We are proposing to add an addition to the rear of our existing house which would match the style of the original architecture.We are also proposing to replace the existing metal bronze-tinted windows,which are currently incompatible tothe architecture style,to single hung divided lite windows as shown onthe elevations. The house Ms withinthe setback requirements.However,we anticipate needing to incorporate a future canvas carport adjacent to the side of the house which would require a variance from the present 7'-6"minimum setback.Our lotis50'wide,narrower than the typical lots in South Miami.As members of this board,please consider amending the minimum setback requirement for the Cambridge Lawns Historic district to zero setback where the carport occurs.These you can implement ona case-by-case basis,as you see appropriate in context tothe existing residences. (B)Notice Required. (1)Governmental agencies having the authority to demolish unsafe structures shall receive notice of designation of individual sites,districts,or archeological zones pursuant to this Code from the Historic Preservation Board. (2)The Historic Preservation Board shall be deemed an interested party and shall be entitled to receive notice ofany public hearings conducted by said governmental agency and the owner relative to the feasibility of,and the public interest in, preserving the designated property,or significant relics and artifacts. (C)Demolition Approval. (1)No permit for voluntary demolition ofa designated building,structure,improvement or site shall be issued to the owner thereof until an application for approval and the reasons therefore have been submitted and approved by the Planning and Zoning Division,pursuant to the procedures in this Code. (2)The Historic Preservation Board may petition the City Commission to grant demoli tion approval with a delayed effective date of up to six (6)months. (3)Grant of a demolition approval shall be evidenced by written order ofthe Planning and Zoning Division detailing .the public interest which is sought to be preserved. (4)Such written order may be appealed to the City Commission,pursuant to provisions of this Code. (D)Structure Preservation. (1)During the demolition delay period,the board may take such action as it deems necessary to preserve the structure concerned,in accordance with the purposes of this Code. (2)Such steps may include,but shall not be limited to: (a)Consultation with civic groups,agencies and interested citizens; (b)Recommendations for acquiring property by public or private bodies or agencies; and (c)Exploration of the possibility of moving one(1)or more structures or other features. (E)Certificate ofAppropriateness. (1)Certificate Required asPrerequisitetoAlteration,Etc.Pursuant toa recommendation by the Planning and Zoning Director of the need for an appropriateness review,no building,structure,improvement,landscape feature,or archeological site within the City of South Miami which is designated pursuant to this Code shall be erected, Errata 128 PROCEDURES ANDAPPLICATIONS 20-5.19 altered,restored,renovated,excavated,moved,or demolished until an application for a "Certificate of Appropriateness"regarding any architectural features,landscape features,or site improvements has been submitted to and approved pursuant tothe procedures in this Section. Architectural features shall include,but not be limited to,the architectural style, scale,massing,siting,general design,and general arrangementoftheexteriorofthe building or structure,including the type,style and color of roofs,windows,doors and appurtenances.Landscape features andsite improvements shallinclude,but arenot limited to,site regarding,subsurface alterations,fill deposition,paving,landscaping, walls,fences,courtyards,signsandexterior lighting No certificate of appropriateness shall be approved unless the architectural plans for said construction,alteration,excavation,restoration,renovation,relocation ordemo lition are approved by the City Commission. (2)Standards for Issuance.The Historic Preservation Board shall adopt and may,from timetotime,amend the standards by which apphcations for any certificate of appropriateness maybe evaluated.Inadoptingthese guidelines,it shallbe the intent ofthe board to promote maintenance,restoration,adaptive reuses appropriate tothe property,andcompatiblecontemporarydesigns that are harmonious with the exterior architectural and landscape features of neighboring buildings,sites,and streetscapes. These guidelines may also serve as criteria for the Planning and Zoning Director to make decisionsregarding the needforanapphcationforacertificate. (3)Procedures. (a)An applicant for a certificate of appropriateness shall submitan apphcation to the Planning and Zoning Division and accompany such apphcation withfull plans and specifications,site plan,and samples of materials as deemed appro priate to fully describe the proposed appearance,color,texture,or materials,and architectural design ofthe building and any outbuilding,wall,courtyard,fence, landscape feature,paving,signage,andexterior fighting. Theapplicantshallprovideadequateinformationtoenable visualization of the effect ofthe proposed action on the applicant's building and its adjacent buildings and streetscapes. Ifsuch apphcation involves a designated archeological site,the applicant shall providefullplansand specifications ofwork that mayaffectthesurface and subsurface of the archeological site. (b)The Historic Preservation Board shall hold a public meeting upon an apphcation for a certificate of appropriateness affecting designated properties in order to make recommendations tothe City Commission. (c)The City Commission shall act upon an apphcation within sixty (60)days of receipt of apphcation materials adequately describing the proposed action. TheCity Commission may approve,deny,or approve inmodified form an •apphcation,subject tothe acceptance ofthe modification bythe applicant,or Errata 229 20-5.19 SOUTH MIAMI LAND DEVELOPMENT CODE suspendactionontheapphcationforaperiodnottoexceed thirty (30)daysin order to seek technical advice from outside its members orto meet further with tile applicant toreviseor modify the apphcation.Noticeandprocedureof the publichearingbytheCity Commission shallbegiventotheproperty owner(s)by certified mail andtootherinterestedpartiesby advertisement inanewspaperof general circulation at least ten (10)days prior to the public hearing. (d)Thedecisionof the CityCommission shall be issued in writing.Evidenceof approval of the apphcation shall beby certificate of appropriateness issued in the formofa resolution of the CityCommission and,whatever the decision,notice in writing shallbegiventotheapplicantandto the DirectorofPlanning and Zoning. (e)If a set of plans is denied,ormodificationisrecommended,the CityCommission shall,to the extent possible,make specific findings asto the reasons for denial and modification,and recommend appropriate changes,if possible. (4)Compliance of Work with Certificate Standards.Allworkperformed pursuant to the issuance of any certificate of appropriateness shall conformto the requirements of the certificate.TheCityManagershalldesignatean official toperformnecessaryinspec tions inconnection with enforcementof this chapter,who shall beempoweredto issue a stop work order if performance is not in accordance with the issued certificate. Nowork shall proceedaslongasastopworkordercontinuesineffect.Copiesof inspection reports shall befurnishedto the City Manager andcopiesofanystopwork orders shall befurnishedtoboththeHistoric Preservation Boardandtheapplicant. The designated official shall ensure that work not in accordance with a certificate of appropriateness shall becorrectedtocomply with the certificate of appropriateness prior to withdrawing the stop workorder. (5)Emergency,Temporary Measures.Forthepurposeofremedyingemergencyconditions determined tobe dangerous tolife,health,orproperty,nothing contained herein shall prevent the making ofanytemporaryconstruction,reconstruction,orother repairs to abuildingorsite,pursuant toanorderofagovernmentagencyoracourtofcompetent jurisdiction. Theownerofabuildingdamagedbyfireor natural calamity shall bepermittedto stabilize the building immediately without approval and to rehabilitate it later under the normal review procedures of this chapter. Repeating the same angle maintains the current appearance ofthe building. Ms.Chael clarified to the Board that as part of the process to obtain the certificate of appropriateness they intend to demolish areas of the house which are not historic such as the existing wood deck,Jacuzzi,screened enclosed porch and storage shed which is close to the property line.She indicated that all the aforementioned structures were not built original to the house therefore they are not compatible to the original house.In addition,she stated that they will match new addition to existing stucco finish of the rest of the house.Furthermore,they are proposing to replace existing metal bronze-tinted windows,which are currently incompatible to the architecture style to single hung divided lit windows as shown on the elevations. The Board addressed the issue of the structures that were not original to the house and discussed the setback requirements. Motion:Ms.Redding moved to approve the demolition of the wood deck,Jacuzzi,screened enclosed porch and temporary structure (storage shed). Mr.Kurtzman seconded the motion.
