RESOLUTION NO. 160-07-12545 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA RELATING TO THE ISSUANCE OF A CERTIFICATE OF APPROPRIATENESS PURSUANT TO SECTION 20- 5.19(E)(3) OF THE LAND DEVELOPMENT CODE FOR THE INSTALLATION OF AN OOLITIC LIMESTONE WALL AND GATES AT THE FRONT OF A RESIDENCE LOCATED AT 6227 SW 57th STREET WITHIN THE CAMBRIGDE LAWNS HISTORIC DISTRICT, PROVIDING AN EFFECTIVE DATE. WHEREAS, applicants, Victor Dover / Marice Chael, are requesting a Certificate of Appropriateness for the installation of low limestone wall and gates at the front of residence located at 6227 SW 57 Street, which is a contributing building within the Cambridge Lawns Historic District.; and WHEREAS, pursuant to Section 20- 5.19(E) of the Land Development Code, a "Certificate of Appropriateness ", is required for applications affecting the exterior (renovation, repair, painting, signage, demolition or landscaping) of properties designated historic; and WHEREAS, Section 20- 5.19(E)(3) of the South Miami Land Development Code requires the City Commission to conduct a public hearing on certificates of appropriateness and to approve, deny, approve in modified form, or defer a subject application; and WHEREAS, the Historic Preservation Board at its August 27, 2007 meeting adopted a motion by a vote of 4 ayes 0 nays recommending approval of the subject application for the installation of a low limestone wall and gates at the front of a residence located at 6227 SW 57 Street, which is a contributing building within the Cambridge Lawns Historic District.; and WHEREAS, the Mayor and City Commission of the City of South Miami desire to accept the recommendation of the Historic Preservation Board. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT: Section 1. Historic Preservation Board Application No. HPB -07 -009 requesting a Certificate of Appropriateness to allow for the installation of low limestone wall and gates at the front of a residence located at 6227 SW 57 Street, within the Cambridge Lawns Historic District is hereby approved as shown on the applicant's plans dated 8 -14 -07 and marked "Exhibit "A ". attached to this resolution. APPLICANT'S REQUEST The applicants, Victor Dover / Marice Chael, are requesting a Certificate of Appropriateness for the installation of Installation of low limestone wall and gates at the front of residence located at 6227 SW 57 Street, which is a contributing building within the Cambridge Lawns Historic District. The Land Development Code requires that a "Certificate of Appropriateness" (COA) be approved for any building permits affecting the exterior (renovation, repair, painting, signage, demolition or landscaping) of a designated structure). The approval process requires review by the Historic Preservation Board and a public hearing by the City Commission. The Commission may approve, deny, approve in modified form, or defer a COA application. APPLICANT'S PROPOSAL The applicant is completing an overall renovation of a single- family home at 6227 SW 57 Street. An additional item not included in the previously approved plans is a low front yard wall and gates at both sides of the structure. The applicant is proposing a wall along the front property line that will be made of oolitic limestone and will be 16 inches in height. The two gates at each side of the structure will be concrete with wood swinging gates all not exceeding four feet in height. tn The Land Development Code (Section 20- 3.6(H)(2)) allows for solid gates and walls in the required front setback (up to the property line) as long as they do not exceed four (4) feet in height. HISTORIC BOARD ACTION The Historic Preservation Board reviewed the applicant's proposed plans at its August 27, 2007 meeting. The Board then adopted a motion by a vote of 4 ayes 0 nays recommending approval of the requested Certificate of Appropriateness. RECOMMENDATION It is recommended that the Commission approve the "Certificate of Appropriateness" for the low (2) limestone wall and gates at the front of residence located at 6227 SW 57 Street as shown on the applicant's plans dated 8 -14 -07 and marked "Exhibit "A ". Certificate of Appropriateness Applications / Public Hearings HPB -07 -009 Applicant/ Owner: Victor Dover/Marice Chael Location: 6227 SW 57 Street (Cambridge Lawns Historic District) Request: Installation of low limestone wall and gates at front of residence. Mr. Youkilis advised the applicant is proposing a wall along the front property line that will be made of oolitic limestone and will be 16 inches in height. The two gates at each side do not exceed four feet in height of the structure. Action: Mr. Dover advised he has been working on the rehabilitation of the historic structure and its addition to the home. There will be two new low garden gates going along the property lines to the house and there will be landscaping in addition to what has been preserved. The site plan shows the location of the low garden wall which will be made from oolitic limestone. The low wall accounts for the change in slope that occurs throughout the yard. There will be plantings along the entire perimeter of the yard. Currently there is an existing chain -link fence on the rear of the property and there will be planting in front of that and the new fence will be visible from the street. HPB Minutes August 27, 2007 Page 2 of 3 Ms. Dison questioned the material that will be used to enclose the pool area_ Mr. Dover replied that three sides have chain - linked fence and the house sits on the fourth side therefore the two short pieces of the new fence will be the new visible material. Ms. Marice Chael stated that the original application and site plan illustrated the outline of the pool and since the pool application the two little gates that Mr. Dover described have to be done to take care of the back. Mr. Perez advised that the project is Leadership and Energy Efficient Design {LEED} certified. The house would be one of the first LEED certified in a historic district and the importance of the project is monumental to the LEED certification. The City of South Miami is creating a Green Design Task Force and the home would be an example. The project will help the City in creating the basis for the work that the Task Force will be performing and hopefully it may be transferred into commercial buildings as well as residential areas throughout the City. Mr. Dover replied that portions of the rehabilitated historic structure are "green" for example the roof material, capturing and harvesting the rain water for irrigation, insulation to the existing house. Wherever something was restructured it was rebuilt with LEED material. The Chair Person opened the public hearing. Speakers: NAME ADDRESS SUPPORT /OPPOSE Pat Shields 6218 SW 56 Street Opposed Ms. Shields stated she has no problem with the proposed wall and the gates for the front of the property. However, she was concerned that the large addition on the rear of the property overwhelmed the neighborhood. The pool which is being added at the rear of the property was never included in the original plans and its request was never brought before the HPB and the Commission. The neighbors were not notified nor given the opportunity to object or agree to it. When Mr. Dover mentioned he was adding the pool she stated she was under the impression he was joking until she found the trees and the shrubs on their property gone. The hugeness of the home's addition is visible from Miller Drive. Everyone is concerned about the integrity on drawings, doors, windows yet she feels that a pool is not original to the historic district neighborhood. Ms. Clyatt questioned if there was a pool permit that was approved. Mr. Youkilis responded that immediately after the major renovation was approved by the HPB, the applicant submitted a revised plan with the inclusion of a pool and the previous Planning Director accepted the plans as submitted therefore the Board never approved the pool. This action also occurred before staff was instructed to bring before the Board any revisions or changes made to the backyard. HPB Minutes August 27, 2007 Page 3 of 3 Ms. Chael stated that they will landscape not only the front yard but the backyard as well. Ms. Clyatt then questioned the type of landscaping. She stated that there are limitations as to what may be placed in the rear of the property considering there is very little landscaping space due to the small lots and the water lines running across the rear property line. Ms. Chael stated this limits the type of trees that could be installed because it may damage the water line that everyone shares. The Board suggested tall palms in order to restore the rear canopy. Ms. Stepnberg stated that the Board must take into consideration that in the rear of the property there are telephone and electrical lines running all around the block and certain trees may create a problem for Florida Power and Light. Ms. Lahiff questioned if the LEED certification was only for the new construction. She also questioned the type of trees that will be used. She added that palm tress would not be a good sound barrier and shrubs would be a great idea. Motion: Mr. Kurtzman moved for approval of the Certificate Of Appropriateness. Ms. Dison seconded. Vote: 4 Ayes 0 Nays Ms. Chael questioned if she may proceed with construction. Mr. Youkilis replied that the COA application must first go before City Commission which is scheduled for September 18, 2007.
