WHEREAS,Application no.PB-05-011 was submitted tothe Planning Boardby
Custom Design Properties,Inc.,said application requesting approval of a variance from
Section 20-3.5(G)of theLand Development Codeto allow thelotarea of a building siteto
be9,927feet,where a minimum of 10,000feetis required,on property within an "MO"
Medium Intensity Office Zoning District,specifically located atthe northwest corner of
SW71 Street and SW 61 Avenue,South Miami Florida;and
WHEREAS,the applicant wishestodevelopthe property withafourstorymixed
use building,and;
WHEREAS,inordertodeveloptheproperty,avarianceisrequired;and
WHEREAS,theapproval of a variance requires a recommendation fromthe
PlanningBoardandtheapproval of theCityCommissionafterapublichearing;and
WHEREAS,onMay 10,2005thePlanningBoard,afterpublichearing,voted5
ayes0nayto recommend approval of thevariancerequest;and
WHEREAS,theMayorandCityCommission of theCity of SouthMiamidesireto
acceptthe recommendation of thePlanningBoard.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI,FLORIDA:
Section1.Thatthe subject application submitted by Custom Design Properties,Inc.
requesting approval of avariancefromSection 20-3.5(G)of theLand Development Code
toallowthelotarea of abuildingsitetobe9,927feet,whereaminimum of 10,000 feetis
requiredonpropertyspecificallylocatedatthenorthwestcorner of SW71StreetandSW
61 Avenue,South Miami Florida.
Section 2.Thatthe approval ofthe subject variance is based uponthe following findings:

a)The existingpropertyissmaller than the minimum sitesizerequiredbytheLand
Development Codeandcannotbedevelopedwithout a variancewhichconstitutes a
hardship.
b)Thevariancerequestedis of a small,incrementalnatureandwouldhaveminimal
impacton surrounding properties.
c)Thatthe variance shall be extended foran additional six-month period.
Section 3.This resolution shall be effective immediately after the adoption
hereof.

SUMMARY OF REQUEST
TheapplicantisrequestingapprovalofavariancefromSection 20-3.5G of theLand
Development Code to allow the net area ofa building site (NE corner of.SW 71th Street and SW
61st Ave)tobe9,927squarefeet where a minimum of 10,000 feetisrequiredand95feet frontage
whereaminimum of 100feetisrequired.Thesubject property iswithinthe "MO"Medium-
IntensityOfficezoningdistrict.Theapplicantseeksavarianceinordertoredeveloptheproperty,
whichiscurrentlyvacant.Theapplicantisproposingtobuildanewfourstoryoffice building
including three residential unitsand9500squarefeet of officespace.

(3)Theapplicant's representative statesina hardship letterthevarianceisnot self-created and
thatthesubstandardsize of thepropertyprohibitstheuse of theproperty.Itisfurtherstatedthat
thereareother nearby properties withsubstandardlotsizewhichhave been grantedvariancesto
permitdevelopment.InOctober,2004thePlanningBoardandtheCityCommissionapproveda
variancefora 5,618 sq.ft.parcelat7001SW61Ave.tobedeveloped.AtthattimethePlanning
Department opposed thevariance,statingthefollowing:
"Thevariancerequestisanotauniquesituation;other property ownersmaywish
torequesta similar variance.Itisimportanttonotethatthisarea(twoblocks)isthe
onlylocation for theMOzoningdistrictintheCity.Thereare13buildingsites.A
total of 7buildingsitesare non-conforming asto minimum lot size requiredforthe
MOzone.The staff recognizesthattheMOzoningandtheFutureLandUse
categoryinthisareaneedstobere-examinedinlight ofitslocationclosetoMetro
RailandtheabuttingTODD(MU-5)district.Thesetypes of changescanbe
addressed as part ofComprehensive Plan'sEvaluation and Appraisal process."
The Planning Department,recognizes the difficulties of the non-conforming status of property in
theMO District.Inthe subject application the variance request isless than one percent of thelot
size minimum and is supportable.
(4)The applicant has chosen tousethe "Joint UseviaSpecial Parking Permit"section of the
LDC(Sec.20-4.4(G)to show the amount of parking spaces provided tobe39 spaces instead of
45.The applicant is required to submit a separate special parking permit application if the joint
use parking reduction is being requested.This section of the Code was under moratorium since
1999,which expired in2004.The Administration is now requesting that the moratorium be
extended an additional nine months.
(5)ThePlanningDepartmentis opposed totheapplicant'sdecisiontousethejointusespecial
parkingpermit.Parking reductionsintheTODDand Hometown District previously underthe
moratorium should not be granted untilsuchtimeas new parking regulations canbe debated and
adopted.
PLANNING BOARD ACTION
Atthemeetingtheapplicantwithdrewtheproposaltousethe joint useviaspecialparkingpermit
elementwhichwouldhaveallowedareductioninrequiredparkingspaces.ThePlanningBoard
atitsMay10,2005meeting,afterapublichearing,adoptedamotionbya5aye0nayvote,
recommending approval of the requested variance.
RECOMMENDATION
Itisrecommendedthatthelotsizevarianceapplicationbeapprovedsubjecttotheapplicant
eliminatingtheuse of the "joint spacesspecialparking permit"from consideration inthe
development of the building.

Section 20-5.5 shall lapse after six (6)month if no substantial
construction or change of use has taken place in accordance with
the request for such variance and if the city commission has not
specified a longer approval period for good cause shown.
(B)Extension of Variance Approvals.Four (4)affirmative votes of
the city commission may grant an extension to a previously
approved variance if a proper and timely request is made by the
applicant prior to the expiration of the six (6)month period.
(C)Hardship Statement.All applications for a variance shall include
a letter of intent indicating the specific nature of the hardship
upon which the request is based.
(D)Property Survey Required.All applications for a variance shall
include a current property survey prepared by a registered
surveyor.
(E)Neighborhood Concurrence.All applications for a variance shall
be accompanied by amap which reflects all properties and the

names of all property owners within a five hundred (500)foot
radius of the subject property.The applicant shall obtain and
submit the signatures of at least twenty (20)percent of such
property owners,indicating their awareness of and concurrence
with the proposed variance request.
(F)Proposed Site Plan Required.A site plan shall be required
showing all proposed buildings and setbacks and any other
features relating to the variance request.
(G)Permitted Variance Requests.Applications for variances shall be
restricted to only the following:
(1)Yard setbacks
(2)Lot size
(3)Lot coverage
(4)Building height
(5)Fences and walls
(6)Impervious coverage
(7)Off-street parking
(8)Open space
(9)Signs
(10)Landscaping

1.The applicant does notown additional,adjacent property,accordingly,the variance of
lot area isnot self-created,and there is an inconsistency between the underlying zoning district,and

2.Theprovisionofthe plaza and balconies enhances the pedestrian character ofthe area,
furthers thecreativedevelopmentenvisionedbytheunderlyingMixed-Use category,andpromotes
rational growth inthecore area near theSouth Miami Metrorail Station,allin concert withthe City's
Comprehensive Plan.
3.Theparking for the proposed buildingis calculated asrequired by Section 20-3.5 of
