RESOLUTION NO.163-14-1 4257 A Resolution amending a Special Use Approval to permit a public car wash at 5795 South Dixie Highway,within the TODD Light Industrial "TODD-LI4"zoning use district. WHEREAS,pursuanttoSection 20-3.3(D)andSection 20-3.4(A)of theLandDevelopment Code(LDC),AutoBodyExpertsUSA,LLChassubmittedPlanningBoardApplicationNo.PB-14-007 requestingamodificationtoapreviousSpecialUse Approval tooperateacarwashopentothepublic,at 5795S.Dixie Highway locatedinthe "TODD(LI-4)Zoning District.";and WHEREAS,on January 6,2009,theCity Commission approved a special useto operate an automotiverepairandbodyshop,withacarwashasanaccessoryuseat5795SouthDixieHighwayby Resolution No.05-09-12814;and WHEREAS,thehand carwash wasapprovedforthe washing of vehicles beingrepairedatthe facility only;and WHEREAS,the applicant proposedtocontinuethisuse,butwouldliketoopenthehand carwash service tothe general public,necessitating an amendment tothe previous approval;and WHEREAS,a carwash is allowed inthe "TODD(LI-4)Zoning District."asa special use subject tomeetinggeneralconditionsspecifiedinLDCSection20-5.8andsubjecttomeetingspecial requirements setforthinLDCSection 20-3.4(B)(10)asamendedby Ordinance #15-14-2193;and WHEREAS,the approval of a special use requires a recommendation fromthe Planning Board andthe approval of the City Commission after a public hearing;and WHEREAS,atits June 10,2014 meeting the Planning Board,after public hearing,voted 6ayes 0naysto recommend approval with staffs conditions of thespecialuse Application No.PB-14-007;and WHEREAS,the Mayor andCity Commission of theCity of SouthMiami desire to accept the recommendation of the Planning Board. Staff Analysis: LocatedintheTODD (LI-4)zoning district,theuseoftheproposedautomobilecarwash isausethatispermittedinthedistrictviaspecialuseapproval.Asshownontheattached site plan,two(2)carwashbaysandtwo (2)lift centers under an unenclosed canopy structure are located towards the center oftheproperty.Considered tobe accessories to themain automotive repairuse,amodificationtothe2009specialuseapprovalwould allowthecarwashfacilitytobeopentothegeneralpublic,nolongermakingitan accessory use. Inanticipationto opening thecarwashservicetothepublic,the applicant has obtained approvalfromthe Miami-Dade CountyWaterandSewer Department fortheoperationof theexistingcarwashfacility.Itisimportanttonotethattheexistingandfacilityutilizes handwashing techniques only,andwillnotbean automated drivethru.Furthermore,no expansionofthecarwaswashserviceisbeingproposedwiththis application. AsshowninFigure1,the owner liststheentirepropertyas5795 S.DixieHighway,where thePropertyAppraisershowsthatthepropertyisdividedintotwo (2)individuallots,5795 SouthDixie Highway,and5786 Progress Road,withtheproposedcarwashbeinglocated ontheformerproperty. Conclusion: After review of the proposed amendment,it was found that the requested special use complies with the LDC requirements set forth for special uses in Section 20-3.4andthe proposeduse meets the conditional requirements set forth in Section 20-5.8inthatthe use: a)Will not adversely affect the health or safety of persons residing or working in the vicinityofthe proposed use, b)Will notbe detrimental to the public welfare or property or improvements in the neighborhood;and, c)Complies withallotherapplicableCode provisions. WHEREAS,Section 20-3.4 (B)(10)sets forth the conditions for "AUTO WASH OPERATIONS"andsubsection(a)requires that all suchuses "shall beconductedina fully enclosed structure";and WHEREAS,the condition requiring a fully enclosedstructurepreventstheuseof automated and un-automated car washing operations in the City ofSouth Miami,in spiteofthe factthattheCityhasauthorizedsuchusesinthepast;and WHEREAS,thecurrentautomated operations inthe City areconductedinstructures that only havethreesides with an opening at both endsto allow vehicles tobe driven or pulled through the washing operation;and WHEREAS,anautomatedcarwashhas mechanical partsandthereisa rational basis forrequiringthatitbecontained within astructureandthatitbelocatedat least 100 feetfroma residential district duetothe noise generated by such operations;however,a hand car washing operation doesnotcreateany significant noiseandtheredoesnotappeartobea rational basis torequire such operations tobe contained withina structure or restricted toa set distance from a residential district;and WHEREAS,an automated car wash usually has vehicles stacked up waiting toenterthe car wash structure;whereas,a hand car washing operation does not require such an assembly line for its operation since vehicle do not need to enter and travel through aset line of operations;and NOW,THEREFORE,BE IT ORDAINED BYTHEMAYORANDTHECITY COMMISSION OFTHECITYOF SOUTH MIAMI,FLORIDA: Section1.Section 20-3.4 (B)(10)(a)ofthe City of South Miami Land Development Code is hereby amended to read as follows: (10)AUTO WASH OPERATION (a)All such uses involving anautomatedcarwashingoperationshallbe conducted ina futfy enclosed structure enclosed on three sides. (b)All such uses involving an automated car washing operation shall have storage lanesadequateto accommodate four (4)vehicles for each bay. (c)Nosuchuse involving anautomatedcarwashingoperationshallbelocatedless thanonehundred(100)feetfromany residential district. Section 2.Codification.Theprovisionsofthisordinanceshall become andbemade partoftheCodeof Ordinances ofthe City of South Miami as amended;thatthesectionsof this ordinance may be renumbered or re-lettered to accomplish such intention;andthatthe word "ordinance"may be changed to "section"or other appropriate word. Ord.No.15-14-2193 Section 3.Severability.If any section,clause,sentence,or phrase of this ordinance is for any reason held invalid or unconstitutional bya court of competent jurisdiction,this holding shall not affect the validity of the remaining portions of this ordinance. Section 4,Ordinances in Conflict.All ordinances or parts of ordinances and all sections and parts of sections of ordinances in direct conflict herewith are hereby repealed. However,itisnot the intent ofthis section to repeal entire ordinances,or parts of ordinances, that give the appearance of being inconflict when the two ordinances can be harmonized or when onlya portion of the ordinance inconflict needs to be repealed to harmonize the ordinances.If the ordinance inconflictcanbe harmonized by amending itsterms,itis hereby amended to harmonize the two ordinances.Therefore,only that portion that needs tobe repealed to harmonize the two ordinances shallbe repealed.
