RESOLUTION NO. 13 9-07-12524 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA RELATING TO A WAIVER OF THE SECOND STORY CONSTRUCTION PROHIBITION IN ORDER TO ALLOW THE CONSTRUCTION OF A NEW TWO -STORY SINGLE FAMILY RESIDENCE, LOCATED AT 7631 SW 59 AVENUE WITHIN AN RS -3 "LOW- DENSITY RESIDENTIAL ZONING DISTRICT," BASED UPON A FINDING THAT THE PROPOSED CONSTRUCTION WILL HAVE NO NEGATIVE IMPACT ON ADJOINING PROPERTIES AND THE IMMEDIATE NEIGHBORHOOD; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Administration and the City Commission are concerned that the construction of larger structures ( "MeMansions ") within established neighborhoods, adjacent to long standing smaller single family residences, is contrary to the established "character" of the neighborhoods in which they are located; and, WHEREAS, the City Commission, staff and various citizen Boards have initiated a comprehensive review of the existing regulations; and, WHEREAS, in conjunction with the review it is also appropriate to provide temporary limitations, restrictions and prohibitions in regard to the issuance of building permits for the activities under study, due to the potential detrimental impact upon the existing neighborhoods of the City; and, WHEREAS, the City Commission at its February 6, 2007 meeting adopted Ordinance No. 03 -07 -1904 which established Interim Regulations for construction of two -story single family residential structures for a period of three months which legislation expired on May 5, 2007; and WHEREAS, the City Commission at its June 5, 2007 meeting adopted Ordinance No. 19 -07- 1920, which continued the Interim Regulations for a period of three months which legislation expires on September 5, 2007; and WHEREAS, an application was filed for the Environmental Review and Preservation Board (ERPB) on March 23, 2007 requesting approval for the construction of a two -story residence located at 7631 SW 59 Avenue; and WHEREAS, the ERPB at its July 17, 2007 meeting recommended final approval for the construction of the subject two -story residence; and WHEREAS, the applicant desires to proceed immediately with the approved construction and has submitted an application to have the City Commission waive the second story construction prohibition. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. That the City Commission hereby approves a waiver of the second story construction prohibition for a new residence located at 7631 SW 59 Avenue. This determination is based upon a finding that the proposed development complies with the following provisions set forth in Section 3 (A) of Ordinance No. 19 -07 -1920: Pg. 2 of Res. No. 139 -07 -12524 (a) the interim regulation imposes undue hardship on the applicant; or (b) the development proposed by the applicant will not: (i) result in a material diminution of the privacy of adjoining residential properties; and (ii) will not result in an obvious departure from the aesthetic character of the immediate vicinity taking into account existing structures and open space; and (iii) the proposed structure will have no more than a de minimus impact on the use and enjoyment of the adjoining parcel,- or (c) the applicant is proposing to mitigate the effect of the redevelopment by providing adequate safeguards which the Commission finds would adequately mitigate any detrimental impact to the neighborhood. Section 2. The above approval of the waiver of the second story construction prohibition for a new residence located at 7631 SW 59 Avenue is conditioned upon the following: (1) If the existing trees that are to be relocated on the subject property do not survive, new trees shall be planted at „a minimum of eighteen feet in height; and, (2) Architect to revise plans depicting a thirty percent maximum impervious coverage_ Section 3. APPLICANT'S REOUEST: The applicant, Mr. Robert Rivero submitted to the Planning Department an Environmental Review and Preservation Board Application (ERPB No. 07 -019), requesting approval for the new two -story residence. The subject property is specifically located at 7631 SW 59 Avenue, within the RS -3 "Low- Density Residential Zoning District." The approval process requires review by the Environmental Review and Preservation Board (ERPB) and a public hearing by the City Commission as required by City Ordinance No. 19 -07 -1920. The City Commission may waive the second story construction prohibition if the proposed project, including site plan and specifications was approved by the ERPB and meets the requirements in Ordinance No. 19 -07- 1920. ERPB ACTION: On July 17, 2007, the ERPB recommended final approval of a two -story residence with conditions. A copy of the ERPB's staff report and ERPB's excerpt minutes with approved conditions are provided as part of this document. This project was presented to the ERPB for preliminary and final review. Landscaping comments were provided by the ERPB members during preliminary review to enhance the building design. These comments were incorporated in the final design plans submitted to the ERPB for final review and approval. The Board members complimented the architect for the building design and the ability to incorporate the design into the local environment. The Board recommended approval by a vote of 5 ayes 0 nays. Attached are a set of final architectural plans submitted by the applicant. RECOMMENDATION• It is recommended that the Commission review this project for consistency with Ordinance No. 19 -07 -1920, and whether a waiver of the prohibition should be granted. WHEREAS, there has been much discussion and debate over the past number of months regarding the construction of new single family residential structures and additions to existing single family residential structures that appear to be too large for the building sites they occupy; and WHEREAS, it is believed that the aforesaid new construction and improvements to existing single family residences are only'the beginning of a trend that could increase as the older single family residences in the City are sold for demolition or reconstruction; and WHEREAS, the City Administration and the City Commission are concerned that the construction of these larger structures ( "MeMansions ") within established neighborhoods, adjacent to long standing smaller single family residences, is contrary to the established "character" of the neighborhoods in which they are located; and, WHEREAS, the City Manager has requested that certain preliminary study and research materials and an amendment to the Land Development Code be prepared and presented to the City Commission for review discussion and adoption; and WHEREAS, the City Manager, staff and the Planning Board have initiated a comprehensive review of the existing regulations; and, WHEREAS, in conjunction with the review it is also appropriate to provide temporary limitations, restrictions and prohibitions in regard to the issuance of building permits for the activities under study, due to the potential detrimental impact upon the existing neigbborhoods of the City; and, Additions shown by unde_,..,,rlinin and deletions shown by wing, Ord, loo. 19 -07 -1920 WHEREAS, although the City Commission is fully cognizant and respectful of the rights of the owners of single family residential properties in the City, the City Commission has determined that the potential for severe and detrimental consequences to the existing single family zoning districts of the City is realistic and likely if the unregulated construction of "McMansions" within the City is permitted to continue, and that the institution of an Interim Development Regulations is both required and justified at this time in order for a proper review and study of the problem and related issues to be conducted; and W_ HEREAS, the Planning Board at its December 12, 2006 meeting, after public hearing, adopted a motion by a vote of 6 ayes 0 nays recommending that the proposed ordinance be disapproved; and WHEREAS, the City Commission at its February 6, 2007 meeting adopted Ordinance No. 03 -07 -1904 which established the same Interim Regulations for single family residential structures for a period of three months which legislation expired on May 5, 2007; and WHEREAS, during the period February 6, 2007 and May 5, 2007 four workshops were held with members of the Planning Board, the Environmental Review and Preservation Board, the Historic Preservation Board, property owners, developers, and other stakeholders; and WHEREAS, an additional three months is now required to prepare an ordinance containing specific regulations to amend the Land Development Code and to conduct public hearings before the Planning Board and City Commission. NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA; Section Z. No building permits shall be issued for the construction of new, or for additions to existing single family residential structures, which construction shall result in the creation or addition of a second floor to the single fami ,ly structure. Section 2. For a building permit to be issued for either a new, or for an addition/remodel to a single - family structure, the structure shall comply with the dimensional requirements contained in section 20 -3.5 (E) of the South Miami Land Development Code. Section 3(A). The City Commission may waive the second story construction prohibition contained in this Interim Regulation if the proposed project, including site plan and specifications, is brought before the Environmental Review and Preservation Board (ERPB); the ERPB determines that the proposed structure complies with the applicable sections of the Land Development Code and the City Commission after public hearing determines that: Page 2 of 4 Ord. No. 19 -07 --1920 (a) the interim regulation imposes undue hardship on the applicant; or (b) the development proposed by the applicant will not: (i) result in a material diminution of the privacy of adjoining residential properties; and, (ii) will not result in an obvious departure from the aesthetic character of the immediate vicinity taking into account existing structures and open space; and, (iii) the proposed structure will have no more than a de min_imus impact on the use and enjoyment of the adjoining parcel; or (c) the applicant is proposing to mitigate the effect of the redevelopment by providing adequate safeguards which the Commission finds would adequately mitigate any detrimental impact to the neighborhood. Section 3 (B). The applicant for a waiver bears the burden of establishing sufficient evidence necessary to prove that the criteria contained in Section 3(A) have been satisfied. Section 3 (Q. An application for a waiver must be filed in conjunction with the ERPB application. The application for waiver shall be filed with the Planning Department on a form provided by the director and must include the following information: (a) the name and address of the applicant; (b) the address and legal description of the property; (e} evidence to support the criteria in Section 3(A); and (d) other information that the director may reasonably require to evaluate the waiver application. Section 3 (D }. The director shall make a recommendation to the ERPB and City Commission on each application for waiver. Section 4. Section 20- 6.1(C)(3)(f) is hereby amended, to temporarily expand the powers of the Environmental Review and Preservation Board (ERPB), to authorize the ERPB to review all single family residential additions /remodels or new construction, which propose the addition of the second floor. The ERPB in conducting such review shall implement the criteria established in this interim regulation. Page 3 of 4 Ord. No. 19-07- -1920 Section 5. Nothing in this ordinance should be construed or applied to abrogate the vested right of a property owner to develop or utilize his/her property in any other way commensurate with zoning and other regulations, including any required renewal of permits for existing legally erected premises. All site plans and building permits already being reviewed (prior to final passage of this interim regulation) by the City of South Miami's Department of Community Development or having received development approval may proceed forward and shall not be required to complywith this interim stay regulation. Section 6. EXPIRATION. September 5, 2007 This ordinance expires : at 1 1:59 p.m. Section 7. SEVERABILITY. The provisions of this ordinance are severable. If a provision of this ordinance or its applications to any person or circumstances is held invalid, the invalidity does not affect other provisions or applications of this ordinance. Section S. EMERGENCY DECLARED; EFFECTIVE DATE. The City Commission finds that the continued development of large single - family "McMansions" will negatively impact residential district within the City and that it is necessary to study and develop standards and regulations that protect the character of the residential communities. The City Commission further finds that this type of construction constitutes an emergency requiring the implementation of this interim regulation. Section 9. Location: 7631 SW 59 Avenue, South Miami Request: NEW CONSTRUCTION Review: Second Review (Final) Date: July 17, 2007 Tuesday 8:30 a.m. Re: ERPB -07 -019 STATUS REPORT: The Environmental Review and Preservation Board (ERPB) application was submitted to the Planning Department on March 12, 2007. The City Commission passed and adopted Ordinance No. 03 -07 -1904, on February 6, 2007, authorizing a study relating to the residential construction of two -story homes for a three month period, (a second story construction moratorium). The proposed subject property, which is a two -story home (building) with the detached accessory buildings, is NOT vested. Therefore, with the recommendation from the ERPB, the applicant will proceed to City Commission, which has the authority to waive the two -story prohibition. The applicant, followed by the City Commission's decision will proceed and apply for a building permit at Building Department. Please refer to the attached Ordinance No. 03- 07 -1904, which mandates that a single - family structure shall comply with the dimensional requirements contained in Section 20- 3.5(E) of the Land Development Code. At the April 3, 2007, ERPB meeting the subject property received preliminary approval with the Board's recommendations and staffs conditions are outlined on the ERPB preliminary report dated April 3, 2007. The attached ERPB minutes and preliminary ERPB staff report, dated April 3, 2007, outline those conditions. The ERPB application and report are included for reference. The Board was pleased with the design of the two -story residence including garage, tiki pavilion and detached structure. The accessory use structure consists of a covered terrace with studio and guest bedroom. The Board complimented the architect 'on a well designed home, the design responds architecturally to the environment. For example, the open space and exterior courtyards of the building design scheme, which allows for numerous windows that provide plenty of natural light and cross ventilation. Mr. David Trautman, ERPB chair, motioned for preliminary approval with the following staff's conditions: 1. Pending approval to waive the Second Story Construction Prohibition, Upon receiving the recommendation from the ERPB, the applicant will proceed to City Commission, which has the authority to waive the two -story prohibition. 7631 SW 59 Avenue ERPB -07 -019 presented on July 17, 2007 New Construction: Residential Page 2 of 6 2. Submit the grading and irrigation plan prior to final ERPB; Signed and sealed grading and irrigation plan, May 7, 2007, has been submitted for review and final approval; prepared by Donald A. Northcut, Landscape Architect, sheet C -1, IR -1 and IR -2. 3. Submit the engineering plans prior to final ERPB; and Signed and sealed grading and engineering plans have been attached for your review. Additional documentation has been included for reference and consideration of the proposed new construction. These include but are not limited to a site visit and current photographs of the subject property performed by the Planning Department staff, copies of the Building Department's permit record search from the Land Master File Inquiry, Miami -Dade Property Appraiser Tax Records for subject and surrounding properties (totaling eight properties), and photographs of surrounding properties (provided by applicant). Survey and Legal Description: See attached Map of Boundary Survey, signed and sealed by professional surveyor and mapper Walter E. Venega of Caribbean Land Surveyors, Inc., dated April 17, 2006. Existing Conditions: The property as described in the boundary survey is a one story c.b.s. residence with asphalt driveway leading to the double car garage, accessible from the side of the building. The property consists of a swimming pool, jacuzzi and wooden deck. The existing residence and existing swimming pool will be demolished and replaced with the proposed two story single - family residence. The property fronts SW 59 Avenue with a frontage of 110 feet in width, which exceeds the 75 feet minimum frontage requirements set forth in the RS -3 zoning district. The property consists of a side length of 371.01 feet, with a total lot size of 40,810 square feet net area, which exceeds the 10,000 square feet minimum lot size net area set forth in the RS -3 zoning district, Section 20- 3.5(E), Land Development Code. Landscaping Plan: Mr. Donald A. Northcut, Landscape Architect, has implemented and revised the landscape plan, sheet L -1, incorporating Mr. Bedell's (ERPB member) comments from the preliminary (first review) ERPB meeting. Those comments are noted on the ERPB minutes of April 3, 2007 and the revisions are noted on the landscape plan as revision number 1, and dated April 24, 2007. A tree removal permit has been submitted and approved with conditions. Refer to the attached tree removal application, and landscape plan for additional information. Also attached are the Performance Bond Calculation Sheet, Transferal Letter, and a copy of the letter of credit from the Commerce Bank, the applicants' bank. Please refer to these documents for additional information. The landscape plan submitted to the City is consistent with the 7631 SW 59 Avenue ERPB -07 -019 presented on July 17, 2007 New Construction: Residential Page 3of6 requirements set forth in Section 20 -4.5, Land Development Code. The plan includes a detailed description of the landscaping schedule, including tree names and pertinent information. The number of existing trees that will be protected, existing trees to be removed, and trees to be added as part of the proposed project can be found on the proposed landscape plan. Pursuant to Section 20- 4.5(D)(5)(b) of the Land Development Code, the minimum number or trees required for the RS -3 zoning district are three trees per lot. The proposed landscape plan identifies a total of twenty (20), sheet L -1 and L -2. Site Plan (Zoning District: "RS -3" Medium Lot Single- Family Residential District): The intent of this district is to provide for low — density residential development located in a moderately spacious setting which emphasizes the preservation of open space. The proposed site plan depicts a two story residence, which consists of linear spaces with cross ventilation, a swimming pool and outdoor landscape pervious areas. The site plan illustrates slope directions for water retention throughout the lawn areas of the subject property. However, grading and irrigation plans have been submitted for review. Applicant must meet the requirements of the storm water ordinance. The intent of the ordinance is to "require all properties to retain storm water drainage on site . as to prevent development that would result in contributing to or causing recurrent ponding on adjoining properties or public right-of-way." The building dimensional requirements are guided by Section 20- 3.5(E), Land Development Code. The calculations on the site plan (zoning legend) of the proposed total net site area is (110' -0" x 371' -0 ") 40,810 square feet, which exceeds the minimum total area (10,000 square feet) required by the Land Development Code. The proposed building coverage calculation includes the two -story home (main house) building including covered terraces (1,129.4 square feet), garage (840 square feet), and tiki pavilion (482 square feet) at a sub total of 6,603.4 square feet. The accessory structure (detached) building consists of a covered terrace with studio and guest bedroom (1,525 square feet) at a total of 8,128.4 or 19.9% of the maximum building coverage; that does not exceed the maximum building coverage (12,243 square feet or 30 %) allowed by the Land Development Code. The proposed second floor (2,061.6 square feet or 23.5% of the maximum building coverage allowed for the first floor) does not exceed the maximum allowable building coverage of 3,961.8 square feet at 60% of the first floor (does not include the square footage of the accessory structure (detached). The proposed first floor building front setback (64' --11 "), exceed the 25' -0" feet minimum front setback required. The proposed first floor building rear setback (25' -0 "), comply with the 25' -0" minimum rear setback required. The proposed two story portion of the building is at a front setback (136' -0 "), exceed the 25-0" feet minimum front setback required. The proposed two story portion of the building rear setback (211' -0 "), exceed the 25' -0" feet minimum rear setback required. The proposed first floor building side setbacks (north side 11' -3" and south side 11' -3 "), exceed the required cumulative widths for both side yards. The proposed second floor building side setbacks (north side 16' -0" and the south side 16 -0 °), exceed the 15' -0" minimum required second floor side setback The subject property is a narrow and deep lot in configuration and providing greater setbacks than the minimum required has allowed the proposal of additional green area and open spaces on the front and rear yards. Greater setbacks provide other positive impacts, such as a greater separation between the abutting buildings and a greater distance on the visual impact of the two -story building from the right -of -way. The proposed impervious coverage includes the building and detached accessory structure, swimming pool, deck area, coral stone driveway and two ponds. The calculation provided for impervious coverage (14,411.2 square feet or 35.3 %) does not exceed the 40% maximum impervious coverage allowed (16,324 square feet or 40 %) by the Land Development Code. Elevations: The building height dimensions, building finishes and materials are noted on the elevations, sheet number A -5. The front facade, the west elevation, illustrates a symmetrical two -story building with oolite stone at the first floor level. For additional balance and harmony to the facade, a one -story three car garage which is located and accessible by the side is attached with a structure to the foyer, also a one -story structure. The south and north elevations depict the massing (one -story and /or two - story) allowing to determine the negative impact, if any on the abutting properties. The proposed windows, located at the south and north wall of the two -story portion of the building, are located by the stairs and walk -in- closets on either side. The front/west facade of the two -story building consist of a balcony at either side and a hallway that connects to the three proposed bedrooms, facing the front yard to SW 59 Avenue. The rear /east facade of the two -story building consists of a covered terrace, which stretches and also connects to the three bedrooms, which overlook the rear yard. Furthermore, these spaces adjacent to the bedrooms create a buffer between the bedrooms and the exterior, a double wall for privacy. Applicant has submitted photographs of the subject property and photographs of the neighbors whose properties are two -story. An aerial photographs depicting the location of these properties. In addition, ERPB has approved a two -story residence at 7630 SW 59 Avenue, across the street from the subject property. The location of proposed windows at the second floor and weather or not is a privacy issue was a concern raised by the Planning Director. Palms: a. A ball of earth at least one (1) foot from the base of the trees shall be moved with the tree; b. Fronds shall be securely tied around the bud prior to relocation and shall remain securely tied around the bud during the entire relocation process and for a minimum of one (1) week after relocation; and, c. Any palm that dies or becomes nonviable within one (1) year of relocation shall be replaced according to the standards set forth in Section 20- 4.5(7)(2) & (3) of the Land Development Code. 3. Preservation credit for relocated trees. Permittees who successfully relocate trees shall receive full credit for the relocated trees and the tree replacement requirements herein shall not apply to such relocated trees.
