A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI,FLORIDA,RELATING TO
ELECTIONS;PROVIDING FOR DELEGATION OF
RESPONSIBILITY OF CANVASSING COMMITTEE;
PROVIDING AN EFFECTIVE DATE.
WHEREAS,article V,section 5B of the city charter provides that the
canvassing committee "shall record the results of the election and proceed to
tabulate the absentee ballots and certify the results";and,
WHEREAS,thecanvassingcommitteeis comprised of a majority of the
city commission and the city clerk;and,
WHEREAS,amajority of thecity commission are candidates inthe
election which scheduled for February 14,2006,andoneormore of the remaining
commissioners might be actively supporting a candidate;and,
WHEREAS,theparticipation of commissionersascandidatesortheir
involvementinactivelysupportingthecampaign of acandidatecreatesaconflict
of interest with their duties as members of the canvassing committee;and,
WHEREAS,theMayorandCityCommissiondesiretoavoidaconflict of
interestandto maintain theintegrity of theelectionprocess,and,therefore,desire
to designate a disinterested government officialto exercise their dutiesas
members of the canvassing committee.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA;
Section 1.Members of thecity commission willnot participate as
members of the canvassing committeeintheFebruary14,2006election.Thecity
commission hereby delegatesitsdutiesasmembers of the canvassing committee
tothe Miami-Dade CountySupervisor of Elections,or his/her designee.Inthe
event the supervisor of elections declines this appointment,then the city attorney
is authorized to request the Chief Judge of theEleventh Judicial Circuit to appoint
a county court judge to exercise theduties of the canvassing committee,along
with the city clerk.

A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OFSOUTHMIAMI,FLORIDA,RELATING TO
ELECTIONS;PROVIDINGFOR DELEGATION OF
RESPONSIBILITY OF CANVASSING COMMITTEE;

WHEREAS,articleV,section 5Bofthecitycharter provides thatthe

conflict of interestandtomaintaintheintegrity of theelectionprocess,and,
therefore,desiretodesignatea disinterested governmentofficialtoexercise then-
dutiesas members of the canvassing committee.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA;
Section1.Members of thecitycommissionwillnotparticipateas
members of thecanvassingcommitteein title February 10,2004election.Thecity
commission hereby delegatesitsdutiesasmembers of thecanvassingcommittee
totheMiami-Dade County Supervisor of Elections,orherdesignee.Intheevent
thesupervisor of electionsdeclinesthisappointment,thenthecityattorneyis
authorizedto request the Chief Judge of theEleventh Judicial Circuit toappointa
