A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
SOUTH MIAMI,RELATING TO A REQUEST PURSUANT TO SECTION 20-
3.4(B)(4)(b)OF THE LAND DEVELOPMENT CODE FOR A SPECIAL USE
APPROVAL TO LOCATE A GENERAL RESTAURANT IN THE "SR (HD-OV)"
SPECIALTY RETAIL HOMETOWN DISTRICT OVERLAY ZONING DISTRICT
SPECIFICALLY LOCATED AT 5850 SUNSET DRIVE.
WHEREAS,Eddie Barrones and Arthur Beaudet,has submitted Application No.PB-05-008
requesting special use approval toallowa general restaurant to locate inthe "SR(HD)"Specialty Retail
Hometown District Overlay zoning district specifically locatedat 5850Sunset Drive;and
WHEREAS,a general restaurant is allowed asaspecialuseinthe "SR(HD)"Specialty Retail
Hometown District Overlay zoning districtsubjectto meeting general conditions specified inLDC
Section 20-5.8and subject to meeting special requirements setforthinLDC Section 20-3.4(B)(4)(b);and
WHEREAS,the approval of aspecialuse requires a recommendation fromthe Planning Board
andtheapproval of theCity Commission afterapublichearing;and
WHEREAS,onMarch8,2005thePlanningBoard,afterpublichearing,voted5-0to
recommend approval with conditions of thespecialuserequest;and
WHEREAS,the Mayor andCity Commission of the City of SouthMiami desire to accept the
recommendation of the Planning Board.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1:Thatan application forspecialusetoallowthegeneral restaurant tolocateinthe "SR(HD)"
SpecialtyRetailHometownDistrictOverlayzoningdistrictspecificallylocatedat5850SunsetDriveis
hereby approved subject tothe following conditions:
(1)Therestaurantshallinstallarefrigeratedgarbagestoragefacilitytobeusedpriortoroutinegarbage
removal;
(2)£JQ Ifthesubjectgeneral restaurant is,inthefuture,determinedbythe Director of Planning ,tobe
adversely affecting thehealthorsafetyofpersonsresidingorworkinginthevicinity of the
proposeduse,tobe detrimental tothepublicwelfareor property or improvements inthe
neighborhood,ortobenotin compliance withotherapplicableCode provisions,thespecialuse
approvalmaybemodifiedorrevokedbytheCity Commission upon notification andpublic
hearing
Section2:Thisresolutionshallbeeffectiveimmediatelyaftertheadoptionhereof.

SPECIFICALLY LOCATED AT 5850 SUNSET DRIVE.
APPLICANT'S REQUEST:
Pursuanttosection 20-3.4(B)(4)(b)of theLandDevelopmentCode(LDC)theapplicants,Eddie
BarronesandArthurBeaudet,arerequestingSpecialUseApprovaltooperateageneral
restaurant,attheabovereferencedlocation.Theproposeduseislocatedinthe "SR(HD)",
Specialty Retail Hometown Overlay Zoning District.A general restaurant ispermittedwith
Special Use Approval.The proposed usemustmeetthe requirements for special uses contained
underSection 20-3.4(B)(4)(d)GeneralRestaurantandSection20-5.8SpecialUseApproval of
the LDC.Ageneralrestaurantisdefinedasan establishment wheretheprincipalbusinessisthe
sale of foodandbeveragestothecustomerina ready-to-consume stateandwherethedesign
shall provide a sit-down areaforthecustomers.
STAFF ANALYSIS:
The applicant is requesting aspecialusepermittooperateaMexicanstylerestaurantintherear
section of thegroundfloor of anexistingtwostorybuildinglocatedat5850SunsetDrive.The
first floorwaspreviouslyoperatedasarestaurantcalledKooKooRoo.Thespacehasbeen
vacantforthepasttwoyears.In2004theCityapprovedaspecialuserequesttooperatea
restaurantonthegroundfloorinthefrontsection of thesamebuildingat5850SunsetDrive.
This restaurant to be called Natural Chicken Grill is now under construction.The proposed
restaurantaspart of thisapplicationwilloccupyapproximately2,600sq.ft.Theentrancetothe
restaurant willbeonSW 58th Court

It also important tonotethatthe Hometown Overlay Zoning District Regulating Plan (map)
designates this building asa "contributive building"(having historic /architectural merit),and
therefore itisexempt from providing required parking spaces.(LDC Section20-7.6 (C)(3)).
SPECIAL CONDITIONS APPLICABLE:
The LDC provides that special uses mustbe approved bytheCity Commission after a public
hearing and receipt ofa recommendation from the Planning Board.The overall purpose isto
determine the compatibility ofthe proposed usewiththe surrounding neighborhood.A special
usemustcomplywiththe conditions setforthinSection 20-5.8(B)inthatthe use:
a)Willnot adversely affectthehealthorsafety of personsresidingor working inthe
vicinity of the proposed use,
b)Willnotbe detrimental tothepublic welfare orpropertyor improvements inthe
neighborhood;and,
(c)ComplieswithallotherapplicableCodeprovisions.
In addition,specialusesmayalsoberequiredtocomplywith supplemental requirements,which
aresetforthinSection20-3.4(B)(4)(b).Inthecase of ageneralrestaurantthefollowing
requirements arelisted:
(i)Allsuch establishments shallprovideonlyinsideorpatioserviceonprivateproperty.
Publicstreets,rights-of-way,sidewalksandrequiredsetbacksmaynotbeusedfor
patioor street-side services of anykind.Aseparate application foroutdoorseating
would be required,
(ii)Noservices of adrive-inor of afastfoodnatureshallbepermitted,
(iii)Thecitycommissionshallreviewandrecommendapproval,disapprovalor
modification of allsiteplansandprojectspecificationsforthisspecialusepermit.
PLANNING BOARD ACTION
ThePlanningBoardatitsMarch8,2005meetingadoptedamotionbyavote of 5ayes0naysto
recommendapproval of theapplicationwiththestandardconditionproposedby staff andthe
following condition:
•Theapplicantshallinstallarefrigeratedgarbagestoragefacilityintherestauranttobeused
prior toroutinegarbageremoval;
RECOMMENDATION
The Administration is concerned that the condition added by the Planning Board is not required
byCityregulationsandisaburdenonapplicantswhereasuitableout-doordumpsteriscloseby
and readily available.
The requested specialuse complies withtheLDC requirements setforthforspecialusesin
Section 20-3.4 andthe conditional use requirements setforthin Section 20-5.8.Approval of the
application with the following standard condition is recommended:

Action:Mr.Illas read the item intothe record.Mr.O'Donniley presented the staff
report.He explained the applicant is requesting aSpecial Use Approval to operate a
general restaurant.The proposed useis located inthe "SR(HD)",Specialty Retail
Hometown Overlay Zoning District.The Mexican style restaurant willbe located
inthe rear section of the ground floor of an existing two-story building located at
5850 Sunset Drive.The firstfloorwas previously operated asa restaurant called
KooKooRoo.Thespacehasbeenvacantforthepasttwoyears.In2004theCity
approvedaspecialuserequesttooperatearestaurantonthegroundfloorinthe
front section of the same building at5850 Sunset Drive.This restaurant tobe called
Natural Chicken Grill isnow under construction.The proposed restaurant as part of
this application will occupy approximately 2,600sq.ft.It appears thatthe entrance
totherestaurantwillbeonSW 58th Court
Mr.O'Donniley alsonotedthattheHometownOverlayZoning District Regulating
Plan(map)designatesthisbuildingasa"contributive building"(havinghistoric/
architecturalmerit),and therefore itisexemptfrom providing required parking

removal.Mr.Illas amended his motion to include the requirement fora

condition that a refrigerated garbage storage facility is provided.Ms.Yates
seconded the motion.
