A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI, FLORIDA, RELATING TO AN APPEAL OF A
DECISION OF THE ENVIRONMENTAL REVIEW AND PRESERVATION
BOARD REGARDING THE APPROVAL OF A SIGNAGE INSTALLATION
LOCATED AT 6220 SOUTH DIXIE HIGHWAY; PROVIDING AN
EFFECTIVE DATE
WHEREAS, the Environmental Review and Preservation Board (ERPB) at its April 5,
2005 meeting reviewed Application No. ERPB -05 -028 and approved, with conditions, the request
for signage installation for a building located at 6220 South Dixie Highway; and
WHEREAS, on July 18, 2005 the applicant, Alice Goodhart, filed an appeal to the decision
of the Environmental Review and Preservation Board claiming that the signage request has been
reduced by half; and
WHEREAS, Section 20- 6.2(A) of the Land Development Code allows for an appeal of an
ERPB decision to be made to the City Commission by the applicant, interested citizens, or the City
administration; and
WHEREAS, Section 20 -6.2 (E) of the Land Development Code provides that the City
Commission may reverse, affirm, or modify any decision of the Environmental Review and
Preservation Board on which there has been an appeal.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI, FLORIDA THAT:
Section 1. That the appeal of the decision of the Environmental Review and
Preservation Board made on July 18, 2005 regarding the approval of a signage installation located at
6220 S. Dixie Highway is affirmed with the following condition: that the sign be allowed a
maximum of 32 sq. ft. denied and h deeision of the d in this affirmed.
Section 2. This resolution shall be effective immediately upon execution.

BACKGROUND AND ANALYSIS•
At its April 5, 2005 meeting, the Environmental Review and Preservation Board (ERPB) gave final
approval, with conditions, for the installation of a sign on a retail store located at 6220 South Dixie
Highway (case number: ERPB -05 -028). The proposed permanent signage is located in the "GR"
General. Retail zoning district, which permits signage not to exceed. 20 percent of the area of any
building face and not to exceed 200 square feet in area. Pursuant to Section 20- 4.3(1)(5) The Land
Development Code (LDC), flat signage for this zoning district is permitted as follows:
FLAT SIGNS with a total aggregate sign area, not to exceed (20) percent of the area
of any building face; for the purpose of sign regulation, there shall be considered to
be only four (4) facades to any building; no single sign shall exceed two hundred
(200) square feet in area Direct illumination is permitted
The Land Development Code (Section 20- 6.2(A) provides that a decision made by the ERPB may
be appealed to the City Commission by the City administration, the applicant, or an interested citizen-
Attached is an appeal filed by the applicant, Alice Goodhart, on July 18, 2005. The City Commission
has 60 days from the filing date to hear the appeal and enter a decision (reverse, affirm or modify the
ERPB decision). The filing of the appeal stays all actions or proceedings related to the development
of the property.
SPECIFIC APPEAL ITEMS:
The appellant has claimed that the ERPB recommendation on April 5 2005, was actually a signage
reduction to half the size of the sign previously approved on March of 1996, (ten years ago), and is
therefore a financial burden. In order to explain her appeal, the appellant has attached the following:
appeal application form; a memo (stamped July 18, 2005 received City Clerk's office); Exhibit I
(ERPB approval letter dated April 6, 2005); and Exhibit 2 (photograph).
STAFF OBSERVATIONS:
(1) In order to properly review the appeal, attached to this report is the ERPB approval letter,
meeting minutes, staff report, application, sign details and photograph presgented at the ERPB
meeting of April 5, 2005 for Case No. ERPB -05 -028. The applicant requested an oval shaped sign
measuring 3' -10" x 8' -0 which equals 30.6 sq. ft. The ERPB approved an oval sign measuring 3'x
6' which equals 18 sq. ft. The ERPB felt that the size requested, although below the maximum size
limitation of 20 %, was not in their judgement aesthetically proportioned for the existing wall space
above the storefront. The oval sign is currently installed.
(2) Enclosed is additional documentation pertaining to the original sign application in 1996, (Case
No. ERPB -96 -025). It includes the ERPB letter and minutes, application, sign details and
photographs. The sign approved by the ERPB in 1996 was a linear sign measuring FT' x 10' which
equals 12 sq. ft. The sign has been on the building for eight years.
(3) It is the Planning Department's observation that the signs being compared are different in form,
design and size. The most recent sign presented to the ERPB in April 2005, has an "oval" shape and
reads different from the "linear" sign previously approved by the ERPB in 1996. In reference to size,
the "oval" sign approved in 2005 is larger. In that the new proposed sign is actually larger than the
one that has been on the building since 1996, the Planning Department is not sure why the applicant
is appealing the ERPB recommendation. It appears that the linear sign may have appeared larger
because it is more similar to nearby adjacent signs.
RECOMMENDATION:
It is recommended that the City Commission deny the appeal or refer the applicant back to the ERPB
for consideration of a different design.

The "Cookies by Design" sign was replacing a pre- existing one which was
in conformity with all other signage in the shopping center (located at
6220 South .Dixie Highway), previously approved by the city.
The planning board was obviously not aware that this was a previously
approved footage and was only a new logo which is now required by my
franchise. They assumed this was for new signage. The size and design of
the new logo sign was approved by my landlord prior to submission to the
city, as per planning board regulations.
To dwarf the new sign by several feet is totally unjust, inequitable and
desperate. It is not in conformity with the other signs in the shopping
center.

shrinkage — half the original size of the previously approved signi)
I am now unjustly limited to the only approved advertising permitted by
the City of South Miami, as I am unable to erect a sign on South Dixie
Highway. This is an unjust financial burden on a local business owner. I
am asking that you grant again what I previously enjoyed, the proper
signage approved by the city 10 years ago in conformity with entire
shopping enter as it exists today.

20 -6.2 Appeals.
(A) ERPB Decisions; Time; Standing to Appeal. All decisions and recommendations of the
environmental review and preservation board (ERPB) shall be posted on the City Hall bulletin
board immediately following the ERPB meeting. An applicant may obtain a building permit
after noon of the day after the ERPB meeting, at which the application was approved, if all
other requirements for the permit have been met. An appeal of an ERPB decision or.
recommendation may be Sled at any time before a building permit is issued by filing same with
the city clerk upon a form prescribed therefore. Appeals may be taken by the applicant,
interested citizens, or the city administration.
(B) Stay of Proceedings. An appeal stays all proceedings in furtherance of the action
appealed from, unless' the officer from whom the appeal is taken certifies to the city
commission, after notice of appeal has been Sled with him, that because of the facts stated in
the certificate a stay would, in the officer's opinion, cause imminent peril to life or property or
that because the violation charged is transitory in nature a stay would seriously interfere with
enforcement of the Code.
(C) Restraining Orders. If certification occurs in accordance with subsection (B) above,
proceedings may not be stayed except by a restraining order, which may be granted by the city
commission or by a court of record on application, on notice to the officer from whom the appeal
is taken and on due cause shown.

20 -6.2 SOUTH MLOH LAND DEVELOPMENT CODE
(D) Appeal Hearing. The city commission shall hear and enter a decision on all appeals
within sixty (60) days of the date of filing said appeal, and shall provide due notice of the
appeal to the parties.
(E) Commission Action. The city commission may reverse, affirm or modify any order,
requirement, decision or determination appealed from and shall make any order, requirement,
decision or determination that, in the city commission's opinion, ought to be made in the
circumstances.
(F) Modification Allowed. When practical difficulties or unnecessary hardships would
result from carrying out the strict letter of a Code provision, the city commission may, in
passing upon appeals, vary or modify any regulation or provision of the Code relating to the
use, construction or alteration of buildings or structures or the use of land, so that the spirit
of the Code is observed, public safety and welfare secured, and substantial justice done.
(G) Prior Denials. The city commission shall not be required to hear an appeal or
application previously denied if it finds that there has been no substantial change in conditions
or circumstances bearing on the appeal or application.

20 -6.3 Violations.
Any of the following shall be a violation of this Code and shall be subject to the enforcement
remedies and penalties provided by this Code and state law:
(A) Th engage in any development, use, construction, remodeling or other activity upon the
land and improvements thereon subject to the jurisdiction of this Code without all
required permits, certificates or other forms of authorization as may be set forth in this
Code.

concept is red lettering with a distinct font style and a light background.

Motion: Mr. Trautman motioned for approval of the application as presented. Mr. Balli seconded

Action: At today's meeting, the Board, staff, and applicant discussed the design of the proposed
new residence. This property is zoned RS -4 "Single- Family Residence" and the use will be single -
family.

T. CALL TO ORDER AND ROLL CALL.

1. PAINTED SIGN [E]3-96 -021)
Applicant: MedPartners Eye Associates (Paula Quigley)
Address: 5950 Sunset Drive
Note: See photograph of "Patient Parking" sign on the front of the
building. (Work has already been completed).
Ms. Maria Elena Gajate signed in as the representative. The Board briefly reviewed the
application.
Motion: Mr. Hochstim moved to approve the application, as presented. Mr. Cooke - Yarborough
seconded the motion.

2. FLAT SIGN [EB -96 -022]
Applicant: Acolite- Claude United (Chet Diffenderfer)
Address: 5950 Sunset Drive
.Note: One non - illuminated sign 27 sq. ft. in area.
No representative was present for the applicant.. Upon Mr. Cooke - Yarborough's inquiry, staff
confirmed that the proposed sign meets the City's code requirements. The Board noted that no
sample of the sign and/or proposed color of the sign was included in the application.
Motion: Mr. Cooke-Yarborough moved to defer the application. Mr. Hochstim seconded the
motion.

3. EXTERIOR ALTERATIONS [EB -96 -023]
Applicant: Marco Vitiello
Address: 7575 SW 62 Avenue
Note: Resubmission of the following previously approved items:
1. Awning color from dark green to alight green.
2. Removal of the stone veneer.
Mr. Marco Vitiello signed in as the representative. As the Board reviewed the plans, a discussion
ensued regarding application of any additional stone veneer and retention of the current stone
veneer. Mr. Cooke - Yarborough recommended that the current stone be retained, as previously
approved by ERPB, and that application of any additional stone not be required.
In response to Mr. Cooke - Yarborough's inquiry regarding current green details on the building,
Mr. Vitiello explained that the green details include numbers, railing, and signs.
Motion: Mr. Cooke - Yarborough moved to approve the application, based on the conditions 1)
that the existing stone be retained and the application of additional stone not be required; and 2)
that the color for the proposed awning be a lighter green,. as opposed to a darker green that was
previously approved. Mr. Hochstim seconded the motion.

4. NEW FLAT SIGNAGE [EB -96 -024]
Applicant: Manny Hemus
Address: 6054 South Dixie Highway
Note: Replace existing "Manny Auto Service" signs with new matching
signs.
Mr. Manny Herons signed in as the representative. The Board reviewed the plans for
replacement of existing signs. During consideration of the application, discussion of the size,
colors, and placement for the signage and of improvements (e.g., landscaping, painting, etc.) to
the building transpired. Mr. Kobola clarified points of review for the Board's information.
Motion: Mr. Hochstim moved approval, based on the condition that signage in the rear, saying
"Manny Auto Service" with telephone number, be repainted with blue background and yellow
letters to match the proposed signage of the application, and that the letters "tel" be eliminated
from the signage during the repainting. Mr. Cooke- Yarborough seconded the motion.

5. NEW FLAT AND WINDOW SIGNAGE [EB- 96 -025J
Applicant: Economy Signs
Address: 6220 South Dixie Highway
Note: One channel letter sign 13 sq, ft. in area and one window sign 2 sq.
ft. in area.
No representative was present for the applicant. The Board briefly reviewed the application.
The Board then voted on the channel letter sign portion of the application.
Motion: Mr. Cooke - Yarborough moved approval, based on the condition that the Board has
approved a channel letter sign, as opposed to a box sign. Mr. Hochstim seconded the motion.
Vote: Approved:3 Opposed:0
The Board followed by voting on the window sign portion.
Motion: Mr. Cooke - Yarborough moved approval of the window sign, as presented. Mr.
Hochstim seconded the motion.
Vote: Approved:3 Opposed:0
6. SIGNAGE [.EB -96 -026]
Applicant: City of South Miami
Address: 6130 Sunset Drive (City Hall & Police Department)
Note: New, handmade, natural finish, redwood sign with raised carved
letters (painted green) with raised City logo in City colors (green &
yellow) and raised, carved border painted in green.
Ms. Diana Morris, of City staff, spoke as the representative. The Board reviewed and discussed
the application (e.g., height of sign, placement of letters for the sign, etc.).
Motion: Mr. Cooke - Yarborough moved approval, based on the recommendations 1) that the
bottom of the sign be squared and not curved; 2) that the inside plaque saying "police
Department' be located equidistant from "City Hall" lettering, in the same manner that the "City
of South Miami" lettering is from "City Hall'; and 3) that the plaque around the "Police
Department' lettering be squared. Mr. Hochstim seconded the motion.

7. DETACHED SIGN [EB -96 -027)
Applicant: Ryan Markland Signs
Address: 6394 South Dixie Highway
Note: Face change only to existing pole sign
No representative was present. The Board reviewed the application, and staff explained that a
face change only is involved. During review, the Board discussed the proposed colors.
Motion: Ms. Wilson moved approval of the application, based on the condition that the yellow
color of the sign be no more intense than the yellow color of the building. Mr. Hochstim
seconded the motion.
Vote: Approved:3 Opposed:0
III. REMARKS.
City resolution no. 48 -96 -9802, design layout for City Hall:
Mr. Cooke - Yarborough spoke in regard to the resolution and recommended that any design
layout which is presented to the City come before ERPB for review.
IV. APPROVAL OF MINUTES: Approval of the February 20, 1996 Minutes,
Mr. Hochstim moved to approve the Minutes of February 20, 1996, as read. Mr. Cooke -
Yarborough seconded the motion.
