No. 158-05-12137RESOLUTION NO. 158-05-12137 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, RELATING TO A CHARTER AMENDMENT; PROPOSING AN AMENDMENT TO THE CHARTER; SUBMITTING A BALLOT QUESTION TO THE ELECTORATE OF THE CITY AT THE GENERAL ELECTION SCHEDULED FOR FEBRUARY 14, 2006 CONCERNING THE LENGTH OF TERM OF THE MAYOR; REPEALING PROVISIONS IN CONFLICT; PROVIDING AN EFFECTIVE DATE. WHEREAS, it is the intent and desire of the City Commission to provide an opportunity to the electorate to vote on the issue of a four (4) year Mayor's term; and WHEREAS, it is the desire of the City Commission that this Charter amendment be submitted to the electorate at the February 14, 2006 general election; and WHEREAS, the proposed Charter amendment is set forth in this resolution. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT: Section 1. The following question shall be submitted to the electors of the City of South Miami at the next general election: Title: MAYOR'S TERM OF OFFICE QUESTION: SHALL ARTICLE V, SECTION 2. A. OF THE CHARTER OF THE CITY OF SOUTH MIAMI BE AMENDED TO PROVIDE THAT THE MAYOR'S TERM BE INCREASED FROM TWO (2) YEARS TO FOUR (4) YEARS EFFECTIVE WITH THE FEBRUARY 2006 ELECTION? YES _ NO If the question is approved by a majority of the voters voting in the general election, the Charter for the City of South Miami shall be amended to read as follows: Article V Elections Section 2. General Elections —A. Time General elections for the Commission shall be held during February of each even year, the day, place and time to be set by ordinance, at which time the Mayer shall be elee4ea to ° *° °m e€tweearsnd two commissioners shall be elected to terms of four years. Upon adoption of the amendment to the Charter at the general election on February 14, 2006, all conflicting provisions of the Charter and the Code of Ordinances shall be repealed. Section 3. This Resolution shall become effective immediately upon adoption and amendments to the Charter shall become effective prospectively after approval by the electors at the general election on February 14, 2006. BACKGROUND & ANALYSIS: The South Miami City Charter currently provides for the Mayor to serve a two -year term, with all of the Commissioners serving four-year terms. With the Mayor's term set at only two years, there have been a number of times in South Miami's history that Mayors appeared to be conducting their re- election campaigns the minute they took the oath of office, limiting their ability to serve South Miami's citizens effectively. A two -year term provides one with very little time to overcome the tremendous learning curve involved in taking on the duty of Mayor, let alone being able to establish initiatives and see projects through to completion. A four -year tern, identical in length to what all of the Commissioners serve, would also provide for much - needed continuity on the City Commission. Since the Mayor's position on the City Commission is no less important than any of the Commissioner's positions, the Mayor should also serve a four -year term. The attached resolution would allow for the voters of South Miami to determine whether the Mayor's term should be increased from two years to four years. This question would be placed on the ballot for the next general election scheduled for February 14, 2006. RECOMMENDATION: I recommend that the attached resolution be adopted, placing the charter amendment question on the February 14, 2006 ballot.
