloridaKeysbyinsecticidesprayingtocontrolmosquitoes;and WHEREAS,the Florida atala butterfly {Eumaeus atala florida)was believed tobe extinctuntilafewwere discovered on Virginia Keyand reintroduced into suburban areas, includingSouthMiami,whereresidentsplantthenativecoontiecycad;and WHEREAS,themonarchbutterfly {Danausplexippus),commoninSouthMiami,has beennearly eliminated overNorthAmericabyuseof pesticides andissurvivingonly because of sedentary populations in South Florida;and WHEREAS,South Miami's suburbanareas inhabited bythe Florida bonnetedbat {Eumops floridanus),Floridaatala butterfly {Eumaeus atalaflorida),andthe monarch butterfly {Danaus plexippus),all of whichareharmedbyapplication of insecticides;and WHEREAS,publiclands designated as "environmentally sensitive"maybe exempted underF.S.388.4111 from wholesale application of insecticide bymosquitocontrol districts. NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Page 1 of3 Ord.No.16-14-2194 Section 1.Chapter5,Article1,Section5-1 of theCity of South Miami's Code of Ordinances shall be amended to read as follows: Sec.5-1.City declared Iwdy-wild fowl andawildlife sanctuary. (a)The territory embracing the corporate limits of tho cityis hereby declared to beabird,wild fowl,and wildlife sanctuary,anditshallbeunlawfultoany person or persons to harass,wound,trap or kill any bird(s),wildfowlorwildlifewithin the territorial limitsof tho city. For the purpose of this ordinance "wildlife"shall be defined as all native birds,mammals,reptiles,and amphibians,and all animal species otherwise protected by federal,state,or county law. (ab)The definition ofwildlife shall be as follows:Allwild or nondomostic birds, mammals,fur bearing animals,reptiles and amphibians. The territory embracing the corporate limits of the city is hereby declared to be a wildlife sanctuary and designated as "environmentally sensitive". (cl Removal.That wildlife,as determined by the city manager as life threatening,can be humanely trapped by certified private sector animal control specialists for safe removal toa suitable location. It shall be unlawful to afw person or persons to harass,wound,poison, capture,or kill wildlife within the territorial limits of the city,except as part of a scientific study by individuals with appropriate federal and/or state licenses and approval of the city manager. (d) It shall be unlawful to introduce into the public airspace broad-spectrum insecticides or biocides within the territorial limits of the city that may harm wildlife,the natural food supply for wildlife,pollinators,or natural biological control species. Removal.Wildlife,not otherwise protected by federal or state law,that create a significant threat to the health and/or safety of persons or other animals,as determined by the city manager,can be humanely trapped by state certified animal control specialists for relocation. Section 2:Codification.The provisions of this ordinance shall become andbe made part of theCode of Ordinances of theCity of SouthMiamias amended;thatthe sections of this ordinancemayberenumberedorre-letteredtoaccomplishsuchintention;andthattheword "ordinance"maybechangedto"section"orotherappropriateword. Section3.Severability.Ifanysection,clause,sentence,orphrase of thisordinanceis forany reason held invalid or unconstitutional bya court of competent jurisdiction,this holding shallnotaffectthevalidity of theremainingportions of thisordinance. Section4.Ordinances in Conflict.Allordinancesorparts of ordinancesandall sections andpartsof sections of ordinances in direct conflict herewith are hereby repealed. However,itisnotthe intent ofthis section to repeal entire ordinances,orpartsof ordinances, (e§) Page 2 of3 Ord.No.16-14-2194 thatgive the appearance of being in conflict when thetwo ordinances can be harmonized or whenonlya portion of the ordinance in conflict needstobe repealed to harmonize the ordinances.If the ordinance inconflictcanbe harmonized by amending itsterms,itishereby amendedtoharmonizethetwoordinances.Therefore,onlythatportionthatneedstoberepealed to harmonize thetwo ordinances shallberepealed. Section5.Effective Date.Thisordinanceshallbecome effective upon enactment. PASSED AND ENACTED this 22^day of July,2014.
