No. 037-06-12178RESOLUTIONNO. 37-06-12178 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, RELATING TO THE CITY MANAGER; AMENDING RESOLUTION NO.: 22 -06- 12163 TO PERMIT THE ACTING CITY MANAGER TO SUBMIT HER APPLICATION FOR CONSIDERATION FOR THE PERMANENT CITY MANAGER POSITION; PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to Art. 111, Sec. 4 of the city charter the Mayor and City Commission of the City of South Miami appointed Ms. Yvonne Soler-Mckinley to serve as the acting city manager for a period of 90 days or until a permanent city manager is selected by the commission; and, WHEREAS, Resolution No.: 22-06-12163 states that Ms. McKinley is not eligible for consideration for the position of permanent city manager; and, WHEREAS, the Mayor and City Commission desire to amend Resolution No. 22-06-12163 to permit Ms. Yvonne Soler-McKinley to submit her application for consideration by the city commission at such time as the commission considers applicants for the position of permanent city manager. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA; Section 1. Ms. Yvonne Soler-McKinley may submit her application for consideration as permanent city manager at such time as the commission begins to consider applicants for the position. This resolution supercedes the prohibition provided in Resolution NO.: 22-06-12163. Section 2. This resolution shall take effect immediately upon approval. PASSED AND ADOPTED this day of W 2006. WHEREAS, pursuant to art. 111, sec. 4 of the city charter the Mayor and City Commission of the City of South Miami have the authority to appoint an acting city manager to serve for a period of no longer than 90 days upon the resignation or during the leave of absence of the city manager; and, WHEREAS, the city manager, Ms Maria Davis, has tendered her notice of resignation effective immediately; and, WHEREAS, the Mayor and City Commission desire to appoint Ms. Yvonne Soler-McKinley to serve as acting city manager until a permanent city manager is selected by the commission. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA; Section 1. Ms. Yvonne Soler-McKinley is appointed to serve as acting city manager until a permanent city manager is selected, or for a period of time of no longer than 90 days. As acting city manager, Ms. McKinley shall have all of the powers and responsibilities as the city manager under the city charter and the law. The acting city manager shall not be eligible for appointment as the permanent city manager. The acting city manager shall have the authority to co-sign checks on behalf of the city. The acting city manager shall be paid a fee of $110,000 per year for the period of time she serves, and no benefits. Section 2. This resolution shall take effect immediately upon approval.
