Res No 162-14-14256RESOLUTION NO,162-14-14256 A Resolution amending Resolution 62-13-13880 repealing the previous limitation on expenditure for the Murray Park Community Pool and authorizing the City Manager to expend an amount not to exceed the amount budgeted in each fiscal year for the operations and expenses of the Murray Park Community Pool commending with current proposed budget relating back to the beginning of the current fiscal year. WHEREAS,the City of South Miami approved a contract,for the construction of the Murray Park Community Pool,with Recreational Design &Construction,Inc.fora contract price of $1,422,000,whichincludes $137,400 fordesignand pre-construction costsandwhich limited the operation and maintenance coststotheCityandtheCRAinan amount nottoexceed $50,000,tobeadjustedannuallybythe Consumer PriceIndex,andthatthepoolshallnotbe openformorethanten (10)weeks,unlessnon-advaloremfundingcanbefound.;and WHEREAS,thecost of theoperationandmaintenance of theMurrayParkCommunity Pool will bein excess of $50,000;and WHEREAS,theCityCommissiondesirestoincreasetheauthorizedexpenditureforthe cost of operationsandmaintenance of thepool. NOW THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section1.Theportionofthe Resolution 62-13-13880 that limited the operation and maintenance coststotheCityandthe CRA inan amount notto exceed $50,000.00,tobe adjusted annually by the Consumer Price Index,and that restricted the pool operations toa periodofnotmorethanten (10)weeksis hereby repealed. Section2.TheCity Manager is hereby authorized to expend thisyearandeach year thereafter an amount notto exceed the amount set forth inthe proposed City of South Miami andSouth Miami Community Redevelopment Agency's budget,orassetforthin their future budgets,for the operation and maintenance costs of the Murray Park Community Pool,unless non-ad valorem funding can be found.Any additional funding canbe used to increase such expenditure tothe fullest extent ofthat funding source asa supplement tothe City and Community Redevelopment Agency's budget as authorized by the City Commission. Section 3,Severability:Ifany section,clause,sentence,or phrase ofthis resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction,this holding shallnot affect the validity ofthe remaining portions ofthis resolution. Section 4.Effective Date:This resolution shall take effect retroactively tothe beginning of the current fiscal year based on the current proposed budget for fiscal year 2014- E§.2 of Res.No.162-14-14256 PASSED AND ADOPTED this 5th_day of August 2014.
