A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI,FLORIDA,GRANTING
VARIANCES TO ALLOW TWO BUILDING SITES ON TWO
PREVIOUSLY PLATTED LOTS WHICH ARE LESS IN AREA THAN
THAT REQUIRED BY RS-4 DISTRICT REGULATIONS AND
WOULD CREATE TWO NONCONFORMING LOTS WHERE PRESENTLY
ONE SINGLE-FAMILY RESIDENCE IS EXISTING ON A SINGLE
BUILDING SITE;TO ALLOW A BUILDING SITE WITH A
FRONTAGE OF 55.26 FEET ON LOT 1 WHERE PRESENTLY ONE
SINGLE-FAMILY RESIDENCE IS EXISTING ON A SINGLE
BUILDING SITE WHICH CONTAINS TWO PREVIOUSLY PLATTED
LOTS;TO ALLOW A BUILDING SITE WITH A FRONTAGE OF
51 FEET ON LOT 2 WHERE PRESENTLY ONE SINGLE-FAMILY
RESIDENCE IS EXISTING ON A SINGLE BUILDING SITE
WHICH CONTAINS TWO PREVIOUSLY PLATTED LOTS;TO
ALLOW A LOT OF 5526 SQUARE FEET IN AREA WHERE 6000
SQUARE FEET IS REQUIRED;TO ALLOW A LOT OF 5100
SQUARE FEET IN AREA WHERE 6000 SQUARE FEET IS
REQUIRED;TO DENY A REAR SETBACK OF 18 FEET 1 INCH
WHERE 25 FEET IS REQUIRED ON LOT 1;TO DENY A SIDE
SETBACK OF 14 FEET 5 INCH WHERE 15 FEET IS
REQUIRED ON LOT 1;TO DENY LOT COVERAGE OF 34
PERCENT WHERE ONLY 30 PERCENT IS ALLOWED ON LOT 1;
TO DENY A REAR SETBACK OF 18 FEET 1 INCH WHERE 25
FEET IS REQUIRED ON LOT 2;AND TO DENY LOT COVERAGE
OF 37 PERCENT WHERE ONLY 30 PERCENT IS ALLOWED ON
LOT 2,ON PROPERTY LEGALLY DESCRIBED AS LOTS 1 AND
2,BLOCK 3 OF BIRD ROAD ESTATES,AS RECORDED AT
PLAT BOOK 19,PAGE 76,OF THE PUBLIC RECORDS OF
DADE COUNTY,FLORIDA,A/K/A 6302 SOUTHWEST 41ST
STREET,SOUTH MIAMI,FLORIDA.

WHEREAS,the applicant has requested ten variances
regarding hispropertyat6302 Southwest 41stStreetandthestaff
recommendation is for denial;and
WHEREAS,ata public hearing on November 28,1989,the
PlanningBoardvoted5-1tograntthefirstfivevariancerequests
listed below and to deny thelastfive requests listed below.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.That a variance to allow two building sites on
twopreviouslyplattedlotswhicharelessinareathanthat
required byRS-4 district regulations and would create two
nonconforming lotswhere presently one single-family residence is
existingonasinglebuildingsiteonpropertylegallydescribed
as:
Lots 1 &2,Block 3,BIRD ROAD ESTATES,as
recorded in Plat Book 19-76 of the Public Record of
Dade County,Florida
is hereby granted.
Section 2.That a variance to allow a building site with a
frontage of 55.26 feet on Lot 1 where presently one single-family
residence is existing on a single building site which contains two
previously platted lotsonthe property legally described above
is hereby granted.
Section 3.That a variance to allow a building site with a
frontage of51feetonLot2where presently one singe-family
residence is existing ona single building site which contains two
previouslyplattedlotsonthepropertylegally described above
is hereby granted.
Section 4.That a variance to allow a lot of 5526 square
feetin area where 6000 square feetis required on the property
legally described above is hereby granted.
Section 5.That a variance to allow a lot of 5100 square
feetin area where 6000 square feetis required onthe property
legally described above is hereby granted.
Section 6.That a variance for a rear set back of 18 feet
1inchwhere25feetis required onLot1onthe property legally
described above is hereby denied.
Section 7.That a variance for a side setback of 14 feet 5
inches where 15 feet is required onLot1on the property legally
described above is hereby denied.
Section 8.That a variance for lot coverage of 34%where
only30%is allowed onLot1onthe property legally described
above is hereby denied.
Section 9.That a variance for a rear setback of 18 feet 1
inch where 25 feet is required on Lot 2 on the property legally
described above is hereby denied.
Section 10.That a variance for lot coverage of 37%where
where only30%isallowedonLot2ontheproperty legally
described above is hereby denied.
